Meeting of November 3, 2009
The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Services Building, in the City of Wabasha, Minnesota on Tuesday, November 3, 2009 at 9:00 a.m. The meeting was called to order by Board Chairman Windhorst. The following Commissioners were present: Windhorst, Dwelle, Riester, Norman and Hall.
DWELLE - HALL
Motion to approve the agenda.

Commissioners reported on meetings they had attended. Administrator’s Update Eagle Basin, Joe Wheeler, bank financing change, future meeting, request for less Courthouse/Annex preliminary plans and schedule Contract extension for CAM Pay equity-failed, some pay grids will need to be changed Two years state aid gone - AMC Public forum comments made by Donald Tradup in regard to the bike trail.

Resolution No.: 2009-204
Whereas, Kimball Excavating, Inc. was awarded Contract No. 08007 for Project S.A.P. 079-599-074, and
Whereas, Kimball Excavating, Inc. has failed to meet the necessary requirements required under the Contract including contract labor provisions, and
Whereas, Kimball Excavating, Inc. and its’ Surety have been notified by certified mail of Breach of Contract and have failed to satisfactorily correct the necessary Contract requirements.
Now Therefore be it Resolved that the Wabasha County Board of Commissioners hereby terminates Contract No. 08007 with Kimball Excavating, Inc. for Project S.A.P. 079-599-074.

Resolution No.: 2009-205
Whereas, combined Projects S.A.P. 079-997-001 and S.A.P. 079-997-002 – RipRap at various locations along CSAH 11 and CR 68 in Wabasha County, with any and/or all Supplemental Agreements, Change Orders or Work Orders, have been completed.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Wabasha County Auditor/Treasurer be authorized to issue a warrant for final payment to Schumacher Excavating, Inc. in the amount of $28,668.38.

Resolution No.: 2009-206
Whereas, Wabasha County is obligated to maintain County State Aid Highways within cities throughout the County, and
Whereas, it is more expedient for the citizens of the listed cities to have those cities perform the maintenance activities of snow and ice control and removal, and sweeping and removal of debris.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the County of Wabasha enter into the attached agreements for the maintenance activities described above with the City of Elgin, Kellogg, Mazeppa, Millville, Plainview and Wabasha, and authorizes the Chairman of the Board and County Administrator to execute the Agreements. The table below is a summary of the mileages and payment amounts of the agreements.

RIESTER – HALL
Resolution No.: 2009-207
Whereas, the 16 counties and 1 tribal community in Southeast MN that are the committee members of Region One – Southeast Minnesota Homeland Security and Emergency Management, desire to establish a mechanism whereby they may jointly exercise powers common to each party on issues requiring regional coordination by creating a Joint Powers Agreement; and
Whereas, the committee for said Joint Powers Agreement shall be made up of one voting member from each county and the tribal community; the member from Wabasha County shall be County Emergency Management Director, a Wabasha County Board Member may serve as alternate; and
Whereas, this Joint Powers Agreement includes an Indemnification and Hold Harmless clause that protects the parties against claims, liability, judgments, and other negative actions by reason of the action or inaction of the committee; and
Now, Therefore, be it resolved that Wabasha County approves and agrees to join in the Joint Powers Agreement for Region One – Southeast Minnesota Homeland Security and Emergency Management.

Deb Koenig, Finance Director came before the Board to give an investment report. Deb stated that low interest rates are affecting the report. The budget report is looking very good according to Deb.
NORMAN – DWELLE
Resolution No.: 2009-208
Be It Resolved that the Wabasha County Board of Commissioners hereby Authorizes payment from the Feedlot III low cost share fix 319 grant for Maynard Schumacher regarding his water quality fix to meet the 2010 Open Lot Agreement in the amount of $3000.00

Feedlot Officer Troy Dankemeyer update the Board on the SE MN Volunteer Nitrate Monitoring Project.
Floyd Riester, County Zoning Administrator came before the Board to discuss Wind Energy. He requests a one-year moratorium on Wind Generators. He would like to place wind generator regulations in the Zoning Ordinance.
Sheriff Rodney Bartsh and the Jail Administrator Charlene Rickard came before the Board. Topics for discussion were transport deputies, transition team members, new squad cars, staffing and budgeting. The first question addressed by the jail administrator was to clarify the number of hours needed to train the new jailers. She explained to the Board where she came up with the hours needed to train the jailers. Sheriff Bartsh answered questions about deputy schedules, comp time and safe driving class. This item will be brought back to the next meeting for more discussion.
