Meeting of February 6, 2008

The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Services Building, in the City of Wabasha, Minnesota on Tuesday, February 5, 2008 at 9:00 a.m.
The meeting was called to order by Board Chairman Riester.
The following Commissioners were present: Windhorst, Dwelle, McNallan, Riester and Springer.

Motion to approve the agenda.

Resolution No.: 2008-029
Whereas, the Wabasha County Highway Department finds it beneficial for the County to purchase one Trimble TCS2 Survey Controller. Now Therefore
Be it Resolved by the Wabasha County Board of Commissioners that the Wabasha County Highway Department be authorized to purchase from the State Bid one Trimble TCS2 Survey Controller from Frontier Precision Inc. in an amount not to exceed $5,405.50 plus sales tax and shipping.

Resolution No.: 2008-030
Whereas, Wabasha County has advertised and conducted interviews for a soon to be vacant Highway Maintenance Worker Position, Now Therefore
Be it Resolved that the Wabasha County Board of Commissioners hereby authorizes the County Highway Engineer to hire James Lewison as a Highway Maintenance Worker.

Resolution No.: 2008-031
Whereas, the Wabasha County Highway Department proposes to acquire land along the existing right of way of CSAH 7 for the purpose of reconstructing the highway under S.A.P. 079-607-019; and
Whereas, S.A.P. 079-607-019 is necessary in order to improve this segment of CSAH 7 to meet Minnesota State Aid standards and provide for public health, welfare, safety and convenience; and
Whereas, the necessary lands for S.A.P. 079-607-019 are as described in Wabasha County Highway Right of Way Plat No. 36. Now Therefore
Be it Resolved that the Wabasha County Board of Commissioners hereby accepts Wabasha County Highway Right of Way Plat No. 36. Be it further resolved, that the Wabasha County Board of Commissioners hereby authorizes the County Highway Engineer to proceed to acquire the necessary lands as described in Wabasha County Highway Right of Way Plat No. 36 in accordance with applicable laws and statutes.

Resolution No.: 2008-032
Whereas, the Wabasha County Highway Department proposes to acquire land along the existing right of way of CSAH 2 for the purpose of replacing Bridge 4080 under S.A.P. 079-602-034; and
Whereas, the land to be acquired is necessary for S.A.P. 079-602-034 as shown on the plans for construction; and
Whereas, S.A.P. 079-602-034 is necessary in order to improve this segment of CSAH 2 to meet Minnesota State Aid standards and provide for public health, welfare, safety and convenience; and Now Therefore
Be it Resolved that the Wabasha County Board of Commissioners hereby authorizes the County Highway Engineer to proceed to acquire the necessary lands for the completion of S.A.P. 079-602-034 in accordance with applicable laws and statutes.

Whereas, The request for bids for Project S.A.P. 079-604-043 needs to be published. Now Therefore
Be it Resolved by the Wabasha County Board of Commissioners that the Wabasha County Highway Engineer be authorized to advertise for bids for Project S.A.P. 079-604-043 – Bituminous Surfacing and Aggregate Shouldering on CSAH 4, beginning at a point 2730 feet south of the Junction of CSAH 4 and CSAH 10, ending at a point 75 feet south of the junction of TH 61 and CSAH 4.

Resolution No.: 2008-034
Whereas, ACS State & Local Solution, Inc. and the Minnesota Counties Computer Cooperative (MCCC) has made and entered into a Maintenance and Support Agreement, and
Whereas, in this agreement ACS furnishes MCCC with an appraisal software system, CAMA-USA, and a Property tax System Program, and
Whereas, Wabasha County has been asked to ratify said Maintenance and Support Agreement, which will be effective January 1, 2009 through December 31, 2011. Now therefore
Be it resolved by the Wabasha County Board of Commissioners hereby ratifies the Maintenance and Support Agreement between ACS State & Local Solutions, Inc. and the Minnesota Counties Computer Cooperative for the Maintenance and support of the ACS Property Tax Software and CAMA-USA.

Resolution No.: 2008-035
Whereas, the State of Minnesota requires Wabasha County to have a multi-jurisdictional All Hazard Mitigation Plan in order to receive future federal funding; and
Whereas, Wabasha County will receive grant funding to cover the cost of creating the All Hazard Mitigation Plan; and
Whereas, the multi-jurisdictional All Hazard Mitigation Plan subcommittee reviewed six proposals and selected, in their opinion, the most qualified firm; and Now Therefore
Be it Resolved that the County of Wabasha hire Yaggy Colby Associates as the consultant to create the All Hazard Mitigation Plan.

Resolution No.: 2008-036
Whereas, the Wabasha County Planning Commission has held a public hearing and considered an application from Kevin Kautz, 60146 Highway 63, Zumbro Falls MN 55991 for an expansion of commercial business, golf course clubhouse addition, in accordance with Article 9, Section 3, Subd. 8 of the Wabasha County Zoning Ordinance. The request involves the following described properties: Parcel # R17.00014.00 S ½ SW ¼Section 7, T109N – R13W (Zumbro Twp) The application, if approved would authorize expansion of commercial business, golf course clubhouse.
Whereas, the Wabasha County Planning Commission voted 3-0 to recommend approval of the above-mentioned expansion of a commercial business, IE: golf course clubhouse with conditions: Any outside lighting shall be of a down lighting concept. Now Therefore
Be It Resolved by the Wabasha County Board of Commissioners that it approves the request as described above based upon the recommendation of the Wabasha County Planning Commission.

Resolution No: 2008-037
Whereas, the Wabasha County Sheriff’s Office has been authorized to participate in the 2008 State Boat and Water Safety Grant; and
Whereas, the Sheriff’s Office has received the 2008 contract which needs to be approved by the Sheriff, County Auditor, and County Board Chairperson; and
Whereas, the Sheriff requests the approval and signing of the 2008 Minnesota Department of Natural Resources State Boat and Water Safety Grant by the Chairman of the County Board. Now Therefore
Be it Resolved by the Wabasha County Board of Commissioners that: the 2008 Minnesota Department of Natural Resources State Boat and Water Safety Grant is hereby approved and authorizes it’s signing by the Chairman of the County Board.

Resolution No: 2008-038
Whereas, the Wabasha County Sheriff’s Office is requesting to purchase one (1) Chevrolet Silverado 1500 4WD Crew Cab at a cost of $24,683.40 and one (1) fiberglass topper at a cost of $1,335.00 which will total $26,018.40; and
Whereas, the monies for this vehicle will come out of the State Boat & Water Grant funds which will be reimbursable within 4 years; Now Therefore
Be it Resolved by the Wabasha County Board of Commissioners that: the Sheriff is authorized to purchase one (1) Chevrolet Silverado 1500 4WD Crew Cab and one (1) fiberglass topper from Thane Hawkins Polar Chevrolet at a cost not to exceed $26,925.00. Be it Further Resolved by the Wabasha County Board of Commissioners that funding of the repair will come from the State Boat & Water Grant.

Resolution No: 2008-039
Whereas, the Wabasha County Sheriff’s Office is requesting to purchase one (1) K-9 from the Minneapolis Police Department at a cost not to exceed $6,500; and
Whereas, the monies for this purchase will come from the proceeds from an upcoming sale of a vehicle forfeiture as an allowed expenditure under Statute 609.5315; Now Therefore
Be it Resolved by the Wabasha County Board of Commissioners that: the Sheriff is authorized to purchase one (1) K-9 from the Minneapolis Police Department at a cost not to exceed $6,500. Be it Further Resolved by the Wabasha County Board of Commissioners that funding of the purchase will come from the sale proceeds from vehicle forfeiture under Statute 609.5315.

Resolution Number 2008-040
Whereas, a 2004 Chevrolet Impala Sedan squad car (#55) is considered a surplus as it has been replaced with a 2008 Dodge Charger as approved through the 2008 budget proceedings; and
Whereas, the Wabasha County Sheriff’s Office is requesting that this vehicle be sold on Ebay; and
Whereas, the Wabasha County Sheriff Office is requesting that the proceeds from the sale of this vehicle be deposited back into the general fund of Wabasha County. Now Therefore
Be it Resolved by the Wabasha County Board of Commissioners that: the Sheriff is authorized and directed to sell the 2004 Chevrolet Impala Sedan bearing VIN #2G1WF55K849350366 on Ebay as noted above. Be it Further Resolved by the Wabasha County Board of Commissioners that: funds from the sale be deposited to the general fund of Wabasha County.

Resolution Number 2008-041
Whereas, a 1999 Ford ES Windstar transport van (#63) is considered a surplus; and
Whereas, the Wabasha County Sheriff’s Office is requesting that this vehicle be sold on Ebay; and
Whereas, the Wabasha County Sheriff Office is requesting that the proceeds from the sale of this vehicle be deposited back into the general fund of Wabasha County. Now Therefore
Be it Resolved by the Wabasha County Board of Commissioners that: the Sheriff is authorized and directed to sell the 1999 Ford ES Windstar bearing VIN #2FMZA5145XBA80967on Ebay as noted above. Be it Further Resolved by the Wabasha County Board of Commissioners that: funds from the sale be deposited to the general fund of Wabasha County.

IT coordinator position was discussed and advertised. The position of IT Coordinator will be advertised and in the mean time Kyle Jerviss, the IT Technician, will receive a pay increase for taking on extra responsibility. Assistant County Attorney Lisa Bayley discussed personnel policies. There was a brief report from the interim administrator.
DWELLE - McNALLAN
Resolution No: 2008-042
Whereas, Elert & Associates was contracted by the County to review certain technical aspects of the PSAP (Public Safety Answering Point) within the new Criminal Justice Center; and,
Whereas, Elert & Associates after reviewing plans and drawings with County staff developed a Short Terms Needs Report; and,
Whereas, the changes within the PSAP will not increase current construction costs; and,
Whereas, Elert & Associates after reviewing plans with County staff recommends an addition for additional space on top of the sally port to contain critical public safety radio equipment; and,
Whereas, an additional ($20,000) is required to fund the additional space required; and Now Therefore
Be it Resolved by the Wabasha County Board of Commissioners that: hereby approve the Elert & Associates Short Term Needs Report.
