The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, October 9, 2012 at 9:00 a.m.
The meeting was called to order by Board Chairman Harms.

Public Forum Comments: Wabasha County Historical Society, Printing & Copying, Road Closure
HALL - NORMAN Motion to approve the consent agenda including the following: Claims Meal Vouchers SSIS Claims Minutes: September 25, 2012; Town Hall Special Meeting September 27, 2012. Donation of $1200 to Veteran Service Office from the Wabasha American Legion Auxiliary: $300 to transportation program, $600 to mental health program, $300 to military appreciation fund Adopted Unanimously HALL - NORMAN Resolution No.: 2012-190 Whereas, Wabasha County has an approved Comprehensive Local Water Plan with the State of Minnesota; and Whereas, Wabasha County has received a Natural Resources Block Grant (NRBG) grant agreement from BWSR. Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the county sign the NRBG Grant Agreement. Adopted Unanimously ROSCHEN – HALL Resolution No.: 2012-185 Whereas, a 2000 Ford Explorer (former squad #62) is considered an excess as it has been replaced with a 2007 Dodge Charger (former squad #90 – VIN # 2B3KA43GX7H770946); and Whereas, Wabasha County Environmental Services (Zoning) is requesting that the 2000 Ford Explorer be transferred to that office for their use; and Whereas, the Wabasha County Emergency Management is requesting that the 2000 Ford Explorer be transferred to the Wabasha County Environmental Services Department. Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: the 2000 Ford Explorer bearing VIN # 1FMZU71X2YZB80567 be transferred to the Wabasha County Environmental Services Department. Adopted Unanimously WOBBE - NORMAN Resolution No.: 2012-191 Whereas, a 1997 Ford F150 utilized by the Environmental Services Department is being replaced with a 2000 Ford Explorer from Emergency Government; and Whereas, the Environmental Services Department is requesting that the 1997 F150 be sold since it is considered excess property; and Whereas, the Wabasha County Sheriff's Department regularly sells vehicles on eBay. Now Therefore Be It Resolved, the Wabasha County Board of Commissioners authorizes the Wabasha County Sheriff to sell the 1997 Ford F150 (VIN: 1FTDX18WXVKD27707) from the Environmental Services Department on eBay. Be It Further Resolved, funds from the sale shall be deposited to the Wabasha County Sheriff's squad car fund. Adopted Unanimously ROSCHEN – NORMAN Resolution No.: 2012-192 Whereas, Wabasha County went out for bids on Basic Life Insurance & AD&D Whereas, it is in the best interest that Wabasha County stay with the present provider, Minnesota Life, to provide Basic Life Insurance & AD&D. The basic plan will remain the same however the premium will decrease for Wabasha County and the employee. Whereas, Wabasha County agrees to contribute $7.00 for $50,000 in life insurance for all Wabasha County employees that qualify. This rate will remain in effect for 3 years. Now Therefore Be it Resolved, by the Wabasha County Board of Commissioners that it is in the best interest that Wabasha County enter into a 3 year agreement with Minnesota Life to provide Basic Life Insurance & AD&D. Adopted Unanimously ROSCHEN - HALL Resolution No.: 2012-193 Whereas, the Wabasha County Board of Commissioners agreed to fund the HSA/VEBA accounts at a monthly rate of $125.00 for single coverage and $250.00 for family, and Whereas, Board approval is necessary to continue this option for the 2013 plan year, and Whereas, to coordinate contributions the county will fund contributions twice a month in conjunction with Health insurance premiums. Now Therefore, be it Resolved that the Wabasha County Board of Commissioners agree to fund the HSA/VEBA accounts at a monthly rate of $125.00 for single coverage and $250.00 for in 2013 based on a twelve month calendar year. Employees hired in 2013 will have their contributions based on their eligible months of coverage remaining in 2013. Adopted Unanimously HALL – NORMAN Resolution No.: 2012-194 Whereas, the calendar year 2011 Flexible Spending Plan has a positive balance in the amount of $509.93; and Whereas, the General Revenue fund absorbs all overages, shortages and administrative costs for the Flexible Spending Plans, Therefore, be it resolved, that the Wabasha County Board of Commissioners hereby approves the overage to be credited to the General Revenue Fund for the calendar year 2011 Flexible Spending Plan. Adopted Unanimously ROSCHEN - HALL Resolution No.: 2012-195 Be it resolved by the Wabasha County Board of Commissioners that Wabasha County enter into the attached Well Agreement with Susan Brandt and authorizes the County Board Chair to execute the Agreement. Adopted Unanimously HALL – NORMAN Resolution No.: 2012-196 Now therefore be it resolved by the Wabasha County Board of Commissioners that the Wabasha County Highway Engineer be authorized to advertise for bids for S.A.P. 079-598-024. Adopted Unanimously HALL - ROSCHEN Resolution No.: 2012-197 Whereas, Wabasha County has reviewed the pertinent data on bridges requiring replacement, rehabilitation, or removal; and Whereas, Wabasha County has identified those bridges that are high priority and has previously established a list of those bridges that require replacement, rehabilitation, or removal; and Whereas, the following additional bridge has been since identified as also requiring replacement, rehabilitation, or removal. Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the following deficient bridge is a high priority and Wabasha County intends to replace, rehabilitate, or remove this bridge as necessary when funds are available,
Be it further resolved that Wabasha County does hereby request authorization to replace, rehabilitate, or remove such bridge. Adopted Unanimously ROSCHEN – WOBBE Resolution No: 2012-198 Whereas, Wabasha County is required by the FCC to narrow band existing radio systems which includes the Outdoor Warning Siren radio system, and Whereas, Wabasha County will use the Minnesota State purchase contracts as the basis for purchase of said equipment thru Federal Signal Corporation, and Whereas, Wabasha County, using 911 funds (01-290-295) to purchase and utilize, has set aside designated funds of costs incurred for said radio equipment, Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: Wabasha County commits to the purchase of said radio equipment for Outdoor Warning Siren Enhancement and narrow banding for the City of Wabasha, not to exceed the sum of $10,000.00. Adopted Unanimously WOBBE – HALL Resolution No: 2012-199 Whereas, Wabasha County is required by the FCC to narrow band existing radio systems which includes the Outdoor Warning Siren radio system, and Whereas, Wabasha County will use the Minnesota State purchase contracts as the basis for purchase of said equipment thru Federal Signal Corporation, and Whereas, Wabasha County, using 911 funds (01-290-295) to purchase and utilize, has set aside designated funds of costs incurred for said radio equipment, Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: Wabasha County commits to the purchase of said radio equipment for Outdoor Warning Siren Enhancement and narrow banding for the City of Kellogg, not to exceed the sum of $7,000.00. Adopted Unanimously HALL – NORMAN Resolution No: 2012-200 Whereas, Wabasha County is required by the FCC to narrow band existing radio systems which includes the Outdoor Warning Siren radio system, and Whereas, Wabasha County will use the Minnesota State purchase contracts as the basis for purchase of said equipment thru Federal Signal Corporation, and Whereas, Wabasha County, using 911 funds (01-290-295) to purchase and utilize, has set aside designated funds of costs incurred for said radio equipment, Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: Wabasha County commits to the purchase of said radio equipment for Outdoor Warning Siren Enhancement and narrow banding for the City of Plainview, not to exceed the sum of $7,000.00. Adopted Unanimously ROSCHEN – HALL Resolution No: 2012-201 Whereas, Wabasha County is required by the FCC to narrow band existing radio systems which makes existing pagers obsolete, and Whereas, Wabasha County will dispose of obsolete pagers as they have no value, and Whereas, Wabasha County will authorize PSAP/Dispatch Supervisor Blaine John Hentz to dispose of said pagers, Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: Wabasha County hereby declares pagers by unit ID#3971, 3972, 3973, 3974, 3989, 3990, 3991, 3992, 3993, 3994, 3999, 010770, and 010771 as obsolete equipment. Adopted Unanimously ROSCHEN – HALL Resolution No.: 2012-202 Whereas, Wabasha County accepts VHF Interoperable Frequency Use agreement between the State of Minnesota and Wabasha County; and The Chairperson of the Wabasha County Board of Commissioners is hereby authorized to sign VHF Interoperable Frequency Use agreement between the State of Minnesota and Wabasha County; and The County Clerk to the Wabasha County Board of Commissioners is hereby authorized to sign VHF Interoperable Frequency Use agreement between the State of Minnesota and Wabasha County Adopted Unanimously WOBBE - NORMAN Resolution No: 2012-203 Whereas, currently there are 21 part-time employees in the Sheriff's Office; and, Whereas, the Wabasha County Sheriff is requesting authorization to hire 4 more part-time employees to help fill shifts of Deputy and Dispatcher bringing the part-time staff level to 25; and, Whereas, the Wabasha County Sheriff further requests authorization to maintain the part-time staff level at 25 without returning to the County Board each time new staff is hired. Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: The Wabasha County Sheriff's Office is hereby authorized to hire 4 more part-time employees to help fill shifts of Deputy and Dispatcher. Be it Further Resolved by the Wabasha County Board of Commissioners that: The Wabasha County Sheriff is authorized to maintain the part-time staff level at a total of 25 without returning to the County Board each time staff is hired. Adopted Unanimously NORMAN – ROSCHEN Resolution No: 2012-204 Whereas, Wabasha County is appointing an ARMER Equipment Asset Point of Contact, and Whereas, Wabasha County is appointing the ARMER System Administrator Blaine John Hentz, and Whereas, Wabasha County appoints the ARMER System Administrator Blaine John Hentz until employment is terminated, Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: Wabasha County Board of Commissioners appoint ARMER System Administrator Blaine John Hentz as the ARMER Equipment Asset Point of Contact for Wabasha County. Adopted Unanimously HALL - WOBBE Resolution No.: 2012-205 Whereas, the Wabasha County IT Department has a current vacancy in the position of IT Technician, due to a resignation; Whereas, the position of IT Technician is crucial to ensure the proper and efficient function of County operations; Whereas, the IT Director, the County Coordinator, the County Recorder and the Social Services Director have interviewed several candidates and now make this recommendation; Now therefore be it resolved by the Wabasha County Board of Commissioners hereby makes an offer of employment to Larry Howe for the position of IT Technician, said offer contingent on the successful completion of the County's pre-employment checks, and with a 6 month probationary period. Further, the hourly rate, subject to any general cost of living adjustments that the board may from time to time adopt, will be set at step 1 ($22.6698) upon hire, with an increase to step 2 (currently $23.3499) upon successful completion of the probationary period, and an increase to step 3 (currently $24.0504) upon completion of the first full year of employment, and step increases according to policy after that. Abstain: Harms Adopted ROSCHEN – NORMAN Resolution No.: 2012-206 Whereas, the current human services delivery system is not sustainable for the State of Minnesota and its counties; and Whereas, all counties must research opportunities to share resources including sharing of supervision; and Whereas, Winona County has a vacancy in the Income Maintenance Program Manager position; and Whereas, Winona County Community Services and Wabasha County Social Services wish to enter into an agreement in order for Wabasha County to provide supervisory services in Income Maintenance to Winona County; and Whereas, said agreement would be time-limited, with work expenses reimbursed for those services provided, which creates a cost-neutral impact for Wabasha County. Now therefore be it resolved by the Wabasha County Board of Commissioners, to authorize the Social Services Director (Terry Smith) to execute an agreement with Winona County to provide supervisory services to the Income Maintenance staff in Winona County. Said agreement and the conditions therein will be reviewed by the Wabasha County Attorney's Office. Adopted Unanimously ROSCHEN – WOBBE Resolution No.: 2012-207 Whereas, in accordance with Minnesota Statutes 97A.145 Subd. 2, the Commissioner of the Department of Natural Resources on September 25, 2012 provided the Wabasha County SWCD supervisors with a description of lands to be acquired by the State of Minnesota for state land purposes, Whereas, the Wabasha County SWCD supervisors did not find any facts, with regards to drainage and flood control issues, that would deter them from recommending allowing the purchase of this property by Minnesota DNR. They approved the recommendation to allow this purchase by the DNR for the stated purpose, Whereas, in accordance with Minnesota Statutes 97A.145 Subd. 2, the Commissioner of the Department of Natural Resources on October 9, 2012 provided the county board with a description of lands to be acquired by the State of Minnesota for state land purposes, Whereas the lands to be acquired are described as follows: Watopa Township; SESW W1/2SW Section 35 T109N R10W Now, therefore be it resolved by the Wabasha County Board of Commissioners on October 9, 2012 that the State's acquisition of the above described property be approved. Adopted Unanimously ROSCHEN - HALL Resolution No.: 2012-208 Whereas, on November 2, 2011, Wabasha County entered an agreement to sell the Public Health Building to the Southeast Minnesota Multi-County Housing and Redevelopment Authority ("Purchaser") for a total of $85,000. Whereas, pursuant to the Contract for Deed ("Contract") that was entered into called for payments to be made over a period of five years; and Whereas, pursuant to the Contract the Purchaser had the option to prepay on the contract; and Whereas, the purchaser would now like to pay the outstanding balance of $76,000.01 which would constitute full performance of said contract; and Whereas, per the Contract's terms the County is required to deliver a Warrant Deed to the purchaser (see attached); Now, Therefore be it Resolved that the Wabasha County Board authorizes the board chair and board clerk to sign the warranty deed to transfer title of the public health building to the purchaser.
