Meeting of February 4, 2014

 

The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, February 4, 2014 at 9:00 a.m.

 

The meeting was called to order by Board Chairman Springer.

 

The following Commissioners were present:  Springer, Wobbe, Hall, Harms.  Absent:  Roschen

Resolution No.: 2014-044

Whereas, Minn. Stat. §13D.05 subd. 3(b) permits closing a County Board meeting if such closure is permitted by the attorney-client privilege; and

Whereas, the County Board desires to consult with its attorney regarding the pending litigation entitled Association for Government Accountability v Wabasha County; and

Whereas, it is not possible to fully discuss strategy and the options available to the County in a public meeting that may be attended by the plaintiff/party threatening litigation; and

Whereas, without such a meeting the County will have to make decisions without the full benefit of consultation with counsel, and is concerned that in such a situation, it could make poor or uninformed decisions, exposing the County and its taxpayers to liabilities and costs that could be avoided by fully informed decision making available only in a closed session with counsel; and

Whereas, in the closed session, the only subject to be discussed is the pending litigation against the County; and

Whereas, certain phases of the litigation strategy may be impaired if every discussion is available for the benefit of opposing parties; and

Whereas, based upon the foregoing the Board finds there is an absolute need for confidentiality of this matter; and

Now, Therefore, Be It Resolved, a special closed meeting of the County Board addressing the above referenced litigation will be held with the County's counsel. No subject matter other than the foregoing shall be discussed at said meeting.

Resolution No.:  2014-045

Whereas, State Statute Chapter 7082- Local ISTS Programs, has been updated with new rules and regulations for Individual Septic Treatment Systems, and

Whereas, all counties in Minnesota are required to update their Individual Septic Treatment Systems Ordinances to reflect these rules and regulations changes; and

Whereas, a public hearing was held on January 21, 2014 by the Wabasha County Board of Commissioner for the purpose of gaining public input on the proposed Individual Septic Treatment Systems ordinance changes; and

Whereas, there was no additional changes recommended to the board to the proposed ordinance wording;

Now Therefore be it Resolved, by the Wabasha County Board of Commissioners that;

the Individual Septic Treatment Systems ordinance be adopted as presented.

Resolution No.: 2014-046

Whereas, various GIS datasets including, but not limited to, road centerlines, address points, parcels, and municipal boundaries are vital to many county projects;

Whereas, the Users Group Counties wish to share GIS Data for use in general internal county projects including, but not limited to, emergency management, 911 dispatch, land use management, land record management, and transportation management;

Whereas, Goodhue County has offered to host GIS Data from other counties on a secure ftp site, accessible only to GIS staff or authorized staff equivalent from the Users Group Counties, for easy storage, access and distribution of the shared GIS Data.;

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that authorize and enter into the Southeast Minnesota Counties GIS Data Sharing Agreement.

Resolution No.:  2014-047

Whereas, the Wabasha County Board of Commissioners previously approved Wabasha County Highway Right of Way Plat No. 43, designating the definite location of the right of way; and

Whereas, the approved Wabasha County Highway Right of Way Plat No. 43 contained several errors; and

Whereas, a Land Surveyor's Certificate of Plat Correction has been created to correct the errors on the previously approved Plat.

Now therefore be it resolved that the Wabasha County Board of Commissioners hereby approves the Land Surveyor's Certificate of Plat Correction to the plat of Wabasha County Right of Way Plat No. 43.

Resolution No: 2014-048

Whereas, the Wabasha County Sheriff's Office is requesting to purchase one (1) USED vehicle for transports from Paul Busch Auto; and

Whereas, the money for the purchase of these vehicles will come out of Capital Funds per 2014 budget approval.

Whereas, the Sheriff also requests approval for the Auditor's Office to cut an Auditor's Warrant not to exceed the amount of $12,000.00 once the invoice is received.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: the Sheriff is authorized to purchase one (1) USED vehicle from Paul Busch Auto at a cost not to exceed $12,000.00.

Be it Further Resolved by the Wabasha County Board of Commissioners that funding of the purchase for this vehicle will come out of Capital Funds.

Be it further Resolved by the Wabasha County Board of Commissioners that: the Auditor's Office is hereby authorized to cut an Auditor's Warrant not to exceed the amount of $12,000.00 to the respective vendor once the invoice is received.

Resolution No: 2014-049

Whereas, the Wabasha County Sheriff's Office is requesting to purchase three (3) MDT (Mobile Data Terminals) units, related equipment, software, licensing, and services; and

Whereas, the money for the purchase of these units, related equipment, software, licensing, and services will come out of Capital Fund designated for Mobile Data Terminals per 2014 budget approval.

Whereas, the Sheriff also requests approval for the Auditor's Office to cut an Auditor's Warrant not to exceed the amount of $33,000.00 once the invoices are received.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: the Sheriff is authorized to purchase three (3) MDT units (Mobile Data Terminals), related equipment, software and licensing, and services at a cost not to exceed $33,000.00.

Be it Further Resolved by the Wabasha County Board of Commissioners that funding of this purchase will come out of Capital Funds designated for mobile data terminals.

Be it further Resolved by the Wabasha County Board of Commissioners that: the Auditor's Office is hereby authorized to cut an Auditor's Warrant not to exceed the amount of $33,000.00 to the respective vendor once the invoices are received.

Resolution No: 2014-050

Whereas, the following applicant wishes to have their Minnesota Lawful Gambling – Premise Permit Application approved: Plainview Polar Baron Snowmobile Club Inc in Plainview Township, 25118 534th St, Plainview, at Stumble Inn 2, and

Whereas, the application is good for two years,

Now therefore be it Resolved by the Wabasha County Board of Commissioners hereby approves the Minnesota Lawful Gambling – Premise Permit Application for the Plainview Polar Baron Snowmobile Club Inc in Plainview Township, subject to the approval of the State of Minnesota Gambling Control Board.

Resolution No.:  2014-051

Whereas, the Public Health Director and Social Services Director have identified workforce planning needs for their departments; and

Whereas, creating a joint supervisory position that provides oversight of community & home based services from both departments would better coordinate county services and benefit the public; and

Whereas, filling such a position externally would prove to be both challenging and cost prohibitive;

Now Therefore be it Resolved by the Wabasha County Board to authorize the internal recruitment of a Community & Home Based Supervisor to oversee staff from both the Public Health and Social Services departments.  The position will be a temporary appointment not to exceed 2 years.

Resolution No.:  2014-052

Whereas, the Wabasha County Board had previously authorized the Social Services Director to fill the Social Services Supervisor position, and

Whereas, despite the Director's best efforts the Social Services Supervisor position remains vacant and there remains a demonstrated need to fill the position; and

Whereas, having an established hiring range and hours would aid in the recruitment of suitable candidates to fill this vacancy;

Now Therefore be it Resolved by the Wabasha County Board that the Social Services Supervisor position be filled and to set the hiring range at a maximum of step 3, dependent upon qualifications.  The work week for this position shall be set at 40 hours per week.
