Meeting of September 28, 2010
The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, September 28, 2010 at 11:00 a.m. The meeting was called to order by Board Chairman Dwelle. The following Commissioners were present: Windhorst, Dwelle, Riester, Norman and Hall.

Resolution No.: 2010-188
Whereas, the Minnesota Department of Human Services, acting through its Department of Human Services, Alcohol and Drug Abuse Division (hereinafter State) and the County of Wabasha, 411 Hiawatha Drive East, Wabasha, MN 55981 (hereinafter Pilot County), witnesseth that:
Whereas, the State is authorized by Minnesota Laws 2010, Chapter 376 Section 1 to approve and implement: Chemical Health Care Home Pilot Services, and,
Whereas, Wabasha County has previously entered into a Cooperative Agreement with Olmsted County, the fiscal agent for the Chemical Health Care Home Pilot Project for the counties of SE Minnesota and represents that it is duly qualified and willing to perform the services set forth in the County Grant Contract; and
Whereas, the State is empowered to enter into contracts for provisions of chemical dependency services for the treatment of chemical dependency or prevent further chemical abuse; and Whereas, the State is permitted to share information with the Pilot County in accordance with Minnesota Statute, section 13.46, and
Whereas, the Pilot County agrees to comply with the provisions of Minnesota Statutes 254A.07, relating to coordination of local programs; Now, therefore be it resolved, the Wabasha County Board of Commissioners approve the participation of Wabasha County as a Pilot County in the Chemical Health Care Home Pilot Services in Southeastern Minnesota. This Resolution further authorizes the Social Services Director and the Wabasha County Attorney to execute the Grant Contract with the State.

Resolution No.: 2010-189
Whereas, Project S.A.P. 079-602-036 – replace Bridge No. 92426 (new Bridge No. 79J60) on C.S.A.H. No. 2, at Junction of C.S.A.H. No. 2 and C.S.A.H. No. 23, in Wabasha County, MN with any and/or all Supplemental Agreements, Change Orders or Work Orders, has been completed.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Wabasha County Auditor/Treasurer be authorized to issue a warrant for final payment to Schumacher Excavating, Inc. in the amount of $5,355.60.

Resolution No: 2010-190
Whereas, the 2009 Child Sexual Predator Program Joint Powers Agreement was authorized and passed by Resolution #2009-082 on April 28, 2009.
Whereas, the Sheriff’s Office is requesting authorization to amend Clause 1, Section 1.2 “Expiration date” of said Contract #3000-1379 to extend the original expiration date to August 31, 2011, or until all obligations have been satisfactorily fulfilled, whichever occurs first.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: the amendment to Clause 1, Section 1.2 “Expiration date” to the 2009 Child Sexual Predator Program Joint Powers Agreement; Contract #3000-1379, is hereby approved and authorizes it’s signing by the Sheriff and Chairman of the County Board.

Resolution No.: 2010-191
Whereas, the Veteran Service Office Administrative Assistant will be on medical leave for approximately eight weeks for pregnancy with her due date of November 9, 2010 , and will be out on FMLA leave, FMLA leave could be up to twelve weeks and;
Whereas, the maternity leave for this employee will be unpaid except for vacation and sick days accrued (approximately four weeks.) Whereas, the county would be responsible for four to eight weeks salary payment to Kelly Services temporary agency at a rate of $15.25-$16.39 per hour (with wage and fees).
Whereas, the Veteran Service Office will need Administrative Support at minimum to handle phone calls, walk-ins, filing, van scheduling and filing paperwork with various agencies.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Veteran Service Office be allowed to hire a qualified individual through a temporary service for up to 8 weeks.

Resolution No.: 2010-192
Whereas, the Wabasha County Veteran Affairs Officer recommends Wabasha County apply for the 2011 Office Enhancement Grants. Whereas, there is a State of Minnesota Department of Veteran Affairs has been awarded $754,740 in grant money to be used by County Veteran Service Offices that must be distributed amongst eighty- seven (87) county service offices.
Whereas, the grants need to be applied for by October 1, 2010. Whereas, there are no county funds required.
Whereas, there will be six grants applied for totaling approximately $33,000.00 over a two year period of time.
Whereas, the grants will be used to enhance the County Veteran Affairs Office.
Whereas, the State of Minnesota Department of Veteran Affairs will be making the decision on grants on November 24, 2010.
Whereas, the grants, if approved, will be given to Wabasha County for the service office sometime after January of 2010. Whereas, according to County policy there must be board approval to allow the service officer to apply for and accept the State of Minnesota CVSO Grants.
Now Therefore Be It Resolved by the Wabasha County Board of Commissioners that the Veteran Service Officer has the authority to apply for and accept the State of Minnesota CVSO grant money described above.

Resolution No.: 2010-193
Whereas, the following applicant wishes to have their Minnesota Lawful Gambling – Premise Permit Application approved: Elba Snowbirds Inc. in Plainview Township, 25188 534th St., Plainview, and
Whereas, the application is good for two years.
Now therefore be it Resolved by the Wabasha County Board of Commissioners hereby approves the Minnesota Lawful Gambling – Premise Permit Application for the Elba Snowbirds Inc. in Plainview Township, subject to the approval of the State of Minnesota Gambling Control Board.

Resolution No.: 2010 -194
Whereas, the following applicant wishes to have his County On Sale and Sunday Liquor License approved: On Sale & Sunday Liquor Troy stock Fast Cat Inc. Plainview Township
Whereas, the applicant has applied for and will receive a food & beverage license issued by Wabasha County Public Health effective October 1, 2010, and
Whereas, the application has been approved by the County Attorney and County Sheriff. The Wabasha County Auditor/Treasurer has received a certificate of insurance and the appropriate license fee. The liquor license will run from October 1, 2010 to July 31, 2011.
Now therefore be it resolved that Wabasha County Board of Commissioners hereby approves the Liquor License to the individual listed above, subject to the approval of the State of Minnesota Liquor Control Commissioner.

Resolution No.: 2010-195
Whereas, five of the exterior air conditioning units were installed when the Wabasha County Services Building was built, and;
Whereas, these five units have all failed this past summer and are the older R22 model that are not considered environmentally friendly, and;
Whereas, three quotes were obtained for the replacement of these five units with Aaron LaRocque Heating, Cooling and Plumbing, LLC providing the lowest quote for the work to be performed in the amount of $21,850. A quote of $22,225 was received from Haley Comfort Systems and a quote of $22,170 was received from Honeywell Building Solutions.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that they approve the quote for $21,850 from Aaron LaRocque Heating, Cooling and Plumbing, LLC and authorize the County Administrator to have the work performed.

Resolution No.: 2010-196
Whereas, the County of Wabasha, Minnesota has sustained severe losses of major proportions, brought on by flood conditions occurring in September 2010; and
Whereas, Wabasha County is a public entity within the State of Minnesota; and
Whereas, Wabasha County suffered significant damages to Wabasha County roads and bridges, rendering County roads and bridges impassable and/or unsafe to travel; and
Whereas, immediate repair of flood damaged County roads and bridges is necessary to facilitate recovery and emergency aid efforts, to facilitate effective and timely delivery of emergency services, and to facilitate safe travel for public, government, and business purposes; and
Whereas, immediate contracting of emergency bridge and road repairs, without the requirement of advertising for bids, is necessary to protect public health, safety and welfare;
Now Therefore be it Resolved that the Wabasha County Board of Commissioners, acting on behalf of and for the people of Wabasha County, hereby declare that, pursuant to Minnesota Statutes 375.21 and 375.22, the Wabasha County Highway Department is hereby authorized to immediately enter into necessary contracts for emergency repair of damaged and negatively impacted County roads and bridges without the requirement for advertising for bids; said authorization to remain in place until modified or rescinded by this Board.

Resolution No.: 2010-197
Whereas, the heavy rains of September 23, 2010 has impacted the population of Wabasha County and its cities; and
Whereas, the heavy rains and resulting flooding has caused a significant amount of public property damage; and
Whereas, the Wabasha County Emergency Management Office requests the Wabasha County Board of Commissioners to declare a LOCAL EMERGENCY for Wabasha County for the rain/flood event of September 23, 2010;
Now Therefore Be It Resolved that the Wabasha County Board of Commissioners declares a Local Emergency for Wabasha County in response to the conditions resulting from the rain/flood event of September 23, 2010.
