Meeting of June 22, 2010
The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Services Building, in the City of Wabasha, Minnesota on Tuesday, June 22, 2010 at 11:00 a.m. The meeting was called to order by Board Chairman Dwelle. The following Commissioners were present: Windhorst, Dwelle, Riester, Norman and Hall.

Motion to approve the agenda.

Commissioners reported on meetings they attended. Administrator’s Update: Board room move for July 6 meeting Feedlot tour and lunch Demo RFP for jail done There was no public comment during the public forum.
RIESTER – HALL
Motion to approve the consent agenda including the following: Claims Meal Vouchers SSIS Claims Minutes: June 15, 2010 Accept Donations: $50 from Kreofsky Building Supply, Plainview; and $200 from the Kiwanis Club of Lake City to the Youthlink Mentorship Program.

Resolution No.: 2010-124
Whereas, there is a vacancy in the position of Assistant County Attorney and;
Whereas, the Board of Commissioners has authorized advertising and interviewing for this position, and;
Whereas, the interviewing process has been completed and a qualified candidate selected.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners approve the hiring of an Assistant County Attorney at Step 1 ($54,672) of the appropriate pay grid.

Resolution No.: 2010-114
The Wabasha County Board of Appeal and Equalization convened at the Wabasha County Services Building in the City of Wabasha, Minnesota, on June 15, 2010 at 7:00 p.m. The following members were present: Commissioners Peter Riester, Richard Hall, David Windhorst, Tom Dwelle, Merl Norman and Auditor/Treasurer Jerry Leisen. Also present was County Assessor Loren Benz and Appraisers Dick Schouweiler, Luanne Petron and Penny Schmit. Commissioner Tom Dwelle called the meeting to order and County Recorder Jeff Aitken swore in all members of the County Board of Appeal and Equalization.
LEISEN – NORMAN
Be It Resolved, that Commissioner Tom Dwelle be nominated for the position of Chair of the Wabasha County Board of Appeal and Equalization, that all other nominations cease and a unanimous vote be cast.

The Auditor/Treasurer, in accordance to statute, shall act as Clerk to the Board of Appeal and Equalization. The following changes shall be entered by the Wabasha County Assessor, based on letters received from applicants, items presented by the County Assessor and parties appealing in person.

Be It Resolved, that the Wabasha County Board of Appeal and Equalization hereby approves to reduce the estimated market value of parcel 19.00424.00, Jeffrey and Vicky Zabel, from $513, 000 to $483,000.

Be It Resolved, that the Wabasha County Board of Appeal and Equalization hereby approves to reduce the estimated market value of parcel 26.01371.00, Dustin and Heidi Jo Boettcher, from $331,200 to $290,900.

Be It Resolved, that the Wabasha County Board of Appeal and Equalization hereby approves to accept The County Assessor’s recommendation for parcel 11.00001.00, William Danckwart, for no change to the estimated market of $347,400.

Be It Resolved, that the Wabasha County Board of Appeal and Equalization hereby approves the County Assessor’s recommendations for the following parcels: Oak Center Properties LLC, parcel 03.00079.03, no change in estimated market value of $335,400. Joseph M. Cerar, parcel 26.01100.00, reduce estimated market value from $169,100 to $157,400. Diana M. Schmidt, parcel 27.01141.00, no change in estimated market value of $237,000. Diana M. Schmidt, parcel 27.00130.18, no change in estimated market value of $2,000. Sejfudin and Zodra Sejdinovic, parcel 22.00522.00, reduce estimated market value from $173,500 to $149,700. Eric Sattre, parcel 21.00133.00, reduce estimated market value from $135,100 to $105,500.

Be It Resolved, that the Wabasha County Board of Appeal and Equalization does hereby recess to the June 22, 2010 regular Wabasha County Board of Commissioners meeting at 11:00 a.m. for the sole purpose of approving these minutes.

The Wabasha County Board of Appeal and Equalization of Wabasha County, Minnesota, reconvened at the County Services Building in the City of Wabasha, Minnesota, on June 22, 2010 at 11:00 a.m. At the recessed meeting of June 22, 2010 of the Wabasha County Board of Appeal and Equalization, we do hereby certify that the minutes of the June 15, 2010 meeting of the Wabasha County Board of Appeal and Equalization were approved as presented. Whereas, the applicants do have current food & beverage licenses issued by Wabasha County Public Health, and
Whereas, the applications have been approved by the County Attorney and County Sheriff. The Wabasha County Auditor/Treasurer has received the certificate of insurance and the appropriate license fee. The liquor license will run from August 1, 2010 to July 31, 2011. Now therefore be it resolved that Wabasha County Board of Commissioners hereby approves the renewal of Liquor License to the individuals listed above, subject to the approval of the State of Minnesota Liquor Control Commissioner.

Resolution No.: 2010-116
Whereas, it is necessary for the County have back-up M-100 ballot counters available for Primary and General Elections, and
Whereas, currently the County has no back-up M-100 ballot counters.
Now therefore be it resolved that the Wabasha County Board of Commissioners hereby approves the County Auditor/Treasurer’s request for the purchase of an M-100 ballot counter from the Election Systems & Software Company for the approximate cost of $4,673.00.
Be it further resolved, that the purchase of this M-100 ballot counter be owned and maintained by the County and used only as a back-up counter.

Resolution No.: 2010-117
Whereas, the segment of County State Aid Highway 59 between the junctions of US Highway 61 and Rocque Ave in the City of Wabasha is currently posted for a maximum speed of 30mph, and Whereas, there is no record of a speed zone study done for the above described road segment, and
Whereas, the currently posted maximum speed may not be reasonable for the above described road segment.
Now Therefore be it Resolved that the Wabasha County Board of Commissioners hereby requests the Minnesota Department of Transportation conduct a speed zone study on the above described highway segment for the purpose of identifying the safe and reasonable maximum speed.

Resolution No.: 2010-118
Whereas, the Wabasha County Highway Department finds it beneficial for the County to purchase one gas driven portable air compressor.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Wabasha County Highway Department be authorized to purchase one gas driven portable air compressor from CPR Services, Inc. in an amount of $7375 plus delivery costs.

Whereas, the Wabasha County Highway Department finds it more beneficial at this time to utilize funds designated for purchasing a hydraulic hammer attachment towards the purchase of an air compressor with the remaining funds directed for use under the budgeted line item for Equipment $500 to $4999, and Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Wabasha County Highway Department be authorized to utilize the funds designated for hydraulic hammer attachment in the amount of $15,000 towards the purchase of an air compressor with the remaining funds directed for use under the budgeted line item for Equipment $500 to $4999.

Minnesota DNR 2010 Federal Boating Safety Supplement Grant CFDA #97.012 (Contract #B44221)
Whereas, the Wabasha County Sheriff’s Office has been authorized to participate in the 2010 Federal Boating Safety Supplement Grant; and
Whereas, the Sheriff’s Office has received the 2010 contract which needs to be approved and signed by the Sheriff, County Auditor or County Administrator and County Board Chairperson; and
Whereas, the Sheriff requests the approval and signing of the 2010 Minnesota Department of Natural Resources Federal Boating Safety Supplement Grant by the County Administrator, Chairman of the County Board, and Sheriff.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: the 2010 Minnesota Department of Natural Resources Federal Boating Safety Supplement Grant is hereby approved and authorizes it’s signing by the County Administrator, Chairman of the County Board, and Sheriff.

Resolution No: 2010-123
Whereas, Wabasha County will enter into an Agreement with the State of Minnesota, SE MN Regional Radio Board, and Olmsted County, fiscal agent for the SEMN RRB for the 2009 Interoperable Emergency Communications Grant Program (IECGP) effective from date grant is signed thru 02/28/2011, in which each County or City within the SE MN Regional Radio Board is required to pay matching funds of $912.92 for P25 interoperable equipment (portable radios/mobile radios/control stations).
Whereas, this item has been requested through the E-911 2011 line item budget.
Whereas, no equipment can be purchased for a specific County or City of the SE MN Regional Radio Board until their match has been received by the fiscal agent, Olmsted County.
Be It Resolved that Wabasha County enters into an Agreement with the State of Minnesota, SE MN Regional Radio Board, and Olmsted County, fiscal agent for the SE MN Regional Radio Board for the 2009 HSEM Interoperable Emergency Communications Grant Program (IECGP) Grant.

Resolution Number: 2010-125
Whereas, Wabasha County relies on private solid waste haulers to provide solid waste hauling services for citizens; and
Whereas, each hauler enters into a Waste Delivery Contract which governs those services, and
Whereas, the current Waste Delivery Contract between Wabasha County and all of the haulers expires on June 30th 2010, and
Whereas, all of the haulers have signed the new successor contract, with the exception of Waste Management, Inc., and
Whereas, the new contract expressly states that it is not valid unless all of the haulers sign an identical contract, and
Whereas, Waste Management is negotiating a successor contract and the parties fully expect to have it, and the other amended contracts, ready for County Board approval on July 6, 2010,
Now, therefore be it resolved that the current Waste Delivery Contract may be extended until the new contract is approved, and The County Board Chair is authorized to sign an agreement to that effect.
