The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Wednesday, July 5, 2017 at 9:00 a.m.

The meeting was called to order by Board Chairperson Key.

Resolution No: 2017-131

Resolution Authorizing license renewal L-214 regarding Lake City ARMER Tower

Between Wabasha County and the Department of Transportation (DOT)

Whereas, Wabasha County originally entered into License No. L-214 dated July 3, 2007 for the use of the County’s property for MNDOT’s Lake City ARMER Tower along with Amendment 1, dated August 28, 2007 and Amendment 2, dated March 31, 2009.  These amendments were previously authorized via resolutions #2007-139 and #2009-106; and,

Whereas, The Public Safety (PSAP) Supervisor recommends exercising Option #2 of license agreement No. L-214 under Section 6 “Option to Renew” for a period of five (5) years commencing June 1, 2017 and expiring on May 31, 2022; and,

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: The County is hereby authorized to renew license agreement No. L-214 between Wabasha County and the Department of Transportation (DOT) for a period of five (5) years commencing June 1, 2017 and expiring on May 31, 2022.

Resolution No: 2017-132

Security Assessment

Whereas, Over the last year Wabasha County has focused on improving the security of our primary office buildings both to increase the security for the citizens we serve as well as the employees who work in those buildings.  In an effort to help prioritize potential enhancements, and the way funding is utilized, it would be beneficial to have a security assessment completed; and

Whereas, The Minnesota Sheriff’s Association has agreed to provide those services and their rates were significantly less than other options that were reviewed.  The cost for the assessment would be $6,000.  Currently the plan is to utilize funds from the Recorder’s Office, Human Services, and from the Sheriff and County Attorney’s forfeiture funds.  However, additional limited funding may be needed; and

Now Therefore Be It Resolved by the Wabasha County Board of Commissioners that the County Administrator is authorized to work with the Minnesota Sheriff’s Association to complete the referenced assessment.

SPRINGER-KEY TO INCREASE WHEELAGE TAX FROM $10 TO $20

Resolution No.: 2017-133

Whereas, the 2013 State of Minnesota Legislative Session approved legislation authorizing all counties to levy a wheelage tax under Minnesota Statute 163.051, and

Whereas, Wabasha County has previously enacted a wheelage tax at a rate of $10 on each motor vehicle.

Now Therefore Be It Resolved that the Wabasha County Board of Commissioners hereby authorizes and levies a wheelage tax as provided in Minnesota Statutes 163.051 in an amount of $20 per year on each motor vehicle as applicable under State Statute and effective starting in a registration period on January 1, 2018.

Be it Further Resolved that the Wabasha County Board of Commissioners hereby requests that the wheelage tax continue to be collected by the State Registrar of Motor Vehicles, as provided for in Minnesota Statutes 163.051.

Be it Further Resolved that the Wabasha County Board of Commissioners hereby authorizes the Wabasha County Auditor/Treasurer to certify the levied wheelage tax to the State Registrar of Motor Vehicles before August 1, 2017 and that the tax be effective January 1, 2018.

WOBBE-SPRINGER

Resolution No: 2017-134

Resolution to purchase a Mobile Data Terminal (MDT) using Impound Lot Funds

Whereas, it was originally intended to purchase a Mobile Data Terminal (MDT) for the FPI Investigator position.

Whereas, due to the hire of an additional Investigator, there are not enough funds to cover this purchase; and,

Whereas, the Wabasha County Sheriff’s office is requesting to purchase a Mobile Data Terminal (MDT) unit using Impound Lot funds.  This would also include printer and accessories, license, software, and installation. 

Whereas, the cost will not exceed $9,000.

Now Therefore be it Resolved that the Wabasha County Board of Commissioners hereby: authorizes the Wabasha County Sheriff’s Office to purchase a Mobile Data Terminal (MDT) unit, to include printer, accessories, license, software and installation costs using Impound Lot funds. 

Whereas, be it further resolved that the Wabasha County Board of Commissioners hereby: The cost is not to exceed $9,000.

Resolution Number: 2017-135

Denial of Chelsea Rabehl Clark Conditional Use Permit Application

Whereas, On April 13, 2017 a complete application for a Conditional Use Permit was submitted by Chelsea Rabehl Clark for a horse boarding facility on parcel R16.00231.00 located in Section 29, Township 110 North, Range 12 West, Town of West Albany; and

Whereas, The Wabasha County Planning Commission conducted a public hearing on May 22, 2017 and on June 27, 2017  to provide an opportunity for the public and the Board of West Albany Township to present any testimony related to the request; and

Whereas, The Wabasha County Planning Commission discussed the matter after the public hearing and with a vote of 5-0 recommends to the Wabasha County Board of Commissioners that the request be denied.

Now Therefore Be It Resolved, the Wabasha County Board of Commissioners denies the Conditional Use Permit application for Chelsea Rabehl Clark for a horse boarding facility based upon the reasons as follows:

1.    The conditional use will be injurious to the use or enjoyment of other properties in the immediate vicinity and will substantially diminish or impair property values in the vicinity.

2.    The conditional use will impede the normal, orderly development or improvement of surrounding vacant property for uses predominant to the area.

3.    There are not adequate utilities, access roads, drainage, soil erosion control measures, or other necessary facilities for the business.

4.    Adequate measures have not been addressed to prevent or control offensive odor, fumes, dust, noise, vibration, or light so as to keep the business from being a nuisance or disturbance to the neighbors.

5.    Other factors bearing on public health, safety, and welfare that would dictate either approval or granting of the conditional use permit have not been adequately addressed.

Resolution No.: 2017-136

Labor Negotiation Strategy

Whereas, Minn. Stat. §13D.03 subd. 1(a) permits closing a County Board meeting for the purposes of discussing labor negotiation strategy;

Whereas, the County Board desires to consult regarding the best course of action to take during the ongoing labor negotiations;

Whereas, it is not possible to fully discuss strategy and the options available to the County in a public meeting;

Whereas, certain phases of the negotiation strategy may be impaired if every discussion is available for the benefit of opposing parties;

Whereas, the County Board wishes to meet with to discuss the pros and cons, and strategy regarding the labor negotiations, and finds that such a discussion cannot be had in public session;

Whereas, based upon the foregoing the Board finds there is an absolute need for confidentiality of this matter;

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that a closed meeting of the County Board concerning labor negotiations will be held. No subject matter other than the foregoing shall be discussed at said meeting.
