Meeting of February 17, 2009
The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Services Building, in the City of Wabasha, Minnesota on Tuesday, February 17, 2009 at 9:00 a.m. The meeting was called to order by Board Chairman Windhorst. The following Commissioners were present: Windhorst, Dwelle, Riester, Norman and Hall.

Motion to approve the agenda.

Commissioners reported on meetings they had attended. Board Concerns: Lease Jail Land Administrator’s Update: Meeting February 27, 9:00 a.m. in the Board Room – Commissioners and Department Heads will discuss response to State Program Aid reductions, prioritize services and review potential cost savings. There was no public comment during the public forum.

Resolution No.: 2009-021
Whereas, the Wabasha County Highway Department proposes to acquire land along the existing right of way of County Highway 86 for the purpose of reconstructing this road under S.A.P. 079-600-010; and
Whereas, S.A.P. 079-600-010 is necessary in order to improve this segment of County Highway 86, 261st Ave (West Albany Township) and 642nd Street (Glasgow Township) to meet Minnesota State Park Road standards and provide for public health, welfare, safety and convenience; and
Whereas, West Albany Township and Glasgow Township are in support of the proposed improvements; and
Whereas, the necessary additional permanent lands for S.A.P. 079-600-010 are as described in Wabasha County Highway Right of Way Plat No. 38.
Now Therefore be it Resolved that the Wabasha County Board of Commissioners hereby accepts Wabasha County Highway Right of Way Plat No. 38.
Be it further resolved, that the Wabasha County Board of Commissioners hereby authorizes the County Highway Engineer to proceed to acquire the necessary lands as described in Wabasha County Highway Right of Way Plat No. 38 in accordance with applicable laws and statutes.

Resolution No.: 2009-022
Whereas, Wabasha County has reviewed the pertinent data on bridges requiring replacement, rehabilitation, or removal; and
Whereas, Wabasha County has identified those bridges that are high priority and has previously established a list of those bridges that require replacement, rehabilitation, or removal; and
Whereas, the following additional bridges have been since identified as also requiring replacement, rehabilitation, or removal.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the following deficient bridges are high priority and Wabasha County intends to replace, rehabilitate, or remove these bridges as necessary when funds are available,
Be it further resolved that Wabasha County does hereby request authorization to replace, rehabilitate, or remove such bridges; and Be it further resolved that Wabasha County does hereby request financial assistance with eligible approach grading and engineering costs on township bridges, as provided by law.

Whereas, the Wabasha County Highway Department finds it most cost effective for the County to purchase a Fuel Monitor for the Wabasha Shop.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Wabasha County Highway Department be authorized to purchase from Rochester Petroleum Equipment Inc. one fuel tank Monitor in an amount of $6,250.05.

Whereas, Rochester Sand & Gravel, Division of Mathy Construction Company, had the lowest bid for combined Projects S.A.P. 079-601-026, S.A.P. 025-611-023, and S.A.P. 079-601-027.
Now Therefore be it Resolved that the Wabasha County Board of Commissioners hereby accepts the bid of Rochester Sand & Gravel, Division of Mathy Construction Company, on Contract No. 09002 for combined Projects S.A.P. 079-601-026, S.A.P. 025-611-023, and S.A.P. 079-601-027 – Bituminous Reclamation, Bituminous Surfacing and Aggregate Shouldering, on Wabasha C.S.A.H. No. 1 and Goodhue C.S.A.H. No. 11, from 2.8 miles to 0.3 mile south of TH 60 and on Wabasha C.S.A.H. No. 1, from 0.3 mile north of CR 83 to CSAH 16 – in the amount of $1,157,240.58 and that the Chairman of the County Board and the County Administrator are hereby authorized to execute a Contract with Rochester Sand & Gravel, Division of Mathy Construction Company, for this work.

Whereas, Rochester Sand & Gravel, Division of Mathy Construction Company, had the lowest bid for Project S.A.P. 079-607-020.
Now Therefore be it Resolved that the Wabasha County Board of Commissioners hereby accepts the bid of Rochester Sand & Gravel, Division of Mathy Construction Company, on Contract No. 09003 for Project S.A.P. 079-607-020 – Bituminous Alternate Surfacing and Aggregate Shouldering, on Wabasha C.S.A.H. No. 7, from 1980 feet Northwest of C.R. 71 to the Junction of T.H. 60 – in the amount of $472,823.45 and that the Chairman of the County Board and the County Administrator are hereby authorized to execute a Contract with Rochester Sand & Gravel, Division of Mathy Construction Company, for this work.

Whereas, H & R Construction Company had the lowest bid for Project S.A.P. 079-623-005.
Now Therefore be it Resolved that the Wabasha County Board of Commissioners hereby accepts the bid of H & R Construction Company on Contract No. 09001 for Project S.A.P. 079-623-005 – Traffic Barrier, on Wabasha C.S.A.H. No. 23, from 4669 feet Southwest of CSAH 2 to 1694 feet southwest of CSAH 2 – in the amount of $54,681.80 and that the Chairman of the County Board and the County Administrator are hereby authorized to execute a Contract with H & R Construction Company for this work.

Resolution No.: 2009-027
Whereas, In accordance with Minnesota Statute 400.01 Wabasha County is given the responsibility to conduct solid waste management programs; and
Whereas, In accordance with the Wabasha County Solid Waste Ordinance, solid waste haulers must be licensed to operate within Wabasha County; and
Whereas, Solid Waste Haulers Licenses must be granted by the Wabasha County Board of Commissioners; and
Whereas, The Wabasha County Solid Waste Officer has collected applications, the required support information and fees required by the County Solid Waste Ordinance from local solid waste haulers who wish to be licensed.
Now, Therefore, Be It Resolved, that the Wabasha County Board of Commissioners hereby approves the following solid waste haulers licenses for one year beginning February 1, 2009 and ending January 31, 2010.

Resolution No.: 2009-029
Whereas, Wabasha County entered into a labor contract with the jailer/dispatchers, represented by Teamsters Local 320 for the period of 2008-2010 and this contract was not ratified until late 2008; and
Whereas, the County, operating in good faith, continued under the terms of the 2006-2007 two-year contract which allotted each jailer/dispatcher $650 annually for uniforms and subsequently made payment of $650 to each employee for 2008; and
Whereas, the contract that was ratified in late 2008 had a clerical error made by the Union, and said contract was subsequently approved by the Board, which reduced the uniform allotment to $625 for each employee; and
Whereas, the uniform allotment was not a point of contention in the contract negotiations and was not meant to be reduced. Now, Therefore, be it Resolved by the Wabasha County Board of Commissioners that the allotment for jailed/dispatcher uniforms be reinstated at $650 per employee as originally intended.

Resolution No.: 2009-030
Whereas, the Wabasha County Human Services Board has participated with Fillmore, Goodhue, Houston and Winona counties in a grant to investigate fraud prevention sine 1996; and
Whereas, the Governor of Minnesota, has proposed the State of Minnesota takeover the fraud prevention program through a statewide program; and
Whereas, the Wabasha County Human Services Board supports the current fraud prevention investigation program as being the most effective method available to serve Wabasha County residents; and
Whereas, the Director of Social Services and Financial Services Supervisors have recommended continued support of the current fraud prevention system;
Now therefore be it resolved by the Wabasha County Board of Commissioners hereby approves signature and submission of a letter to our Legislative Delegation in support to continue the existing 5-county welfare fraud prevention investigation services.

Resolution No.: 2009-031
Whereas, the following items are considered a surplus: 2004 Artic Cat Snowmobile (#70) 2001 Polaris Snowmobile (#71) 2000 Triton Snowmobile Trailer (#72)
Whereas, the Wabasha County Sheriff’s Office is requesting that the above snowmobiles and trailer be sold on Ebay; and
Whereas, the Wabasha County Sheriff Office is requesting that the proceeds from the sale of these items be deposited back into the capital fund of Wabasha County.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: the Sheriff is authorized and directed to sell the following on Ebay as noted above: 2004 Artic Cat Snowmobile bearing VIN #4UF04SNW14T131531 2001 Polaris Snowmobile bearing VIN #4XANP6ES71B119319 2000 Triton Snowmobile Trailer bearing VIN #4TCSS1101YHX20592 Be it Further Resolved by the Wabasha County Board of Commissioners that: funds from the sale be deposited to the capital fund of Wabasha County.
