Meeting of December 11, 2012

 

The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, December 11, 2012 at 9:00 a.m.

 

The meeting was called to order by Board Chairman Harms.

 

The following Commissioners were present: Hall, Wobbe, Harms, Roschen, Norman,

 

ROSCHEN - NORMAN

Motion to approve the agenda.

Harms removed Item F (Authorize Hiring Interim County Administrator), Plante suggested wording change on Item E to state: County Coordinator/Human Resources; Jerviss asked that Item Q (Approve Purchase of Mobile Data Terminals) be moved up on the agenda.

Motion by Wobbe to approve agenda as noted with Item G (Award Labor Negotiations RFP) listed as discussion item instead of action item. Seconded by Hall. Roll Call: Wobbe-aye, Roschen-nay, Harms-nay, Norman-nay, Hall-aye. Motion Failed.

Andru Peters gave a presentation on Reorganizing the Regional Rail Authority.

 

Resolution No.: 2012-233

Whereas, the Board has approved the Union Contracts to include a 1.0% COLA increase effective January 1, 2013; and

Whereas, a 1.0% increase for non-union employees would preserve the pay differentials required to maintain Pay Equity required by State Statutes; and

Whereas, the current Consumer Price Index published by the Bureau of Labor Statistics shows that the inflation rate for 2012 is 2.2% through the end of October, the most current date available.

Now therefore be it resolved by the Wabasha County Board of Commissioners that Non-Union Employees be granted the same 1.0% COLA as Union employees effective January 1, 2013.

WOBBE - HALL

Resolution No.: 2012-234

Whereas, the County has budgeted cost of living increases for elected officials, non-union and union employees; and

Whereas, the County Board of Commissioners did not accept a increase in 2009, 2010, 2011and 2012; and

Whereas, Minnesota State Statute 375.055 requires that County Commissioners salaries and per diems be established by a resolution before January 1 of the year in which they become effective.

Now therefore be it resolved by the Wabasha County Board of Commissioners that the following salaries and per diems are approved for 2013:

$16,124.68 Annual salary (plus $500 for the Board Chair)

$45.00 Authorized per diem payments (under 4 hours)

$90.00 Authorized per diem payments (4 hours and above)

Motion by Wobbe, seconded by Hall to approve commissioners' salaries at $1200 less, and per diems at $45 per day for meetings less than four hours, and $90 per day for meetings exceeding four hours. Roll Call: Wobbe-aye, Roschen-nay, Harms-aye, Norman-aye, Hall-aye. Motion Passed.

Resolution No.: 2012-235

Whereas, Policy Number 408 of the Wabasha County Comprehensive Policies and Procedures Manual states that "Full-time and regular part-time employees with five (5) years of service shall receive a recognition certificate with the individual's name and hire date appropriately noted, and signed by the chair of Wabasha County Board of Commissioners. Recognition Certificates shall also be given to individuals celebrating anniversaries at five (5) year intervals thereafter", and

Whereas, effective January 1, 2012, paper savings bonds could no longer be purchased at financial institutions;

Whereas, effective January 1, 2012 any savings bond being purchased would be need to be purchased electronically;

Whereas, Wabasha County is unable to purchase bonds using the electronic system,

Whereas, effective January 1, 2013, the Employee Recognition Policy will state the following to be earned by employees:

5 years Recognition       Certificate

10 years Recognition     Certificate and $50 chamber bucks *

15 years Recognition     Certificate and $100 chamber bucks *

20 years Recognition     Certificate and $150 chamber bucks *

25 years Recognition     Certificate and $200 chamber bucks *

30 years Recognition     Certificate and $250 chamber bucks *

35 years Recognition     Certificate and $300 chamber bucks *

*this is a onetime pre-tax pay addition to the employee after the anniversary date has occurred. The employee will be able to designate which city they would like to receive chamber bucks.

Now therefore, be it resolved, that the Wabasha County Board of Commissioners approves the amendment to the Employee Recognition Policy. This policy will cover all Wabasha County Employees whether they are union or non union employees.

NORMAN - ROSCHEN

Resolution No: 2012-236

Whereas, the Wabasha County Coordinator and County Board have identified administrative and human resource concerns that would be best managed by a full time Human Resources Coordinator; and

Whereas, Minnesota Statute 375.48 allows a County Board to assign to the Coordinator any title that it deems appropriate; and

Whereas, Minnesota Statute 375.49 allows a County Board to determine the duties and responsibilities of a County Coordinator; and

Whereas, the reorganization and implementation to a Human Resource Coordinator from the County Coordinator position will fill a void in comprehensive and systematic human resource processes in Wabasha County; and

Now therefore be it resolved, the Wabasha County Board of Commissioners hereby updates and modifies the County Coordinator job description, title, and responsibilities to include that of a Human Resources Coordinator with the detailed job description distinguished herein as Exhibit A; and

Be it finally resolved, that Bridget Hoffman, current County Coordinator, is assigned the additional duties of Human Resources Coordinator, with all of the duties and responsibilities that come with the position, effective January 1, 2013 at her current pay grid and step.

Motion by Norman, seconded by Roschen to change title to County Coordinator/Human Resources. Roll Call: Wobbe-nay, Roschen-aye, Harms-aye, Norman-aye, Hall-aye. Motion Passed.

Resolution No.: 2012-237

Whereas, the Wabasha County Coordinator and County Board have identified administrative and human resource concerns that were addressed by updating the County Coordinator job description to that of a Human Resources Coordinator; and

Whereas, the Wabasha County Board anticipates needed support in the administration of Wabasha County as a result of the shift from County Coordinator to that of a Human Resources Coordinator effective January 1, 2013; and

Whereas, suggestions from Springsted have included the employment of an interim county administrator; and

Whereas, the interim county administrator would be for a period of not less than 6 months; and

Now therefore be it resolved, the Wabasha County Board of Commissioners hereby authorizes the hiring of an interim County Administrator with the detailed job description distinguished herein as Exhibit B; and

Be it further resolved, the County Coordinator will work with Springsted to identify and recruit candidates for the interim county administrator position; and

Be it further resolved, the County Coordinator will work with Springsted to determine necessary or appropriate availability [FT vs. PT] of the interim county administrator and whether this position could be a result of collaboration or job share with a neighboring county; and

Be it finally resolved, the County Coordinator will work with Springsted to determine appropriate salary and compensation for the interim county administrator.

Whereas, the Wabasha County Board of Commissioners have conducted a Request for Proposal for Labor Negotiations;

Be it further resolved by the Wabasha County Board of Commissioners that the Wabasha County Board Chair and the County Coordinator are authorized to execute the necessary documents and begin the process of Labor Negotiations for the above party named.

Resolution No.: 2012-240

A Resolution Approving the Re-appointment of Robert Beniak to the Southeastern Minnesota Multi-County Housing and Redevelopment Authority consisting of the Counties of Wabasha, Winona, Goodhue and Dodge.

Be It Resolved, by the County Board of Wabasha County, Minnesota that the recommendation from the Southeastern Minnesota Multi-County Housing and Redevelopment Authority of Robert Beniak to serve as Commissioner of the Southeastern Minnesota Multi-County Housing and Redevelopment Authority for a period of five (5) years, the recommendation of appointment is hereby approved.

Resolution No: 2012-241

Whereas, it is necessary for the Wabasha County Board to approve upgrade of PSAP 911 to meet specifications for PSAP NG911 Phase 1; and

Whereas, it is necessary for the Wabasha County Board to approve required PSAP NG911 Phase 1 upgrade covered by State of Minnesota Grant Contract #3-14917; and

Whereas, funds are not to exceed $10,000 per State of Minnesota Grant Contract #3-14917 for the PSAP NG911 Phase 1 upgrade; to include installation.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: the State of Minnesota Grant Contract #3-14917 for PSAP NG911 Phase 1 upgrade is hereby approved and authorizes it's signing by the County Coordinator and Chairman of the County Board.

Resolution No.: 2012-242

Whereas, Wabasha County has entered into an agreement with the American Federation of State, County and Municipal Employees, Council 65 regarding the conditions of employment with Wabasha County; and

Whereas, Wabasha County has also entered into an agreement to share the Wabasha County Income Maintenance Supervisor duties with Winona County for a period of 3 months, ending January 31, 2013; and

Whereas, a portion of the duties performed by the Wabasha County Supervisor include direct service to individuals and families; and

Whereas, Winona County is agreeable to reimburse Wabasha County for expenses related to sharing this position between the two counties; and

Whereas, the Memorandum of Understanding details the provisions under which an Eligibility Worker may work additional hours and receive compensation for those additional hours of work; and

Whereas, the Director Social Services recommends approval of this Memorandum of Understanding;

Now, therefore be it resolved, the Wabasha County Board of Commissioners adopts the recommended Memorandum of Understanding defining the conditions under which employees may work additional hours as the shared Supervisor position with Winona County continues in place. The Memorandum of Understanding expires on January 31, 2013.

Resolution No.: 2012-243

Whereas, a cost allocation plan is necessary to recover indirect costs expended on behalf of programs of the US Department of Health & Humans Services, and

Whereas, the County has contracted with GMG, Inc to prepare the required cost allocation plan, and

Whereas, plan year 2011 was the final year of the agreement with GMG, Inc for cost plan services.

Now Therefore, be it resolved, that the Wabasha County Board of Commissioners hereby approves extending the agreement for an additional three (3) years at a fixed annual amount of $4,750 for each plan year.

Resolution No.: 2012-244

Whereas, GASB Statement No. 45 states that a actuarial valuation is required at least once every three years, and

Whereas, the County had contracted with Hildi Inc to provide the actuarial services to the County previously, and

Whereas, the next actuarial review is required as of January 2013.

Now Therefore, be it resolved, that the Wabasha County Board of Commissioners hereby approves the attached agreement for consulting services between Hildi Inc and Wabasha County.

Resolution No.: 2012-245

Whereas, the Wabasha County Board of Commissioners per Minnesota Statute 275.07 is required to adopt a final property tax levy for taxes payable year 2013 and certify that amount to the county auditor no later than December 28, 2012; and

Whereas, based upon the final budget the following amounts have been determined to be needed for the 2013 property tax levy.

Now, Therefore, be it resolved by the Wabasha County Board of Commissioners that the County Auditor-Treasurer is to certify the 2013 final property tax levy to the Minnesota Department of Revenue as presented.

Motion by Norman, seconded by Roschen for a 0% levy increase. Roll Call: Wobbe-nay, Roschen-aye, Harms-aye, Norman-aye, Hall-nay. Motion Passed.

Resolution No.: 2012-246

Whereas, The Wabasha County Board of Commissioners approved a Special Benefit Tax agreement dated July 1, 2005 with Southeastern Minnesota Multi-County Housing and Redevelopment Authority for the purpose of paying, in part the debt service on the Authority's Tax Increment Revenue notes, Series 2005; and

Whereas, pursuant to this agreement, the Wabasha County Board of Commissioners does hereby certify the special benefit property tax levy in the amount of $50,000.00 for the Southeastern Minnesota Multi-County Housing Redevelopment Authority, a Special Taxing district.

Now, Therefore, be it Resolved by the Wabasha County Board of Commissioners instructs the County Auditor-Treasurer to certify the above 2013 special benefit property tax levy for Southeastern Minnesota Multi-County Housing Redevelopment Authority to the Minnesota Department of Revenue.

Resolution No.: 2012-247

Whereas, the Southeastern Minnesota Multi-County Housing and Redevelopment Authority was created by action of the Boards of Commissioners of Dodge, Goodhue, Wabasha and Winona Counties pursuant to Minnesota Statutes, Section 469.004; and

Whereas, Minnesota Statute Section 469.033 subs. 6, permits the Authority to levy and collect a special benefits tax not to exceed 0.0185 percent of taxable market value; and

Whereas, the Wabasha County Board of Commissioners has considered the Authority's request to approve a special benefit tax to be levied upon all taxable market value of taxable property within the Authority's area of operation within Wabasha County.

Now, Therefore, be it Resolved by the Wabasha County Board of Commissioners instructs the County Auditor-Treasurer to certify a 2013 final special benefit property tax levy in the amount of $59,494 for Southeastern Minnesota Multi-County Housing Redevelopment to the Minnesota Department of Revenue.

Motion by Norman, seconded by Roschen for a decrease of $50,000 HRA proposed tax levy. Roll Call: Wobbe-nay, Roschen-aye, Harms-nay, Norman-aye, Hall-nay. Motion Failed.

Motion by Wobbe, seconded by Hall to reduce requested amount by 7% for an amount of $59,494. Roll Call: Wobbe-aye, Roschen-nay, Harms-aye, Norman-nay, Hall-aye. Motion Passed.

Whereas, the Wabasha County Board of Commissioners has considered the duties of each and every office, department and agency and the experience, qualifications and performance of employees, elected officials and appointed employees in the development of this budget; and

Whereas, capital expenditures included in the 2013 budget shall be made only after approval of the Board of Commissioners per the County Purchasing Policy.

Now, Therefore, be it Resolved by the Wabasha County Board of Commissioners that the 2013 Wabasha County Final Budget is adopted as presented.

Motion by Roschen, seconded by Norman to approve the budget with the levy change as 0% for 2013. Roll Call: Wobbe-nay, Roschen-aye, Hams-aye, Norman-aye, Hall-nay. Motion Passed.

Resolution No.: 2012-249

Whereas, the Wabasha County Sheriff's Office uses many computer and information systems;

Whereas, a long term goal of the county is to improve public safety and increase efficiency by providing direct access to those systems by installing mobile data terminals in the county's squad cars;

Whereas, a project has been proposed that takes the first steps towards mobile data terminals, and the project will have other benefits to the county, local police departments, and the public;

Whereas, the County IT Director, the County Sheriff and the County PSAP Coordinator all recommend these purchases;

Now therefore be it resolved by the Wabasha County Board of Commissioners that the IT Director is hereby authorized to purchase servers, equipment, software and licensing, and services not to exceed $45,000 to begin this project, to be paid from the capital fund designated for mobile data terminals.
