The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, May 20, 2014 at 9:00 a.m.

 

The meeting was called to order by Board Chairman Springer.

The following Commissioners were present: Springer, Wobbe, Hall, Harms, Roschen

Resolution No.: 2014-136

Whereas, MN Dept of Health has terminated the Delegation Agreement with Wabasha County to license and inspect Food, Beverage, Lodging, Campgrounds, Mobile Home Parks, Youth Camps, Pools; and

Whereas, Minnesota Department of Health has offered in its place a Conditional Delegation Agreement for a 2 year period: and

Whereas, after careful consideration the Wabasha County Board has decided that the expenses of meeting the requirements in the Conditional Delegation Agreement are too significant for the county to continue providing the program;

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, Wabasha County turn the delegated program of Food, Beverage, Lodging, Campgrounds, Mobile Home Parks, Youth Camps, and pools licensing and inspection back to the Minnesota Health Department, effective May 21, 2014

Resolution No.: 2014-137

Whereas, the Wabasha County Board and the Wabasha Human Services Board have previously approved filling the vacant Child Support Officer position; and

Whereas, the Social Services Director and the Child Support Supervisor have conducted interviews with applicants for this position; and

Whereas, the Social Services Director is recommending the hiring of Amy Vanwey for this position, contingent upon passing Criminal and Background Checks and Drug Screening, and that the salary be set at the initial rate of pay which is grade E, step 1;

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, it hereby accepts and authorizes the appointment of Amy Vanwey as Child Support Officer, contingent upon passing Criminal and Background Checks and Drug Screening, at pay grade E, step 1. The starting date of employment shall be May 28, 2014.

SPRINGER - HALL

Resolution No.: 2014-138

Whereas, the Social Services Department and the Public Health Department are in need of replacement of their multifunction devices; and

Whereas, the Directors of these departments have reviewed specifications and prices for the replacement of these devices and ongoing service maintenance agreements from at least two different competitors; and

Whereas, there are current funds left in the South Country Health Alliance fund to cover the cost of these replacement devices;

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, it hereby accepts and authorizes the Directors of Social Services and Public Health to purchase from Metro Sales, Inc. the Richo MP 5002 for each office at a price of $7092 each and to sign maintenance agreements for each device at a cost of $81 a month for 9,000 copies per machine and excess copies at $.009 a copy. The purchase price of the multifunction devices will be taken out of the South Country Health Alliance fund. The old multifunction device in Social Services, property tag #2611, will be disposed of by Metro Sales, Inc. The old multifunction device in Public Health, property tag #010488, will either be disposed of by Metro Sales, Inc. or transferred for use by another Department.

Resolution No.: 2014-139

Now Therefore Be It Resolved by the Wabasha County Board of Commissioners that,

Wabasha County enter into the attached Cooperative Agreement between Elgin Township and Wabasha County for the replacement of a Bridge and authorizes the Chairman of the Board and County Administrator to execute the Agreement.

ROSCHEN - HARMS

Resolution No.: 2014-140

Whereas, Wabasha County has a solid waste program that promotes recycling by way of providing collection sites throughout the County; and

Whereas, Collection sites utilize small sheds to house residential recycling materials until a contractor collects those materials; and

Whereas, One shed in Plainview received extensive damage and another shed in Wabasha is beyond repair, and

Whereas, Wabasha County has a surplus of recycling sheds at the Wabasha Highway Shop.

Now Therefore Be It Resolved, the Wabasha County Board of Commissioners approves of the disposal of the shed in Plainview that received extensive damage and the second shed in Wabasha that is beyond repair by way of demolition and being transferred to the La Crosse County Landfill.

Resolution No.: 2014-141

Whereas, Minnesota Statute 375.055 allows for County Commissioners to participate in County offered group insurance programs that are available to county officers and employees; and

Whereas, Wabasha County currently offers its officers and employees many different health and dental insurance options; and

Whereas, it is common practice across the State that Counties offer County Commissioners health and dental insurance;

Whereas, on January 8, 2013, the Wabasha County Board of Commissioners made Health and Dental Insurance coverage optional to County Commissioners.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that effective immediately Wabasha County shall (continue to provide optional Health and Dental Insurance coverage to County Commissioners) or shall (eliminate Health and Dental Insurance coverage to County Commissioners).

Motion to go into closed session.

Resolution No.: 2014-142

Whereas, Minn. Stat. §13D.05 subd. 3(b) permits closing a County Board meeting if such closure is permitted by the attorney-client privilege;

Whereas, the County Board desires to consult with its attorney regarding the correspondence and requests from the Board of Water and Soil Resources; and

Whereas, it is not possible to fully discuss strategy and the options available to the County in a public meeting; and

Whereas, without such a meeting the County will have to make decisions without the full benefit of consultation with counsel, and is concerned that in such a situation, it could make poor or uninformed decisions, exposing the County and its taxpayers to liabilities and costs that could be avoided by fully informed decision making available only in a closed session with counsel; and

Whereas, in the closed session, the only subject to be discussed is the pending BWSR requests; and

Whereas, certain phases of the litigation strategy may be impaired if every discussion is available for the benefit of opposing parties;

Whereas, based upon the foregoing the Board finds there is an absolute need for confidentiality of this matter.

Now, Therefore, Be It Resolved a closed meeting of the County Board addressing the above referenced concerns will be held with the County's counsel. No subject matter other than the foregoing shall be discussed at said meeting.
