Meeting of September 16, 2008
The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Services Building, in the City of Wabasha, Minnesota on Tuesday, September 16, 2008 at 9:00 a.m.
The meeting was called to order by Board Chairman Riester.
The following Commissioners were present: Windhorst, Dwelle, McNallan, Riester and Springer.
SPRINGER - WINDHORST
Motion to approve the agenda, removing Item I and Item J.
Commissioners reported on meetings they had attended.
There was no public comment during the public forum.
SPRINGER - McNALLAN

Whereas, Kimball Excavating, Inc. had the lowest bid for Project S.A.P. 079-599-074.
Now Therefore be it Resolved that the Wabasha County Board of Commissioners hereby accepts the bid of Kimball Excavating, Inc. on Contract No. 08007 for Project S.A.P. 079-599-074 – Furnish and Install Bridge No. 79J59 and Construct Approaches on 220th Avenue, 3.25 miles SE of Plainview – in the amount of $145,672.50 and that the Chairman of the County Board and the County Administrator are hereby authorized to execute a Contract with Kimball Excavating, Inc. for this work.
WINDHORST - DWELLE
Resolution Number: 2008-202
Whereas, Wabasha County did road construction work at the intersection of County Road 1 and Minnesota Trunk Highway 60 in Mazeppa, and
Whereas, when the work was completed, the rumble strips which had previously been at the intersection to warn motorists of the approaching intersection were not replaced, and
Whereas, there have been three car accidents at the intersection since the construction, with cars over-shooting Highway 60 and landing in the ball field, and
Whereas, the City Council of Mazeppa believes the rumble strips should be replaced immediately,
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that they require the rumble strips at the intersection of County Road 1 and Minnesota Trunk Highway 60 be replaced immediately.
DWELLE – SPRINGER
Whereas, the Wabasha County Board has approved the position of a part-time deputy/clerk in the Auditor/Treasurer’s office, and
Whereas, Wabasha County Board has authorized to hire and fill the position, and
Whereas, the Human Resource Department and the Auditor/Treasurer’s office has completed the hiring process and has recommended Kathleen Jeffery for the position.
Now therefore be it resolved by the Wabasha County Board of Commissioners hereby approves the hiring of Kathleen Jeffery as part-time deputy/clerk in the Wabasha County Auditor/Treasurer’s office. Effective date of hire, September 17, 2008 and starting pay per union contract AFSCME 3542- grade 6-step hire.
McNALLAN - SPRINGER

Whereas, the Wabasha County Planning Commission has held a public hearing and considered an application to subdivide. A preliminary plat has been submitted by Derald & Shirley Severson, the request involves land at the following location: Parcel # R14.00119.00 Buckshire Knoll Section 17, Township 108N, Range 11W (Plainview Township) Com 52.2 rods E of SW corner of SW1/4, N 62.5 rods, E 38.4 rods, S 62.5 rods, W 38.4 rods to beginning, except 208’ X 208’ of said desc tract (14 acres)
Whereas, the Wabasha County Planning Commission (absent: Don Springer & Bruce Bartels) voted unanimously to recommend approval of the above mentioned preliminary plat,
Now Therefore Be It Resolved by the Wabasha County Board of Commissioners that it approves the preliminary plat described above based upon the recommendation of the Wabasha County Planning Commission.
McNALLAN - SPRINGER
Resolution Number: 2008-205
Whereas, The State of Minnesota requires the County, pursuant to the provisions of Minnesota Statues 134.34 and 134.341 to participate in a regional public library system, as assigned by the Minnesota Department of Education, and
Whereas, The County agrees to provide funding for Southeastern Libraries Cooperating (SELCO) at a level of $145,460 for the 2009 year, $151,133 for 2010 and $157,027 for 2011 which is an increase of 3.9% per year.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that they approve the three (3) year contract with SELCO in the amounts mentioned above.

Whereas, in the past Wabasha County Public Health has paid for flu shots for county employees and their families, And
Whereas, the cost of the vaccine alone has gone up to $21, so the total cost of the vaccine this year will be $30, this price includes the syringe and the nurses’ time.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the county pay for flu shots for county employees and their families at a cost of $30 per shot.
Resolution 2008-198 moved to September 23 meeting.
Whereas, the Board of Commissioners of Wabasha County has authority to adopt an ordinance regulating the surface use of waters within its boundaries, pursuant to Minnesota Statute 86B.201 and 86B.205, and,
Whereas, the said Board of Commissioners determines that it is in the best interest of the citizens of Wabasha County to adopt such an ordinance to promote the health, safety, and welfare of its citizens,
Now Therefore, after public hearing duly notices, the Board of Commissioners of Wabasha County, Minnesota, does ordain:
Section 1: Purpose, Intent And Application: As authorized by Minnesota Statutes 86B.201, 86B.205, and Minnesota Rules 5110.300-6100.3800 as now in effect and as hereafter amended, the Ordinance is enacted for the purpose and with the intent to control and regulate the use of the waters of Lake Zumbro in Wabasha County, Minnesota said bodies of water being partially located within the boundaries of Wabasha County, to promote its fullest use and enjoyment by the public in general and the citizens of Wabasha County in particular; to insure safety for persons and property in connections with the use of said waters; to harmonize and integrate the varying uses of said waters; and to promote the general health, safety, and welfare of the citizens of Wabasha County, Minnesota.
Section 2: Surface Zoning Of Lake Zumbro By Restricting Speeds During Certain Surface Water Levels:
a. Upon the surface water level obtaining 921.0 feet or above, the entire water surface shall become a slow, no wake zone, and no surface craft shall travel at such a speed as to create a wake.
b. Upon the surface water level dropping to 919.7 feet or below, slow, no wake zone, shall expire.
c. The surface water level measurements shall be read at the dam site located on the north end of the lake and as recorded at Rochester Public Utilities lake level monitor computer at Rochester Public Utilities Operation Center, or such other place as the Rochester Public Utilities monitor shall, from time to time, be located. Surface water measurements shall be posted on the Rochester Public Utility website and the wake zone status shall be posted on the Olmsted County Sheriff’s Department website.
Section 3: Enforcement: The enforcement of this Ordinance shall be the primary responsibility of the Olmsted County Sheriff’s Department as per the inter-county agreement between Wabasha and Olmsted Counties. Other licenses peace officers including Conservation Officers of the Department of Natural Resources of the State of Minnesota are also authorized to enforce this ordinance.
Section 4: Exemptions: All authorized Resource Management Emergency and Enforcement Personnel, while acting in the performance of their assigned duties are exempt from the foregoing restrictions.
Section 5: Notification: It shall be the responsibility of Olmsted County to provide for adequate notification of the public which shall include placement of a sign at each public watercraft launching facility outlining essential elements of the ordinance.
Section 6: Penalties: Any person who shall violate any of the provisions of this Ordinance shall be guilty of a petty misdemeanor, and upon conviction thereof, shall be punished by a fine of not more than three hundred dollars ($300.00) or such other maximum amount as the laws relating to maximum penalties for petty misdemeanors shall from time to time permit. Section 7: Effective Date: This Ordinance shall be in effect from and after the date of its passage. Removed from agenda.

Whereas, the maintenance garage is in need of a new ceiling and insulation, And
Whereas, Wabasha County requested five (5) quotes from various contractors, and received only one (1) quote for the project,
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that they accept a bid from Dan Miller Construction in the amount of $15,105 for replacement of the ceiling in the maintenance garage and insulation for the building.
There was a Union Local #3541 Grievance presented to the Board regarding using a floating holiday. A Social Services Employee would like to use her Floating Holiday on December 26th. The Union Contract states, “Floating Holidays must be taken during the calendar year in which they are earned and may not be carried forward into the following year. The new Wabasha County Personnel Policy states that the Floating Holiday must be used before the last pay period of the year. The reason for this policy is because using a Floating Holiday so close to the end of the year causes problems in book keeping. The Social Services Department Head and the County Administrator denied the request. The Union Representative says that the Union Contract “trumps” the Policy Manual. Wabasha County Assistant Attorney Lisa Bayley feels the Policy Manual “trumps” the Union Contract. The specific language of the Union Contract and the Policy & Procedure Manual the issue. It was the consensus of the Board to set up a meeting with the Union to come to an agreement. There was a motion by Commissioner Springer and a Second by Commissioner McNallan to table this until the September 23rd meeting.
Jim Roemer came before the Board to ask that the County Engineer allow him to build another driveway in his County Sunshine Estates Subdivision. Mr. Roemer only had a permit for three driveways on the final plat and now wants to build another one. SPRINGER - WINDHORST Motion to recess to County Road 30 site.
