Meeting of January 19, 2010
The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Services Building, in the City of Wabasha, Minnesota on Tuesday, January 19, 2010 at 6:00 p.m. The meeting was called to order by Board Chairman Dwelle. The following Commissioners were present: Windhorst, Dwelle, Riester, Norman and Hall.
WINDHORST - HALL
Motion to approve the agenda.

Commissioners reported on meetings they attended. Administrator’s Update: January 25 meeting in St. Charles – Borromeo Catholic Church, 9:00 a.m. Set new date for Highway Shop Tour. There was no public comment during the public forum.
HALL - RIESTER
Motion to approve the consent agenda including the following: Claims Meal Vouchers SSIS Claims Minutes: January 5, 2010 Donations: $2500 from First National Bank, Plainview, to the Regional Railroad Authority for the Bike Trail

Resolution Number: 2010-018
Whereas, the Wabasha County Courthouse has not been in compliance with ADA requirements since the inception of the Americans with Disabilities Act, and;
Whereas, 25 years ago the Wabasha County Board of Commissioners committed to make all Wabasha County facilities ADA accessible, and;
Whereas, the County has the opportunity to consolidate offices and services in the Courthouse and Services Building, at the same time divesting ourselves of the expense of maintaining the Public Health building, and;
Whereas, the Wabasha County Board in 2002 allocated $350,000 to be used for ADA compliance in the Courthouse, and;
Whereas, for the wellbeing of our citizens and employees it is financially prudent to invest this money in making the Courthouse ADA compliant, as the savings from maintaining the Public Health building can pay for the ADA compliance project in a relatively short period of time, allowing the County to replace the allocated funds currently in our reserves, and;
Whereas, in order to close the Public Health Building and consolidate offices and services in the Old Courthouse and County Services Building it is necessary to house some offices and services on the second floor of the Old Courthouse
Whereas, if we are to make our offices ADA compliant this consolidation of offices and services can only be accomplished by approving and implementing the elevator option as bid, and;
Whereas, if we choose the ramp alternative only the first floor of the Old Courthouse will be ADA compliant, leaving the second floor non-complaint, and;
Whereas, the bids for the elevator project came in slightly less than anticipated and the bids for the ramp came in approximately where anticipated.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that Option 1 (Elevator and first floor ADA restroom) and Alternate 2 (Second Floor ADA restroom) at a construction cost of $269,309 or Option 2 (Ramp to First Floor and First Floor ADA Restroom) at a construction cost of $92,000 be approved.

Now therefore Be it Resolved by the Wabasha County Board of Commissioners that all bids for the elevator and ramp are rejected, and these projects not be carried forward at this time.

RIESTER - DWELLE
Resolution Number: 2010-019
Whereas, the Wabasha County Attorney position is currently officially a part-time position even though it is paid as a full time position, and; Whereas, the County Attorney already works as though the position were a full-time position, and;
Whereas, the possibility exists for the election of a County Attorney who will actually work just part-time while maintaining a private practice, necessitating the use and associated cost of an outside law firm when the inevitable conflict of interest occurs, and;
Whereas, the possibility exists for the election of a County Attorney who will actually work just part-time while maintaining a private practice, possibly requiring the hiring of another Assistant Attorney to carry the case load left by the part-time County Attorney, and; Whereas, it is best business practice to have a Full-Time County Attorney to preclude these possible detrimental impacts on the County. Whereas, the Board of County Commissioners has the authority under MN Statute 388.21 subd. 1 that the full-time elected County Attorney NOT engage in the private practice of law. This is only the case if the position is full-time and does not apply to an elected part-time County Attorney.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that effective January 1, 2011, the position of County Attorney become a full-time position.

Resolution No.: 2010-020
Whereas, Minnesota Statute 508.47 allows for a registered land survey No. 22 split to create a separate lot be approved by the Wabasha County Board, and
Whereas, Kent and Bonnie Roberson are the owners of parcel # 07.0014.03 Section 3, Township 109, Range 13 (Hyde Park Twp) consisting of 162.5 acres,
Whereas, the creation of a separate parcel consisting of approximately 10 acres as requested by the Roberson’s is consistent with the Wabasha County Zoning and Subdivision Ordinances.
Now Therefore Be It Resolved that the Wabasha County Board of Commissioners hereby approves the creation of a separate lot as shown in registered land survey number 22 and authorizes the Board Chairman to sign said survey.

Terry Smith, Social Services Director, came before the Board to present a Southeast Minnesota Community Transformation Contract.
Blaine Hentz came before the Board to advise the Board that some dispatchers will be attending out of state training. The dispatchers will be gone 6 days and 8 dispatchers are going. It was the consensus of the Board to allow this training.
WINDHORST - HALL
Resolution No: 2010-021
Whereas, one of our Deputies was severely injured in a head-on collision on December 25, 2009. It is unknown when he will be able to return to work. Therefore, his position will need to be filled temporarily, and;
Whereas, we are requesting that the Deputy who is currently training as a Jailer be returned to the road shift as Deputy Sheriff, effective immediately, in order to fill the temporary position due to the injured Deputy, and;
Whereas, in returning this Deputy to the road shift, this will create a Jailer position vacancy. Therefore, the Wabasha County Sheriff is also requesting that the vacancy of the Jailer position be filled from the pool of prior applicants.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: it is hereby approved that the Deputy who is currently training as a Jailer be returned to the road shift to fill the Temporary Deputy Sheriff position, effective immediately, and;
Now Therefore be it further Resolved by the Wabasha County Board of Commissioners that: the Jailer position vacancies also be filled from the pool of prior applicants.

* There will be two jailer positions filled. The day of the Board meeting another jailer resigned, it was the consensus of the Board to amend the resolution and hire two new jailers.
Opened Public Hearing on Lake Zumbro Improvement District Petition at 7:04 p.m. The public spoke about dredging Lake Zumbro. Both sides agree that dredging needs to be done; the disagreement comes on who should pay for the dredging. One side believes that the citizens who own property on the lake should pay for the dredging; one side believes the County should pay for it. The LID will be voted on at the February 2nd, 2010 Board meeting.
