The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, February 21, 2016 at 9:00 a.m.

The meeting was called to order by Board Chairperson Key.

Resolution No.:  2017-034

Whereas, Fitzgerald Excavating and Trucking Inc. is the lowest responsible bidder for SAP 079-627-007.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that Wabasha County hereby accepts the bid of and hereby awards a contract to Fitzgerald Excavating and Trucking Inc. for SAP 079-627-007 in the amount of $302,073.45 and that the Chair of the County Board and the County Administrator are hereby authorized to execute a Contract with Fitzgerald Excavating and Trucking Inc. for this work.

Resolution No.:  2017-035

Whereas, Fitzgerald Excavating and Trucking Inc. is the lowest responsible bidder for SAP 079-608-013.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that Wabasha County hereby accepts the bid of and hereby awards a contract to Fitzgerald Excavating and Trucking Inc. for SAP 079-608-013 in the amount of $1,635,538.15 and that the Chair of the County Board and the County Administrator are hereby authorized to execute a Contract with Fitzgerald Excavating and Trucking Inc. for this work.

Resolution No.:  2017-036

Whereas, Rochester Sand and Gravel – Division of Mathy Construction Company is the lowest responsible bidder for SAP 079-608-014.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that Wabasha County hereby accepts the bid of and hereby awards a contract to Rochester Sand and Gravel – Division of Mathy Construction Company for SAP 079-608-014 in the amount of $964,656.94 and that the Chair of the County Board and the County Administrator are hereby authorized to execute a Contract with Rochester Sand and Gravel – Division of Mathy Construction Company for this work.

Resolution No.:  2017-037

Whereas, CP 79-16-8210 with any and/or all Supplemental Agreements, Change Orders or Work Orders, has been completed. 

Now Therefore be it Resolved by the Wabasha County Board of Commissioners the Wabasha County Auditor/Treasurer be authorized to issue a warrant for final payment to Traffic Marking Service Inc. for completion of CP 79-16-8210 in the amount of $2274.30.

Resolution No.:  2017-038

Whereas, SP 079-625-015, SP 079-602-039 and SP 079-070-007 with any and/or all Supplemental Agreements, Change Orders or Work Orders, has been completed. 

Now Therefore be it Resolved by the Wabasha County Board of Commissioners the Wabasha County Auditor/Treasurer be authorized to issue a warrant for final payment to Chippewa Concrete Services Inc. for completion of SP 079-625-015, SP 079-602-039 and SP 079-070-007 in the amount of $213,086.41.

Resolution No.: 2017-039

Whereas, Wabasha County has reviewed the pertinent data on bridges requiring replacement, rehabilitation, or removal; and

Whereas, Wabasha County has identified those bridges that are high priority and has previously established a list of those bridges that require replacement, rehabilitation, or removal; and

Whereas, the following additional bridges have been since identified as also requiring replacement, rehabilitation, or removal.

Now Therefore Be It Resolved by the Wabasha County Board of Commissioners that, the following bridge is a high priority and Wabasha County intends to replace, rehabilitate, or remove this bridge as necessary when funds are available.

Be It Further Resolved that Wabasha County does hereby request authorization to replace, rehabilitate, or remove such bridge and authorizes the Wabasha County Engineer to request funds.

Resolution No: 2017-040

Resolution Authorizing

2017 State of Minnesota DNR

Annual County Boat and Water Safety Grant

Contract #120418

Whereas, the Wabasha County Sheriff’s Office has been authorized to participate in the 2017 State Boat and Water Safety Grant; and,

Whereas, the Sheriff’s Office has received the 2017 contract which needs to be approved and signed by the Sheriff, County Auditor or County Administrator and County Board Chairperson; and,

Whereas, the Sheriff requests the approval and signing of the 2017 State of Minnesota (DNR) Annual County Boat and Water Safety Grant Agreement by the County Administrator and Chairman of the County Board.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: the 2017 State of Minnesota (DNR) Annual County Boat and Water Safety Grant Agreement is hereby approved and authorizes it’s signing by the County Administrator and Chairman of the County Board.

Resolution No.:  2017-041

Approval of Contract for Audit Services

Whereas,  Wabasha County has notified the Office of the State Auditor that its annual financial audit will be preformed be a Certified Private Accounting (CPA) firm that meets the requirements established by Minnesota Statutes, section 326A.05, and

Whereas, a Request for Proposal was sent to a list of potential providers of audit services, and

Whereas, EideBailly submitted the lowest fee structure for audit services for the years 2017 through 2019.

Now Therefore, be it resolved, that the Wabasha County Board of Commissioners hereby approves the attached contract from EideBailly to provide auditing services for the fiscal year ending December 31, 2017.

Whereas, the following applicant wishes to have their MN Lawful Gambling Exempt Permit approved:

Whereas, Exempt Permit is for gambling at BJ’s Bar & Grill 61486 County Road 86 Theilman, MN 55945, Highland Twp.

Whereas, the application have been approved by Highland Twp Board. The permit runs for 1 day-September 23rd, 2017.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners hereby approves, the MN Lawful Gambling Exempt Permit for Millville Hunting & Shooting Club of Southern MN at BJ’s Bar & Grill.

Whereas, the following applicant wishes to have their MN Lawful Gambling Exempt Permit approved:

Whereas, Exempt Permit is for gambling at BJ’s Bar & Grill 61486 County Road 86 Theilman, MN 55945, Highland Twp.

Whereas, the application have been approved by Highland Twp Board. The permit runs for 1 day-March 18th, 2017.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners hereby approves, the MN Lawful Gambling Exempt Permit for Whitewater Longbeards-NWTF at BJ’s Bar & Grill.

Resolution No.: 2017-044

Whereas, the Wabasha County Board of Commissioners has by Resolution previously authorized the County Engineer to acquire the right of way as described below in accordance with applicable laws and statutes for the purpose of reconstructing County State Aid Highway 8 under project SAP 079-608-013; and

Whereas, improvements under project SAP 079-608-013 are necessary in order to improve this segment of County State Aid Highway 8 to provide for public health, welfare, safety and convenience; and

Whereas, Wabasha County has been unable to successfully negotiate the acquisition of the following necessary right of way:

That part of the Northwest Quarter of Section 16, Township 108, Range 11, Wabasha County, Minnesota, described as follows:

Commencing at the northwest corner of said Section 16; thence South 89 degrees 34 minutes 39 seconds East, oriented with the Wabasha County coordinate system NAD 1983, 1996 adjustment (HARN), along the north line of the Northwest Quarter of said Section 16, a distance of 833.14 feet being the point of beginning of the easement to be described; thence South 0 degrees 00 minutes 00 seconds East, a distance of 40.00 feet; thence South 89 degrees 34 minutes 39 seconds East, a distance of 852.58 feet; thence North 00 degrees 00 minutes 00 seconds East, a distance of 40.00 feet; thence North 89 degrees 34 minutes 39 seconds West, along said north line of said section 16, a distance of 852.58 feet to the point of beginning. Containing 0.78 acres, more or less, of which 0.14 acres, more or less is new highway easement and 0.64 acres, more or less of existing easement previously obtained by prescription or written easement.

Also That part of the Southwest Quarter of Section 9, Township 108, Range 11, Wabasha County, Minnesota, described as follows:

Commencing at the southeast corner of southwest quarter of said Section 9; thence North 89 degrees 34 minutes 39 seconds West, oriented with the Wabasha County coordinate system NAD 1983, 1996 adjustment (HARN), along the south line of the Southwest Quarter of said Section 16, a distance of 748.02 feet being the point of beginning of the easement to be described; thence North 01 degrees 15 minutes 27 seconds West, a distance of 40.02 feet; thence North 89 degrees 34 minutes 39 seconds West, a distance of 226.10 feet; thence South 00 degrees 00 minutes 00 seconds East, a distance of 40.00 feet to the southerly line of said section 9; thence South 89 degrees 34 minutes 39 seconds East, along said southerly line of said section 9, a distance of 226.98 feet to the point of beginning.  Containing 0.21 acres, more or less, of which 0.04 acres, more or less is new highway easement and 0.17 acres, more or less of existing easement previously obtained by prescription or written easement.

Also A Temporary Easement over, under and across 0.16 acres of that part of the Northwest ¼ Section 16, Township 108 North Range 11 West and that part of Southwest ¼ Section 9, Township 108 North Range 11 West as illustrated and defined on the construction plans for SAP 079-608-013.  This Temporary Easement will expire December 31, 2018 or upon completion of project S.A.P. 079-608-013 whichever date may be later.

Whereas, Wabasha County has the authority to acquire the necessary right of way for this project by Eminent Domain.

Now Therefore Be It Resolved by the Wabasha County Board of Commissioners that, the Wabasha County Attorney is hereby authorized to commence eminent domain actions for the acquisition of the above described right of way.

Highway: County and Plainview Township Road 550th Street Discussion

Consensus given to Highway Engineer

Resolution No.: 2017-045

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the Wabasha County Highway Department is hereby authorized to advertise and hire three 2017 Part-Time Temporary Seasonal Employment Positions at the County Engineer’s recommended wage of $10 to $15 per hour.

Resolution No: 2017-046

Resolution revising Resolution #2009-069 regarding the use of Impound Lot Funds

Whereas, on April 21, 2009, the County Board authorized Resolution #2009-069 regarding the Wabasha County Sheriff’s Office request to set up a fund for an Impound Lot at the Criminal Justice Center; and,

Whereas, the fund would help offset costs for upkeep and maintenance; and,

Whereas, any remaining funds would be used toward a future storage building on this same lot.

Whereas, the Wabasha County Sheriff’s office is now requesting to revise the original resolution to include authorizing this fund to be used for equipment in squads in addition to the upkeep and maintenance. 

Whereas, a future storage building is no longer planned.  Therefore, this specific language may be removed.

Now Therefore be it Resolved that the Wabasha County Board of Commissioners hereby: approves revising Resolution #2009-069 to include authorizing this fund to be used for equipment in squads in addition to the upkeep and maintenance of the lot. 

Whereas, be it further resolved that the Wabasha County Board of Commissioners hereby: authorizes the removal of the language which indicates any remaining amount to be used toward a future storage building on the lot.
