Meeting of February 16, 2010
The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Services Building, in the City of Wabasha, Minnesota on Tuesday, February 16, 2010 at 9:00 a.m. The meeting was called to order by Board Chairman Dwelle. The following Commissioners were present: Windhorst, Dwelle, Riester, Norman and Hall.
HALL - WINDHORST
Motion to approve the agenda.
Commissioners reported on meetings they attended. Administrator’s Update: CJC railing has been replaced. Township Officers Meeting is February 23 at 7:30 p.m. Administrator out February 17 - ? There was no public comment during the public forum.
RIESTER - WINDHORST
Motion to approve the consent agenda including the following: Claims Meal Vouchers SSIS Claims Minutes: February 2, 2010
John Delrus and Mike Carey from the MN 100 Club and the Teamsters attended the meeting to present injured Deputy Andy Hamann a check for $3,500 and $500 respectively.

Whereas, the county has obsolete telephone equipment in storage pending disposal and that equipment has no practical use to the county, and Whereas, St. Felix School can make use of that equipment,
Now Therefore be it Resolved by the Wabasha County Board of Commissioners to authorize the donation of surplus telephone equipment to St. Felix School in Wabasha, MN.
Dietrich Flesch, County Engineer came before the Board to discuss the Oakwood Township Agreement for Bridge Replacement. Dietrich suggested 592nd and 609th Street remain an Oakwood Township Road versus becoming a County Road until the bridge is replaced. Oakwood Township is asking the County for $10,000 for the bridge replacement. The County Engineer is not recommending this. It was the consensus of the Board to leave policy as is.

Whereas, a majority of the property owners within the proposed lake improvement district on Lake Zumbro have submitted a petition to the Wabasha County Board which conforms to the requirements set forth in Minnesota Statutes Section 103B.521, Subd. 1 and Minnesota Rule 6115.0970, Subp. 1; and
Whereas, the citizen’s group which submitted the petition has provided a certified copy of the petition to the Commissioner of the Minnesota Department of Natural Resources and to the Minnesota Pollution Control Agency as required by Minnesota Rule 6115.0970, Subp. 2A; and
Whereas, on December 22, 2009 the Wabasha County Auditor has verified the authenticity of the signatures on the petition and has notified the County Board as required by Minnesota Statutes Section 103B.521, Subd. 2; and
Whereas, the Wabasha County portion of Lake Zumbro lies within Zumbro and Mazeppa Township and Wabasha County has sent the Town Chairperson and Clerk of each Township a copy of the notice of public hearing more than 30 days in advance of the public hearing on this petition seeking their review and comment as required by Minnesota Statutes Section 103B.521, Subd. 1(d); and
Whereas, Wabasha County has at least 21 days prior provided notice of a public hearing on the petition to the DNR and the MPCA, all owners and residents within the proposed District, local and regional units of government, special purpose districts, development commissions, and corporations and utilities owning property within the proposed District and published notice of the public hearing in Wabasha Herald which is widely circulated in the proposed District and posted notice of the public hearing in public building and leading commercial establishments in or near the proposed District as required by Minnesota Rule 6115.0970, Subp. 3; and
Whereas, the Wabasha County Board has made the petition available for public viewing by concerned citizens at the Wabasha County Government Offices.
Whereas, the Wabasha County Board convened the public hearing on the petition on January 19, 2010 at 7:00 p.m. in the County Board Room at the Wabasha County Government Offices, as required by Minnesota Statutes Section 103B.521, Subd. 2 and the report from the Commissioner of the Minnesota Department of Natural Resources was read into the record as required by Minnesota Rule 6115.0970, Subp. 7, and comments from persons for and against the creation of the District was received and considered; and
Whereas, on February 16, 2010, the Wabasha County Board reconvened to approve the establishment of the Lake Zumbro Improvement District which was more than 10 days but within 30 days following the public hearing on the petition as required by Minnesota Rule 6115.0970, Subp. 9; and
Whereas, the Wabasha County Board is aware that because a portion of Lake Zumbro is also located within Olmsted County, the Wabasha County Board needed to complete similar steps for creation of a multi-county Lake Improvement District and it is aware that the Olmsted County Board convened its public hearing on January 19, 2010, and then met on February 9, 2010 to discuss whether or not to recommend creation of the District pursuant to Minnesota Statutes Section 103B.521, Subd. 3;
Now, therefore be it resolved that the Wabasha County Board hereby issues this resolution in support of its order for establishment of the Lake Zumbro Improvement District, and therefore issues the following order pursuant to Minnesota Statutes Section 103b.535:1. With the provision that all financial matters pertaining to the Lake Zumbro Improvement District require the approval of the full Board and that those property owners in the LZID be assessed no amount greater than that assessed other property owners in Wabasha County. The request by the petitioners requesting establishment of a Lake Zumbro improvement district is hereby granted. I certify that the above resolution and order was adopted by the Wabasha County Board of Commissioners on February 16, 2010.

Whereas, the Director of Social Services has provided detailed information to the Human Services Board on the vehicles available through the State bid contract; and
Whereas, a replacement vehicle has been included in the 2010 budget for Social Services; and
Whereas, the 2007 Malibu is the vehicle to be moved to the general county car pool upon purchase of a 2010 vehicle; and
Whereas, the purchase of a vehicle by the Department of Social Services provides the highest level of reimbursement and is cost-effective;
Whereas, the Director of Social Services recommends the purchase of a 2010 vehicle and transfer of the 2007 vehicle to the general car pool; and
Whereas, Wabasha County Policy requires capital purchases approved by the Human Services Board to also be approved by the Wabasha County Board of Commissioners;
Now, therefore be it resolved, the Wabasha County Board of Commissioners hereby approves the purchase of a 2010 Ford Fusion at a cost of $17,561.00, as bid by Tom Heffernan Ford of Lake City.
WINDHORST - HALL

Whereas, funds were budgeted to be used for various jail opening items, and
Whereas, the items have been ordered but not received or not to be ordered until closer to the Jail opening date, and
Whereas, the County will be incurring costs in 2010 of $5,950 for the misc Jail items and $22,200 for Jail radios, and
Now therefore be it resolved, by the Wabasha County Board of Commissioners designates $28,150 of General Revenue Fund balances for the above items effective December 31, 2009,
Be it further resolved, that any remaining unspent funds at the end of 2010 will revert back to General Revenue undesignated funds.

WINDHORST – RIESTER
Resolution No: 2010-038
Whereas, Wabasha County previously authorized transition onto the ARMER radio system, and
Whereas, Wabasha County using Minnesota State purchase contracts as the basis for purchase of said radio equipment, and
Whereas, Wabasha County use 911 funds to purchase, and utilize PSIC grants for reimbursement of costs incurred for said radio equipment,
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: Wabasha County commits to the purchase of said radio equipment for Dispatch at the Criminal Justice Center thru the Minnesota State purchase contracts, not to exceed the sum of $116,000.00.
HALL - WINDHORST
Resolution Number: 2010-039
Whereas, it is in the best interests of the citizens of Wabasha County to move the Public Health Department to the County Services Building from both a cost and service perspective, and;
Whereas, it is the best interest of the citizens of Wabasha County to relocate certain offices within the County Services building, Courthouse, Annex and Criminal Justice Center in order to make as many County services ADA accessible as possible at a minimal cost, and;
Whereas, to accomplish this relocation some renovation will be necessary.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the County Administrator proceed to obtain quotes for the required work in the County Services Building, Courthouse and Annex.

Floyd Riester, Zoning Administrator came before the Board to ask their opinion of a Zoning Issue regarding Tim Mehrkens’ property. The Board would like Floyd to come back with a resolution or recommendation.
