Meeting of July 6, 2010
The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Services Building, in the City of Wabasha, Minnesota on Tuesday, July 6, 2010 at 9:00 a.m. The meeting was called to order by Board Chairman Dwelle. The following Commissioners were present: Windhorst, Dwelle, Riester, Norman and Hall.

Resolution No.: 2010-126
Whereas, Project S.A.P. 079-602-034 – replace Bridge 79545 over Dry Creek on C.S.A.H. No. 2 by Elgin, MN, in Wabasha County, MN with any and/or all Supplemental Agreements, Change Orders or Work Orders, has been completed.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Wabasha County Auditor/Treasurer be authorized to issue a warrant for final payment to Minnowa Construction, Inc. in the amount of $20,798.76.

Resolution No.: 2010-127
Whereas, Wabasha County has applied to the Commissioner of Transportation for a grant from the Minnesota State Transportation Fund for construction of Bridge 79J60 on County Highway 2 under S.A.P. 079-602-036, and
Whereas, the Commissioner of Transportation has given notice that funding for this Project is available, and
Whereas, the amount of the grant has been determined to be $44,522.50 by reason of the lowest responsible bid, and
Whereas, the State of Minnesota requires the attached General Obligation Bond Proceeds Grant Agreement – Construction Grant for S.A.P. 079-602-036 be executed by Wabasha County in order to receive the necessary funds for this Project.
Now Therefore Be It Resolved by the Wabasha County Board of Commissioners that Wabasha County does hereby agree to the terms and conditions of the grant and attached Agreement consistent with Minnesota Statutes; 174.50, subdivision 5, clause (3), and will pay any additional amount by which the cost exceeds the estimate, and will return to the Minnesota State Transportation Fund any amount appropriated for this Project but not required.
Be it further resolved that the Chairman of the Wabasha County Board of Commissioners and County Administrator are hereby authorized to execute the attached General Obligation Bond Proceeds Grant Agreement – Construction Grant and Declaration on behalf of Wabasha County.

Whereas, the Commissioner of Transportation has given notice that funding for this Project is available, and
Whereas, the amount of the grant has been determined to be $142,584 by reason of the lowest responsible bid, and
Whereas, the State of Minnesota requires the attached General Obligation Bond Proceeds Grant Agreement – Construction Grant for S.A.P. 079-605-012 be executed by Wabasha County in order to receive the necessary funds for this Project.

Resolution No.: 2010-129
Whereas, there is no record of a speed zone study or authorization done for the segments listed below, and
Whereas, the following segments may not be currently posted at a reasonable speed, and CSAH 2 – from CSAH 11 to CSAH 23 CSAH 30 – from US TH 61 to 0.3 mile west of US TH 61 CSAH 54 – from Mn TH 60 to CSAH 1
Now Therefore be it Resolved that the Wabasha County Board of Commissioners hereby requests the Minnesota Department of Transportation conduct speed zone studies on the above described highway segments for the purpose of identifying safe and reasonable maximum speeds.

Resolution No.: 2010-130
Whereas, Wabasha County relies on private solid waste haulers to provide solid waste hauling services for citizens; and
Whereas, each licensed hauler enters into a Waste Delivery Contract which governs those services, and
Whereas, the current Waste Delivery Contract between Wabasha County and all of the haulers expired on June 30th 2010, with an extension of thirty days, and Whereas, after negotiation and discussion, a new contract which is valid for three years with two, one-year automatic renewals has been signed by each of the haulers,
Now, therefore, be it resolved that the Chairman of the Wabasha County Board is hereby authorized to sign the Waste Delivery Contracts for the following solid waste haulers who are currently licensed to haul solid waste in Wabasha County, with immediate effect. 1) Waste Management, Rochester, Minnesota 2) Waste management, Hastings, Minnesota 3) Wabasha Rubbish Removal 4) Rommel Rubbish Removal 5) Green Planet Disposal 6) Lake City Disposal 7) Veolia Environmental Services, Solid Waste Midwest

Resolution No.: 2010-131
Whereas, the Planning Commission held a public hearing on June 28, 2010 and reviewed the Conditional Use Permit Application by HUTTON SERVICES LLC on behalf of HIGH PLAINS COOP, PO Box 636, Plainview MN 55964, for the expansion of an existing business with the addition of a bulk liquid propane storage tank facility and activities associated with truck distribution of product as regulated under Article 10, Sect. 3, Subd. 15 of the Wabasha County Zoning Ordinance. The conditional use involves High Plains COOP property located at: 401 South Smith Street, Kellogg MN, 55945 Parcel # 05.00280.09 Lot 10 SE ¼ of NE ¼ Section 27, T.110.-R10W (Greenfield Township) Whereas, the Planning Commission approved the request 4-0 and recommends approval from the County Board with the following conditions: None
Now therefore be it resolved that the Wabasha County Board of Commissioners approves the Conditional Use request with listed conditions.

Resolution No.: 2010-132
Whereas, Wabasha County Emergency Management develops and maintains a County-wide All-Hazard Emergency Operations Plan (EOP) that serves a guideline for responding to hazards that can affect the county. The Plan must contain at least 16 SARA Title III items listed in the Local Emergency Operations Plan Crosswalk;
Whereas, said EOP is updated and reviewed yearly in a 4-year Plan Review cycle developed by the Minnesota Division of Homeland Security and Emergency Management;
Be It Resolved that the Wabasha County Board of Commissioners hereby approves the 2010 Wabasha County-wide All-Hazard Emergency Operations Plan (EOP) with its revisions and updates by signing the Certification of Plan Approval page.

Resolution No.: 2010-133
Whereas, the 16 counties that are the members of the Region One – Southeast Minnesota Homeland Security and Emergency Management Organization Joint Powers Board, have established a mechanism whereby they may jointly exercise powers common to each party on issues requiring regional coordination by having created a Joint Powers Agreement; and
Whereas, the Board for said Joint Powers Agreement shall be made up of one voting member from each of the 16 Southeast MN counties; Wabasha County joined in the Joint Powers Agreement in November 2009; and
Whereas, the Joint Powers Board has recognized the need for operating funds for items that need to be paid up front, including, but not limited to, legal representation fees, fiscal agent fees, grant funded planner position, and insurance; each county will provide the same amount in the form of a membership fee.
Now, Therefore, be it resolved that Wabasha County approves payment of the membership fee of $1000 for 2010 understanding that this amount will be adjusted annually as the amount of costs is realized.

Resolution No.: 2010-134
Whereas, Wabasha County initially failed its 2009 Pay Equity Report and the Board authorized the County Administrator to make point changes in some positions to more closely bring them in line with the State’s Job Match, and;
Whereas, the revised report was submitted and found to pass, the statistical analysis test, the salary range test, and exceptional service pay test, and;
Whereas, the Board approved the formation of a Committee to reevaluate all County positions for 2010, which is currently in process, and; Whereas, the State requires official approval of the revised Pay Equity Report by the Board.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners approves the revised Pay Equity Report for 2009, and authorize the County Administrator to submit the revised report to the State.

Resolution No.: 2010-135
Whereas, the current copier in the Courthouse is in need of replacement; and
Whereas, a multi-function copier from Metro Sales at a cost of $7,552 plus sales tax and delivery charges has been selected to replace the copier; and
Whereas, the amount of $7000.00 was appropriated in the 2010 budget to purchase a multi-function copy machine; and
Whereas, the recorder’s equipment fund will be used to cover the overage caused by the addition of the fax module.
Now therefore be it resolved by the Wabasha County Board of Commissioners that the Finance Director is hereby authorized to purchase a multi-function copier machine for the courthouse.
Be it further Resolved by the Wabasha County Board of Commissioners that the current copier machine be considered excess equipment to be disposed of by the by the County Administrator.

Resolution No.: 2010-136
Whereas, Wabasha County currently has labor contracts with the Teamsters and AFSCME that expire December 31, 2010, and;
Whereas, it is in the best interest of the County and the Unions to have new labor agreements agreed upon prior to January 1, 2011.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the County’s Negotiating Committee, consisting of the County Administrator, the County Attorney, Commissioner Dwelle and Commissioner Norman be authorized to begin contract negotiations with the Teamsters and AFSCME.

Resolution No.: 2010-137
Whereas, the County is in the process of moving offices and functions between four buildings at three sites, requiring the moving of furniture, files and office equipment, and this work will require the disassembly and reassembly of many items, and;
Whereas, this work must be performed in three phases due to the nature of the move. We will be moving from the second floor of the Services Building to the Old Courthouse and Annex and the Criminal Justice Center, from the Old Courthouse to the Annex and from the Public Health Building to the Services Building, and:
Whereas, the company that performed the move to the Criminal Justice Center did an excellent job and performed work beyond what was contracted and paid for, and;
Whereas, a quote was obtained from this same firm for this move at an estimated amount based upon 65 hours for five men and a truck at $190 per hour for a total of $12,350.00.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Board authorizes the County Administrator to enter into a contract with Winona Moving and Storage in the amount of $12,350.00, or a lesser amount if the work performed so indicates.
