Meeting of December 15, 2009
The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Services Building, in the City of Wabasha, Minnesota on Tuesday, December 15, 2009 at 9:00 a.m. The meeting was called to order by Board Chairman Windhorst. The following Commissioners were present: Windhorst, Dwelle, Riester, Norman and Hall.
DWELLE - RIESTER
Motion to approve the agenda.

Commissioners reported on meetings they attended.
Administrator’s Update: MCIT Certificates- very little money paid out in workers’ comp.
Tom Gosse came before the Board with concerns about County Road 86.
HALL - DWELLE
Motion to approve the consent agenda including the following: Claims Meal Vouchers SSIS Claims Minutes: November 24, 2009 and December 1, 2009

RIESTER - DWELLE
Resolution No.: 2009-221
Whereas, in accordance with Minnesota Statutes 97A.145 Subd. 2, the Commissioner of the Department of Natural Resources on December 15, 2009 provided the county board with a description of lands to be acquired by the State of Minnesota for state land purposes.
Whereas the lands to be acquired are described as follows: The E1/2 Of The SESW Of SECTION 26 TOWNSHIP 110N RANGE 12W
Now, therefore be it resolved by the Wabasha County Board of Commissioners on December 15, 2009 that the State’s acquisition of the above described property be approved.

Approve snowmobile trail lease renewal.

Joe Wheeler from SEMMCHRA stated that the original request from the county was lowered by $73,682. SEMMCHRA staff gave up part of their COLA for 2009 and all of their COLA for 2010. They also gave up Merit increases for 2009 and 2010. They also laid off a full time staff person.
County Engineer Dietrich Flesch came before the Board to discuss Road Jurisdictions and receive some direction from the Board. It was recommended by the Board that he bring the information to the Township Meetings.
NORMAN - DWELLE
Resolution No.: 2009-222
Whereas, the Wabasha County Board approved for the Youthlink Mentorship Program be coordinated by the Family Services Aide II position, effective 05/19/09, and
Whereas, Social Services has combined the duties of the Youthlink Mentorship Program Coordinator with the Family Service Aide II position, and
Whereas, the Wabasha County Restorative Justice Program facilitated through the Probation Department has been eliminated due to budget shortfalls, and
Whereas, the Probation Department has a remaining Restorative Justice budget of $1512, and
Now Therefore Be It Resolved by the Wabasha County Board of Commissioners that the Finance Director be authorized to approve an inter-fund transfer from the Probation General Fund- Restorative Justice (Fund 252) to the Social Services Fund (Fund 11) in the amount of $1512 to cover the expenses of the Youthlink Mentorship Program.

Resolution No.: 2009-223
Whereas, Wabasha County has completed the hiring process for the retention of an Assistant Wabasha County Attorney, and
Whereas, the County of Wabasha has offered and Renee Carlson has accepted the position of Assistant Wabasha County Attorney, Now, Therefore, be it resolved that the Wabasha County Board of Commissioners hereby authorizes the employment of Renee Carlson as Assistant Wabasha County Attorney at Step 2 of the 2009 pay grid. Ms. Carlson’s starting date of employment shall be January 6, 2010.

Whereas, the Wabasha County Attorney position is currently officially a part-time position even though it is paid as a full time position, and; Whereas, the County Attorney already works as though the position were already a full-time position, and;
Whereas, it is best business practice to have a Full-Time County Attorney.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that effective January 1, 2010, the position of County Attorney become a full-time position.

Resolution No.: 2009-225
Whereas, the County has budgeted cost of living increases per the Union Contracts of 2.75% as well as the same cost of living increases for non-union employees, and;
Whereas, the County Board of Commissioners did not accept a cost of living increase in 2009, and;
Whereas, State Statute requires that changes in County Commissioner salaries be approved prior to the end of the calendar year for the upcoming year.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that they approve a 2.75% cost of living increase, the same cost of living increase as county employees.
Died for a lack of second
Commissioner Riester made a motion to take a 1.5% increase. This motion died for a lack of a second.
DWELLE – HALL

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that they approve a 0% cost of living increase.

Resolution No: 2009-226
Whereas, the Wabasha County Sheriff’s Office has a Joint Powers Agreement with the Southeast Minnesota Narcotics and Gang Task Force; and,
Whereas, the Joint Powers Agreement has now been amended from the original agreement implemented in approximately 1987; and, Whereas, the Sheriff’s Office has received the amended Joint Powers Agreement between the Wabasha County Sheriff’s Office and the Southeast Minnesota Narcotics and Gang Task Force which needs to be approved by the County Board and signed by the Sheriff; and, Whereas, the additions that are highlighted in red are related to and required by the Grant. These two topics had not been addressed before. The Task Force Attorney, James Martinson, reviewed the additions.
Whereas, the Sheriff requests the approval and signing of the Amended Joint Powers Agreement between the Wabasha County Sheriff’s Office and the Southeast Minnesota Narcotics and Gang Task Force.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: the Amended Joint Powers Agreement between the Wabasha County Sheriff’s Office and the Southeast Minnesota Narcotics and Gang Task Force is hereby approved and authorizes it’s signing by the Sheriff.

Resolution No.: 2009-227
Whereas, Wabasha County desires to purchase ARMER 800mhz portable law enforcement radios; and
Whereas, Whitewater Wireless Inc. provided a bid thru state contract pricing; and
Whereas, the cost incurred in this upgrade is a 80/20% reimbursement matching grant, with 2007 PSIC to pay a 80% reimbursement amount of ($36800.00), and E-911 radio capital improvement project to pay upfront cost of $46,000.00, with actual cost of $9,200.00; and Whereas, the monies for this upgrade will come out of the E-911 (290) account;
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: The Chairperson of the Wabasha County Board of Commissioners is hereby authorized to purchase said portable radios from Whitewater Wireless, Inc, at the cost of $46,000.00. Be it further resolved that funding of the upgrade will come from the 911 (290) account.

Resolution No.: 2009-228
Whereas, the Wabasha County Courthouse has not been in compliance with ADA requirements since the inception of the Americans with Disabilities Act, and;
Whereas, 25 years ago the Wabasha County Board of Commissioners committed to make all Wabasha County facilities ADA accessible, and;
Whereas, the County has the opportunity to consolidate offices and services in the Courthouse and Services Building, at the same time divesting ourselves of the expense of maintaining the Public Health building, and;
Whereas, the Wabasha County Board in 2002 allocated $350,000 to be used for ADA compliance in the Courthouse, and;
Whereas, for the wellbeing of our citizens and employees it is financially prudent to invest this money in making the Courthouse ADA compliant, as the savings from maintaining the Public Health building can pay for the ADA compliance project in a relatively short period of time, allowing the County to replace the allocated funds currently in our reserves, and;
Whereas, this consolidation of offices and services can only be accomplished by approving and implementing the elevator option as bid, and;
Whereas, the bids for this project came in slightly less than anticipated.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that Option 1 (Elevator and first floor ADA restroom) and Alternate 2 (Second Floor ADA restroom) be approved.

RIESTER - DWELLE
Resolution No.: 2009-229
Whereas, Wabasha County Board of Commissioners adopted a new Policies and Procedures Manual on June 27, 2008, and;
Whereas, this Policies and Procedure Manual included employment processing, and;
Whereas, this policy has not been followed by all department heads, resulting in individuals not meeting the minimum job requirements being hired, and vacancies being filled without the prior approval of the Board.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the County Administrator, in his role as Human Resources Director, is directed to not place individuals on the County payroll when County policy has not been followed.

County Attorney Jim Nordstrom gave an overview of what was discussed during the closed session with the Teamsters Union. Topic of discussion was the sergeants position at the jail, the naming of the position, and whether or not there should be a pay differential for the position of sergeant.
