MINUTES - REGULAR MEETING – TUESDAY, MAY 19, 2009
The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Services Building, in the City of Wabasha, Minnesota on Tuesday, May 19, 2009 at 9:00 a.m. The meeting was called to order by Board Chairman Windhorst. The following Commissioners were present: Windhorst, Dwelle, Riester, Norman and Hall.
HALL - DWELLE
Motion to approve the agenda.

Commissioners reported on meetings they had attended.
During the Administrator’s Update, Dave Johnson mentioned that there were no bids on the criminal justice center land lease. The Fitzgeralds offered $70 per acre plus personal property tax. Also, the 2004 Dodge Intrepid from the Sheriff’s Office sold for $1,036.01, it had 179,000 miles on it. It was sold on Ebay. There was no public comment during the public forum.

Accept Donation of $5,000 from Olmsted County for the Impound Lot Fund.

PSC, the company the County hired to do a study on Dispatch and Radio Systems, presented the Board with their findings on what it would cost to keep dispatch within the county or take it to another location. They looked at three alternatives besides keeping the dispatch in the county. They looked at Goodhue County, the City of Rochester and Winona County. Goodhue County is in the process of updating their dispatch system and could dispatch Wabasha County. Rochester is compatible with Wabasha County but would need to add a position. Winona County has an outdated dispatch system and they would have to update their system. PSC stated that Winona County is not a suitable environment for contracting services. Remodeling would be required to dispatch out of Rochester and Winona. Dispatching could be done out of Goodhue County with very little disruption. Goodhue County currently runs with 12 full time dispatchers and 1 part timer. Rochester has 24 full time dispatchers. Winona County has 10 full time dispatchers and 1 part timer. If dispatch were to move to either Rochester, Winona County or Goodhue County they would need to add one position (3 bodies), 24 hours a day to support Wabasha County. Winona would be the most costly to dispatch from. Conversion complexity is highest for Rochester. The earliest service available if dispatch was moved out of the county would be sometime in 2010. The capital investment for leaving dispatch in Wabasha County is about $1.387 million. PSC’s recommendation given nothing other than dollars is to keep dispatch within the county.

Resolution No.: 2009-103
Whereas, the Wabasha County Highway Department finds it beneficial to purchase one Tandem Truck, and
Whereas, with the purchase of one Tandem Truck, Unit 951 – Ford Tandem Truck is considered excess.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Wabasha County Highway Department be authorized to purchase one International Tandem Truck from Astleford International Trucks in an amount of $59,240.22 considering the trade-in value of Unit 951, and hereby authorizes the County Auditor/Treasurer to issue warrants for applicable sales tax and license fees of the truck.
Be it further resolved that the Wabasha County Board of Commissioners hereby declares Unit 951 – Ford Tandem Truck as Excess Equipment and authorizes the County Engineer to dispose as a trade-in allowance.

Resolution No.: 2009-104
Whereas, Wabasha County is the owner of Flood Control Easements granted to the County on April 6, 1972, filed February 20, 1974, in Book 157 of Deeds, page 134, and dated April 6, 1972, filed February 20, 1974, in Book 157 of Deeds, page 135, in and for Wabasha County, and Whereas, Wabasha County is acting on the request of Bernard Sheehan to release and discharge to Bernard Sheehan all property covered by these Easements as shown in Exhibit A, except the property described on Exhibit B, from the operation and effect of said Easements without prejudice to its rights in and to any other lands therein described, and
Whereas, the attached Permanent Private Road Easement shall be appropriately executed by all Grantors and recorded, prior to the release and discharge of the above described property, and Whereas, no costs of recording the documents shall be paid by Wabasha County.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the County of Wabasha enter into the attached Permanent Private Road Easement and hereby authorizes the Chairman of the Board and Wabasha County Administrator to execute said Permanent Private Road Easement.
Be it further resolved by the Wabasha County Board of Commissioners that Wabasha County does hereby quitclaim and release unto Bernard Sheehan, the current owner of record, any and all rights or interest it may have pursuant to the aforementioned Flood Control Easements of the property described on Exhibit A except the County of Wabasha shall reserve all rights in its easements over the property described on Exhibit B attached hereto.

Resolution No.: 2009-105
Whereas, Bruce and Margaret Eggenberger the owner of parcel number 22.00209.00 has provided a written request to the Wabasha County Board of Commissioners regarding the local option abatement for property not qualifying for disaster credit as defined in M.S. 273.123; and
Whereas, the County Assessor has determined that fifty percent or more of the Eggenberger property was destroyed by water damage on February 23, 2009 and the structure is not useable; and
Now Therefore Be It Resolved by the Wabasha County Board of Commissioners that a reduction in property tax is granted on parcel number 22.00209.00 based on the number of months that the home is uninhabitable or the structure is unusable.

*This is only effective for the calendar year 2009. If they would like an abatement for 2010 they must come back to the board.

Resolution No: 2009-106
Now therefore be it resolved by the Wabasha County Board of Commissioners hereby approve/authorize Amendment #2, Communications License L-214, lease agreement with Minnesota Department of Transportation, Minnesota State Patrol and Wabasha County.

Resolution No: 2009-107
Now therefore be it resolved by the Wabasha County Board of Commissioners hereby approve/authorize renewal of communications lease agreement on Lake City Radio Tower site with Minnesota Department of Natural Resources and Wabasha County.

DWELLE - RIESTER
Resolution No: 2009-108
Now therefore be it resolved by the Wabasha County Board of Commissioners hereby approve/authorize ARMER 800mhz radio User agreement with Southeast Regional Radio Board, State of Minnesota through Commissioner of Transportation and Wabasha County.

Deb Koenig, Finance Director came before the Board to give a quarterly budget and investment report. The jail is on budget.
RIESTER - DWELLE
Resolution No.: 2009-109
Whereas, the Wabasha County Restorative Justice Program has a vacancy in the full-time position of Restorative Justice Coordinator since 4/3/2009, and
Whereas, Social Services has agreed to combine the duties of the Youthlink Mentorship Program Coordinator with the Family Service Aide II position,
Now Therefore Be It Resolved, that the Wabasha County Board of Commissioners hereby approves that the Family Service Aide II position will be maintained as a full-time (37.5 hour) position and take on the duties of the Youthlink Mentorship Program Coordinator.

Resolution Number: 2009-101
Whereas, a study of the feasibility of a High Speed Rail System between St. Paul and La Crescent is being undertaken,
And Whereas, this high speed rail route is planned to pass through a portion of Wabasha County,
And Whereas, it is in the best interest of Wabasha County to be a part of the planning process for this project,
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that they join the Joint Planning Board as a financial voting member.
