Meeting of June 24, 2014

 

The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, June 24, 2014 at 9:00 a.m.

 

The meeting was called to order by Board Chairman Springer.

The following Commissioners were present: Springer, Wobbe, Hall, Harms, Roschen

 

SPRINGER - WOBBE

Motion to approve the agenda.

Adopted Unanimously

 

Administrator Update: Consensus was given to the interim administrator to sign Wetland Conservation Act timeline extension request.

Public Forum Comments: various concerns related to county practices.

 

SPRINGER - HALL

Motion to approve the consent agenda after amending the Minutes to include "Jim Roschen -- disapproval of social media" comments made during the Public Forum.

Resolution No.: 2014-166

Whereas, the Wabasha County Auditor/Treasurer's Office has a current vacancy in the position of Deputy Auditor/Treasurer, due to the incumbent (Debbie Eggenberger) giving two week notice;

Whereas, Ms Eggenberger has been an employee in the Wabasha County Auditor/Treasurer Office since October 29, 2012, and is in good standings with the Department;

Whereas, this position is part time 25 hours a week and receives no benefits. There are times during peak tax collection that the position will work fulltime still will no benefits.

Whereas, the Auditor/Treasurer recommends this vacancy be filled;

Now therefore be it resolved by the Wabasha County Board of Commissioners hereby accepts the resignation of Debbie Eggenberger with reluctance and thanks for her services to Wabasha County, effective June 27, 2014. Further, the Auditor/Treasurer is authorized to fill the Deputy Auditor/Treasurer vacancy to maintain normal operations of the Auditor/Treasurer's Department.

HALL - SPRINGER

Resolution No.: 2014-167

Whereas, the 2013 State of Minnesota Legislative Session approved legislation authorizing all counties to levy a wheelage tax under Minnesota Statute 163.051, and

Whereas, counties that enact the tax and request the State Registrar of Motor Vehicles collect the tax beginning January 1, 2015 must notify the State Registrar of Motor Vehicles of the levied tax by August 1, 2014.

Now Therefore Be It Resolved that the Wabasha County Board of Commissioners hereby authorizes and levies a wheelage tax as provided in Minnesota Statutes 163.051 in an amount of $10 per year on each motor vehicle as applicable under State Statute and effective starting in a registration period on January 1, 2014.

Be it Further Resolved that the Wabasha County Board of Commissioners hereby requests that the wheelage tax be collected by the State Registrar of Motor Vehicles, as provided for in Minnesota Statutes 163.051.

Be it Further Resolved that the Wabasha County Board of Commissioners hereby authorizes the Wabasha County Auditor/Treasurer to certify the levied wheelage tax to the State Registrar of Motor Vehicles before August 1, 2014 and that the tax be effective January 1, 2015.

Resolution No. 2014-168

Whereas, the Springsted Report and the County Administrator have identified the need for additional human resources programs and services in the County; and

Whereas, the County Administrator believes that the expanding the position's job duties and responsibilities will better help coordinate county services and benefit the public; and

Now Therefore Be It Resolved by the Wabasha County Board of Commissioners that position of Human Resources Generalist is created and the attached job description (Exhibit A) be adopted and that the position be placed on Pay Grade 5 of the County's Exempt/Non-exempt Position Pay Scale.

Resolution No. 2014-169

Whereas, the Springsted Report and the County Administrator have identified the need for additional human resources programs and services in the County; and

Whereas, the Wabasha Board of Commissioners have adopted the job description of the Human Resources Generalist; and

Whereas, the current Payroll/Human Resources Specialist has provided notice of their intention to retire; and

Whereas; filling the position of Human Resources Generalist at this time results in a minimal fiscal impact, and potential costs savings, to the County; and

Now Therefore Be It Resolved by the Wabasha County Board of Commissioners to authorize the recruitment of a Human Resources Generalist.

Be it Further Resolved that when the position of Payroll/Human Resources Specialist becomes vacant that the position be abolished.

Resolution No.: 2014-124

Whereas, the County has approved a personnel policies and procedures manual that is a living document; and

Whereas, periodically it is necessary to establish new policies and procedures for effective personnel administration; and

Whereas, the personnel policy and procedures committee has determined a need for new policy to be added to the manual; and

Whereas, the personnel policy and procedures committee recommends adoption of the attached Layoff Policy.

Now there be it resolved by the Wabasha County Board of Commissioners that the Layoff Policy, as presented, is hereby approved.

HARMS - HALL

Motion to go into closed session.

Resolution No. 2014-170

Whereas, Minn. Stat. §13D.05 subd. 3(b) permits closing a County Board meeting if such closure is permitted by the attorney-client privilege;

Whereas, the County Board desires to consult with its attorney regarding the correspondence and requests from the Board of Water and Soil Resources; and

Whereas, it is not possible to fully discuss strategy and the options available to the County in a public meeting; and

Whereas, without such a meeting the County will have to make decisions without the full benefit of consultation with counsel, and is concerned that in such a situation, it could make poor or uninformed decisions, exposing the County and its taxpayers to liabilities and costs that could be avoided by fully informed decision making available only in a closed session with counsel; and

Whereas, in the closed session, the only subject to be discussed is the pending BWSR requests; and

Whereas, certain phases of the litigation strategy may be impaired if every discussion is available for the benefit of opposing parties;

Whereas, based upon the foregoing the Board finds there is an absolute need for confidentiality of this matter.

Now, Therefore, Be It Resolved a closed meeting of the County Board addressing the above referenced concerns will be held with the County's counsel. No subject matter other than the foregoing shall be discussed at said meeting.
