Meeting of October 19, 2010
The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, October 19, 2010 at 9:00 a.m. The meeting was called to order by Board Chairman Dwelle. The following Commissioners were present: Windhorst, Dwelle, Riester, Norman and Hall.

Administrator’s Update: October 25, District IX AMC meeting, 8:15 in Albert Lea December 6-8 MN AMC, St. Cloud MCIT – delegate October 21, teamsters’ negotiations AMC Executive Director Public forum comments regarding development were made by Jerome Vierling and Trent Kannenberg

Motion to approve the consent agenda including the following: Claims Meal Vouchers SSIS Claims Minutes: October 5, 2010 Accept Donation of $250 from American Legion Auxiliary McCahill Post 110 to Youthlink Mentorship Program.

Resolution No.: 2010-201
Whereas, the Minnesota State Retirement System offers a program, authorized by Minnesota Statue 352.98, which allows employees to transfer their severance payments into a post retirement Healthcare Savings Plan for use at a later date, and;
Whereas, this plan has the potential to save both the County and the employee money, and;
Whereas, AFSCME Council 65, Local 3533 Highway Unit has requested an MOU with the County to establish the Post Retirement Healthcare Plan.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the requested MOU with the County be approved for the duration of the existing contract.

Resolution No.: 2010-202
Whereas, the non-bargaining unit employees of Wabasha County request County Board consideration and approval to develop a health care savings plan; and
Whereas, the group of non-bargaining unit employees is clearly defined by Wabasha County Human Resources and currently includes 53 employees; and
Whereas, the group of non-bargaining unit employees affected by this Resolution does not include Elected Officials; and
Whereas, the Minnesota State Retirement System is able to offer a health care savings plan to County employees; and
Whereas, the non-bargaining unit employees have agreed to a minimum of $500.00 value in their severance pay to be eligible for this health care savings plan (employees with less than $500.00 value in their severance pay will receive the funds as a cash payout); and Whereas, a majority of the said non-bargaining unit employees have requested Wabasha County to formally participate with the Minnesota State Retirement System in the health care saving plan;
Now, therefore be it resolved, the Wabasha County Board of Commissioners approves participation in the health care savings plan as offered through the Minnesota State Retirement System. Contributions to the health care savings plan will be 100% of an employee’s severance pay (as defined in County Policy #213), Eligible employees must have a minimum of $500 severance pay for the employee contribution to participate in this benefit. The eligible Wabasha County employees are non-bargaining unit staff in the multiple departments of the County. This benefit is not available to Elected Officials.

Whereas, the Planning Commission held a public hearing on September 27, 2010 and reviewed the Conditional Use Permit Application by TODD AND CHERYL JACKSON,

Whereas, the Planning Commission approved the request 3-0 and recommends approval from the County Board with the following condition: minimum width of driveway and access road (township) to have 16 foot surface.
Now therefore be it resolved that the Wabasha County Board of Commissioners approves the Conditional Use request with listed conditions.

Resolution No. 2010-204
Be It Resolved that the Wabasha County Board of Commissioners hereby authorizes payment from the Feedlot IV Low Cost Share Fix 319 Grant for Jary Holst in the amount of $12,420.00 and payment from the Feedlot V Low Cost Share Fix 319 Grant for Jary Holst in the amount of $2580.00.

It was approved by Board consensus to hold a Lake Zumbro Improvement District Public Hearing at 7:00pm on Tuesday, November 16th. The regular Board meeting will be held at 6:00pm that same night in the Commissioner’s Board room. Commissioner Norman was against holding a public hearing.

Resolution No.: 2010-205
Whereas, the following applicant wishes to have their Minnesota Lawful Gambling – Premise Permit Application approved: Bulldog Quarterback Club in Plainview Township, 25188 534th St., Plainview, at Stumble Inn 2, and
Whereas, the application is good for two years. Now therefore be it Resolved by the Wabasha County Board of Commissioners hereby approves the Minnesota Lawful Gambling – Premise Permit Application for the Bulldog Quarterback Club in Plainview Township, subject to the approval of the State of Minnesota Gambling Control Board.

Resolution No. 2010-206
Whereas; South Country Health Alliance is a 14 County Minnesota Managed Care Organization authorized to provide managed care services in various Minnesota counties; and
Whereas; South Country Health Alliance has entered into a contract with the Center for Medicare and Medicaid Services (CMS) and is participating in Medicare Advantage as a Dual Eligible Special Needs Plan (SNP); and
Whereas; Freeborn County has been a participating Member County of South Country Health Alliance Member since 2001, but has chosen to discontinue its membership with South Country Health Alliance beginning 1/1/11; and
Whereas; South Country and Freeborn County have developed a mature and successful provider network that serves a significant Medicare and Medicaid enrollee membership located in Freeborn County; and
Whereas; the Freeborn County Board of Commissioners has approved Freeborn County Resolution #HS-10-6012010 in support of continuing to contract for the provision of managed care services to eligible Freeborn County residents through South Country Health Alliance for the 2011 service year; and
Whereas; to avoid disruption of service to the eligible enrollees, the Minnesota Department of Human Services has acknowledged that South Country Health Alliance would continue to serve the eligible enrollees of Freeborn County in 2011 as a part of its approved service area; and
Whereas; the member counties of South Country Health Alliance, in accordance with Minn. Stat. 471.59 and through Resolutions passed by their respected County Boards, have duly empowered the Joint Powers Board of South Country Health Alliance to provide managed care services as authorized under the term of the Joint Powers Agreement and By-Laws; and
Whereas; to ensure minimal disruption of service to the citizens of Freeborn County, the South Country Health Alliance Joint Powers Board has unanimously approved South Country Health Alliance Resolution #01-0610-0001 authorizing South Country Health Alliance to continue to provide managed care services to eligible enrollees living in Freeborn County in 2011;
Now Therefore, Be It Resolved; that Wabasha County hereby ratifies the action of the South Country Health Alliance Joint Powers Board regarding the continuing provision of managed care service to eligible enrollees living in Freeborn County,
And Be It Further Resolved that Wabasha County recognizes and acknowledges that the provision of managed care services to enrollees living in Freeborn County is subject to all the rights, obligations and conditions incident thereto; including those described in the South Country Health Alliance Joint Powers Board Articles and By-Laws and any contractual obligations incident thereto.

Whereas, the County has excess furniture due to the moves and replacement of furniture necessitated by these moves, and;
Whereas, the quantity and value of this furniture is such that its sale does not warrant the time and cost of a public auction, and; Whereas, the County has the ability to sell this furniture at a publicly advertised tag sale.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the County Administrator is authorized to dispose of the excess furniture at a tag sale to be held on County property at a date yet to be determined.
