Meeting of January 8, 2008
The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Services Building, in the City of Wabasha, Minnesota on Tuesday, January 8, 2008 at 9:00 a.m. The meeting was called to order by Auditor-Treasurer Jerry Leisen. McNALLAN- SPRINGER Motion to appoint Pete Riester Wabasha County Board of Commisioners Board Chair. Adopted Unanimously The following Commissioners were present: Windhorst, Dwelle, McNallan, Riester and Springer. McNALLAN – DWELLE Motion to approve the agenda and that Resolutions 2008-015 and 2008-016 follow Resolution 2008-002. Adopted Unanimously McNALLAN- DWELLE Motion to appoint Don Springer Wabasha County Board of Commissioners Vice Chair. Adopted Unanimously Commissioners reported on meetings they had attended. There was no public comment during the public forum. Recess for Regional Railroad Authority Meeting McNALLAN - SPRINGER Motion to approve the consent agenda including the following: Claims Meal Vouchers SSIS Claims Minutes: December 18 and December 26, 2007 Adopted Unanimously No action was taken on Resolution 2007-298, possible conflict of interest. Resolution Number: 2007-298 Re-appointment of David Windhorst to the Southeastern Minnesota Multi-County Housing and Redevelopment Authority Be It Resolved, by the County Board of Wabasha County, Minnesota that the recommendation from the Southeastern Minnesota Multi-County Housing and Redevelopment Authority of David Windhorst to serve as Commissioner of the Southeastern Minnesota Multi-County Housing and Redevelopment Authority for a period of five (5) years, the recommendation of appointment is hereby approved. McNALLAN – SPRINGER Resolution No.: 2008-001 Whereas, the Southeastern Minnesota Multi-County Housing and Redevelopment Authority (hereinafter “the Authority”) is required to the general public the opportunity to voice their questions and concerns as it relates to the 2008 Wabasha County Small Cities Development Program Application, and Whereas, the Authority will hold a public hearing on the 2008 Wabasha County Small Cities Development Program Application. Now, Therefore, Be It Resolved By the Board of Commissioners that a public hearing will be held on Tuesday, January 22, 2008 at 11:00AM at the Wabasha County Social Services Building, 625 Jefferson Avenue, Wabasha, MN 55981. Adopted Unanimously WINDHORST - SPRINGER Resolution No.: 2008-002 Whereas, the Wabasha County Board of Commissioners has advertised to accept sealed bids for the Wabasha County legal newspaper for 2008; and Whereas, the Wabasha County Board of Commissioners desires to open the sealed bids on Tuesday, January 8, 2008; and Whereas, three bids were received; the Lake City Graphic, The Plainview News and The Wabasha County Herald; and Whereas, the Lake City Graphic is the apparent low bidder of $9.35 per standard advertising unit (SAU). Now therefore Be it resolved by the Wabasha County Board of Commissioners hereby accepts the bid of the as the “legal County newspaper,” to include publications of the Commissioners Proceedings, the Delinquent Tax List and other notices ordered by the County Board of Commissioners as required by law for the year 2008. Adopted Unanimously DWELLE - SPRINGER Resolution No.: 2008-003 Whereas, that the Wabasha County Board of Commissioners hereby has entered into a contract for service with Rhonda Donnay-Rice to administer the Parent Education Program at the direction of the County Administrator. Whereas, that Rhonda Donnay-Rice agreed to work through the end of 2007 Now, Therefore Be it resolved that the Wabasha County Board of Commissioners terminates the contract for services with Rhonda Donnay-Rice according to section 3 of the contract for service agreement. Adopted Unanimously SPRINGER - WINDHORST Resolution No.: 2008-004 Resolution Establishing Committee Assignments for 2008 Whereas, the County Board has many responsibilities that relate to other civic and governmental organizations and agencies; and Whereas, frequently, these responsibilities require the County Commissioners participate as a Committee or Board Member for these organizations and agencies. Resolution No.: 2008-005 Whereas, annually, the County Board is required to identify certain positions and/or individuals to perform certain fiscal functions and operations Now Therefore Be It Resolved by the Wabasha County Board of Commissioners that the following appointments and actions requiring specific action pursuant to statute, rule or ordinance are hereby directed and approved: Be It Resolved, That the Wabasha County Board of Commissioners hereby approves retroactively to January 1, 2008 the payment for necessary express, freight, telephone, water, light, e-bay and other utility charges to be paid on the Warrant of the County Auditor/Treasurer, upon receipt of itemized bills pursuant to MS 375.16. Be It Resolved, That the Wabasha County Board of Commissioners hereby approves retroactively to January 1, 2008 the payment for sales tax and fees and fines due to other government, to be paid on the Warrant of the County Auditor/Treasurer, upon receipt of itemized bills pursuant to MS 375.15. Be It Resolved, That the Wabasha County Board of Commissioners hereby sets the mileage reimbursement rate for 2008 at the same level as the 2008 IRS mileage rate. Be It Resolved, That the Wabasha County Board of Commissioners hereby approves the establishment and/or continuance of a Petty Cash Fund, pursuant to MS 375.162; and Be It Further Resolved, That Sheriff Rodney Bartsh shall be custodian of said fund. The amount of the fund shall not exceed $100.00. Be It Resolved, That the County of Wabasha shall pay bounty on the following rodents killed in Wabasha County during the year 2008: Striped Gophers, half of township bounty up to $.40 each maximum (last years rate) Pocket Gophers, half of township bounty up to $.80 each maximum (last years rate) Be It Resolved, That the Wabasha County Board of Commissioners hereby grants to Patrick Moga, Wabasha County Finance Officer, the authority to designate depositories of Wabasha County funds, pursuant to Minnesota Statute 118A.01 subd. 1. Whereas, it is in the best interest of Wabasha County to reduce administrative costs and increase departmental efficiency, and Whereas, costs are increasing to mail refunds of overpayments and return documents not processed because of underpayments, Be It Resolved, That the Wabasha County Board of Commissioners hereby authorizes the offices of the County Auditor/Treasurer and County Recorder to retain overpayments in amounts not exceeding $10.00 for services of any kind. Revenue from such overpayments shall be deposited in the General Revenue fund in a timely manner, and Be It Resolved, That the Wabasha County Board of Commissioners hereby authorizes the offices of the County Auditor/Treasurer and County Recorder to accept, at their discretion, underpayments of any kind with the deficit amount not exceeding $5.00 and to process the document or transaction regardless of the deficiency. Be It Resolved, That the Wabasha County Board of Commissioners hereby sets the maximum reimbursable meal allowance, for 2008, at $7.00 for breakfast, $9.00 for lunch and $14.00 for dinner. Whereas, the County Auditor/Treasurer’s Office currently maintains a checking account for the sole purpose of refunding over-payment of taxes, Be It Resolved, the County Auditor/Treasurer is authorized to maintain a checking account for overpayment of taxes and also for refunds of miscellaneous over-payments or payments made in error as required by all Wabasha County Departments. Be It Resolved, That any employee of Wabasha County who has funds to be deposited in a designated financial depository of Wabasha County, shall take said funds to the Office of the County Auditor/Treasurer for transfer to said depository. No employee shall personally transfer or transport funds, except for the County Auditor/Treasurer or designee thereof. Be It Resolved, That the Wabasha County Board of Commissioners hereby authorizes Jerry Leisen and Patrick Moga to open any deposit or checking accounts, endorse checks and orders for payment of money and withdrawal of funds on deposit with First State Bank of Wabasha. Be It Resolved, That the Wabasha County Board of Commissioners hereby approves the County Auditor/Treasurer to cash checks not to exceed $2,500 to replenish the change fund. Be It Resolved, That the Wabasha County Board of Commissioners hereby authorizes and requests that Jerry Leisen, Wabasha County Auditor/Treasurer, and Patrick Moga, Finance Officer, be named as an authorized signators on negotiable instruments of Wabasha County, provided as necessary that all Countersignatures are present. Be It Resolved, That the Wabasha County Board of Commissioners hereby authorizes that the Chairman of the Board, Jerry Leisen, Auditor/Treasurer and Patrick Moga, Finance Director, be named as authorized signators on negotiable instruments of Wabasha County, provided as necessary all Countersignatures are present. Be It Resolved, That the Wabasha County Board of Commissioners hereby approves retroactively to January 1, 2008 the payment for necessary charges to be paid on the Warrant of the County Auditor/Treasurer to avoid finance charges, upon receipt of itemized bills. Adopted Unanimously DWELLE - WINDHORST Resolution No.: 2008-007 Whereas, expenses in the amount of $122, 844.30 for the Criminal Justice Center were paid from the Special Revenue Building Fund (Fund 15) during calendar year 2006 for the Criminal Justice Center, and Whereas, a Capital Projects Fund (Fund 37) was established in 2007 to cover expenses related to the Criminal Justice Center, Be It Resolved, that the Wabasha County Board of Commissioners hereby authorizes an interfund transfer in the amount of $122,844.30 from the Criminal Justice Center Capital Projects Fund to the Special Revenue Building Fund effective December 31, 2007. Adopted Unanimously SPRINGER – WINDHORST Resolution No.: 2008-008 Whereas, that the Wabasha County Board of Commissioners hereby authorizes the following employees and board member the ability to do the following with First State bank of Wabasha Now Therefore Be it Resolved by the Wabasha County Board of Commissioners hereby authorizes the addition of the endorsement of Peter Riester and removal of Eugene T. McNallan. Adopted Unanimously McNALLAN - DWELLE Resolution No.: 2008-009 Whereas, that the Wabasha County Board of Commissioners hereby approved a resolution on disposal of excess equipment, Whereas, the MIS Department has determined the attached list of equipment as excess, Whereas, the excess property will be disposed of by Olmsted County Public Works Department, Now, Therefore Be it resolved that the Wabasha County Board of Commissioners approves the attached list of equipment as excess property. Adopted Unanimously DWELLE - SPRINGER Resolution No.: 2008-010 Whereas, that the Wabasha County Board of Commissioners hereby has previously entered into a contract for service with Rhonda Donnay-Rice to administer the Parent Education Program at the direction of the County Administrator. Whereas, a new person will be needed for the Parent Education program Now, Therefore Be it resolved that the Wabasha County Board of Commissioners contract for services for one day a week for a replacement for Rhonda Donnay-Rice for the Parent Education Program. Ayes: Riester, Springer, Dwelle Nays: McNallan, Windhorst Adopted DWELLE - SPRINGER Resolution No.: 2008-011 Whereas, that the Wabasha County Board of Commissioners hereby has previously entered into a contract for service for the Parent Education Program at the direction of the County Administrator. Whereas, a United Way grant has provided funding for this program Now, Therefore Be it resolved that the Wabasha County Board of Commissioners grant permission to resubmit for the United Way grant for the Parent Education Program. Ayes: Riester, Springer, Dwelle, Windhorst Nay: McNallan Adopted Accept Resignation and Appoint New Member to Planning Commission County Attorney Lisa Bayley brought to the Board’s attention that there should be a different appointing process for the County’s Planning Commission Members, she suggested letting the public know there is an opening and go through the application process to be on the Board. WINDHORST – DWELLE Accept resignation of Jack Stamschror with regrets and thank him for his service. Adopted Unanimously McNALLAN – DWELLE Appoint John Lubinski for the remainder of Jack Stamschror’s term, December 31, 2008. Adopted Unanimously McNALLAN - SPRINGER Resolution No.: 2008-012 Whereas, the Wabasha County Board of Commissioners has been notified by the Minnesota Board of Water and Soil Resources that the Wabasha County Comprehensive Local Water Management Plan has been approved according to Minnesota Statutes Chapter 103B.301: Now, Be It Further Resolved, the Wabasha County Board Commissioners hereby adopts and will begin implementation of its approved comprehensive water plan. Be It Further Resolved, after the adoption of the local comprehensive water management plan, the Wabasha County Board shall amend existing water and related land resources plans and official controls as necessary to conform them to the applicable and approved comprehensive water plan. Be It Further Resolved, after the adoption of the local comprehensive water management plan, Wabasha County shall notify local units of government within the County of the adoption of the plan or amendments to the plan. The local units of government are required to submit existing water and related land resources plans and official controls within 90 days to the County Board for review. Be It Further Resolved, within 180 days, the Wabasha County Board shall review the submitted plans and official controls and identify any inconsistencies between the local plans and official controls, and local comprehensive water management plan. The Wabasha County Board shall specify applicable and necessary measures to bring the local plans and official controls into conformance with the local comprehensive water management plan. Be It Further Resolved, if a local unit of government disagrees with any changes to its plan, the local unit has 60 days after receiving the county’s recommendations to appeal the recommendations to the Board of Water and Soil Resources. Be It Further Resolved, after receiving the recommendations of the Wabasha County Board, or a resolution of an appeal, a local unit of government has 180 days to initiate revisions to its plan or official controls. The new or revised plans and official controls must be submitted to the Wabasha County Board for review and recommendations. Adopted Unanimously SPRINGER – DWELLE Resolution No: 2008-013 Resolution approving the updated Wabasha County Geospatial Data Distribution Policy & Fees Schedule Whereas, the Wabasha County Board of Commissioners recognize that an updated geospatial data distribution policy shall be approved to clearly dictate how Geographic Information Systems (GIS) data, that has been collected, maintained, and produced by Wabasha County GIS, will be shared with other entities; and Whereas, the Wabasha County Geospatial Data Distribution Policy & Fees Schedule is based upon the 2006 GIS Data Distribution Policy & Fees Schedule, and Whereas, the updated Wabasha County Geospatial Data Distribution Policy & Fees Schedule has minor modifications to the fee schedule that more clearly defines the fee structure. The updated Wabasha County Geospatial Data Distribution Policy & Fees Schedule also addresses more types of requests, such as online access and distribution to educational users. Now Therefore Be it Resolved, that the Wabasha County Board of Commissioners approve the updated Wabasha County Geospatial Data Distribution Policy & Fees Schedule, and said policy & fees be set in place upon adoption. Adopted Unanimously WINDHORST - DWELLE Resolution No.: 2008-015 Whereas, Wabasha County is a member of the Minnesota Counties Computer Cooperative (“MCCC”), and Whereas, MCCC and all of its members wish to amend and restate the Joint Powers Agreement, and Whereas, the Amended and Restated Joint Powers Agreement has been reviewed for form by the Assistant County Attorney. Now therefore Be it resolved by the Wabasha County Board of Commissioners hereby approves the Amended and Restated Joint Powers Agreement between Wabasha County and the Minnesota Counties Computer Cooperative (MCCC) and authorizes the County Board Chair and County Administrator to sign the agreement. Adopted Unanimously SPRINGER – DWELLE Resolution No.: 2008-016 Whereas, Wabasha County is a member of the Minnesota Counties Computer Cooperative (“MCCC), and Whereas, MCCC and Wabasha County has signed an Amended and Restated Joint Powers Agreement, and Whereas, both parties wish to do an Amendment to the Amended and Restated Joint Powers Agreement. Now therefore Be it resolved by the Wabasha County Board of Commissioners hereby approves Amendment No. 1 to Minnesota Counties Computer Cooperative Amended and Restated Joint Powers Agreement between MCCC and Wabasha County and authorizes the County Board Chair and County Administrator to sign the agreement. Adopted Unanimously McNALLAN - WINDHORST Resolution No.2008-014 Whereas, the Wabasha County Board has authorized the County Administrator to advertise a vacancy for the position of Stationary Engineer, and Whereas, the Wabasha County Administrator has interviewed and selected Gerard Marking as the successful applicant, Now Therefore Be It Resolved that the Wabasha County Board of Commissioners hereby authorizes hiring Gerard Marking to the full time, union position of Stationary Engineer at grade 8, ($15.69 per hour) of the collective bargaining agreement with the American Federation of State, County and Municipal Employees Local 3542 contingent upon union approval. Start date for this position would be no later than Wednesday, January 9th, 2008. Adopted Unanimously Sheriff Rodney Bartsh reported on Out-of-County Prisoners. Boarding cost for December 2007 for out of county prisoners was $30,610, $38,398.74 including gas and wages for transporting. There are now 19-20 inmates in other county jails. Compared to this time last year the number of inmates is down. Assistant County Attorney Bayley briefly discussed the County’s Personnel Policies.
