Meeting of October 7, 2014

 

The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, October 7, 2014 at 9:00 a.m.

 

The meeting was called to order by Board Chairman Springer.

The following Commissioners were present: Springer, Wobbe, Hall, Harms. Absent: Roschen

Resolution No.: 2014-217

Whereas, the Wabasha County Board of Commissioners hereby makes the following findings of facts:

1. The required petition was received by the Auditor/Treasurer from legal voters of residence requesting naming of the unnamed creek located in Sections 28 & 33, Township 110 and Range 11 in Glasgow Township; Wabasha County. Such petition was filed with the Wabasha County Auditor/Treasurer on the 8th day of August 2014. This petition met the statutory requirements of Minnesota Statute 83A.05, sub 2.

2. The Auditor/Treasurer's office requested and the county board ordered a time and location for the hearing on the petition which was held more than 30 days after the order was made.

3. The notice of the public hearing was published for three weeks in the Lake City Graphic, Wabasha County Herald and Plainview News during the following weeks: September 8, 2014, September 15, 2014 and September 22, 2014. Service of the notice of hearing was made to the Commissioner for the Department of Natural Resources by certified mail. Personal service by Sheriff's Department was made to Glasgow Town Board Chair.

4. A public hearing was held at 9:15 a.m. on October 7, 2014, at the Wabasha County Courthouse after proper notice to Glasgow Township, property owners along stream and the Department of Natural Resources; and

5. The Minnesota Department of Natural Resources Director reviewed the request for naming and responded that the name "Zell Creek" does not duplicate the name of any existing creeks in the State of Minnesota.

6. The Wabasha County Board of Commissioners heard from all interested persons on the naming of the creek.

Resolution No.: 2014-218

Whereas, the calendar year 2013 Flexible Spending Plan has a positive balance in the amount of $181.04; and

Whereas, the General Revenue fund absorbs all overages, shortages and administrative costs for the Flexible Spending Plans,

Therefore, be it resolved, that the Wabasha County Board of Commissioners hereby approves the overage to be credited to the General Revenue Fund for the calendar year 2013 Flexible Spending Plan.

Resolution No.: 2014-219

Whereas, Article 14, Section 5 of the Wabasha County Zoning Ordinance allows by way of a Conditional Use Permit the placement of accessory structures below the Regional Flood Elevation in floodfringe areas provided such structures are flood-proofed; and

Whereas, Larry Diedrich has applied for a Conditional Use Permit to allow for an accessory structure to be placed below the Regional Flood Elevation on his property described as parcel R07.00223.00 located in section 23, Township 109 North, Range 13 West (33269 County Road 11, Millville) which is located in a floodfringe; and

Whereas, Mr. Diedrich has submitted specifications from SJS Engineering of Rochester for the construction methods necessary for his garage to be considered flood-proofed as per the Minnesota State Building Code; and

Whereas, The Wabasha County Planning Commission conducted a public hearing on Mr. Diedrich's request for a Conditional Use Permit and after consideration of all the information presented decided to forward the matter to the County Board with a recommendation that the Conditional Use Permit be approved with three conditions.

Now Therefore Be It Resolved, the Wabasha County Board of Commissioners approves a Conditional Use Permit for parcel 07.00223.00 to allow for the construction of a garage located below the Regional Flood Elevation in a floodfringe area with the conditions as follows:

1. The garage must be flood-proofed as per the Minnesota State Building Code.

2. Any hazardous materials stored in the garage must be located above the Regional Flood Elevation.

3. All utilities that service the garage must enter the building above the Regional Flood Elevation.

Resolution No.: 2014-220

Now Therefore Be It Resolved by the Wabasha County Board of Commissioners that Wabasha County enter into Mn/DOT Agreement No. 06811 with the State of Minnesota, Department of Transportation for the following purposes:

To provide for payment by the State to the County for the use and maintenance of County State Aid Highway No. 1 and 7 as a detour route during the contract construction to be performed upon, along and adjacent to Trunk Highway No. 60 from County State Aid Highway No. 1 to County State Aid Highway No. 7 under State Project No. 7902-23 (T.H. 60=073).

It is further resolved by the Wabasha County Board of Commissioners that the Wabasha County Engineer is authorized to execute the Agreement and any amendments to the Agreement.

SPRINGER - WOBBE

Resolution No.: 2014-221

Whereas, the Wabasha County Social Services Director has accepted the retirement of Ann Bright effective October 3, 2014; and

Whereas, Ms. Bright has been employed by Wabasha County as an Eligibility Worker in a permanent position; and

Whereas, the Social Services Director recommends retaining this permanent position in order to maintain normal operations of the department; and

Whereas, Christopher Binner is currently employed as an Eligibility Worker in a temporary position and has performed his job duties satisfactorily;

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the retirement of Ann Bright is accepted, with reluctance and best wishes in future endeavors, and the Director of Social Services is hereby authorized to appoint Christopher Binner as an Eligibility Worker in a permanent position in order to maintain normal operations of the Social Services Department.

SPRINGER - HARMS

Resolution No.: 2014-222

Whereas, due to recent staffing changes Wabasha County Social Services has a vacancy for a temporary Eligibility Worker; and

Whereas, due to instability with the MNsure system there is a continued need to fill this vacancy in order to maintain normal operations of the department; and

Whereas, the Social Services Director recommends filling this vacancy as a temporary position not to exceed 24 months;

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the Director of Social Services is hereby authorized to fill the Eligibility Worker vacancy as a temporary position not to exceed 24 months in order to maintain normal operations of the Social Services Department.

Motion to close regular meeting and open Performance Evaluation closed session.

Resolution No.: 2014-223

Whereas, Minn. Stat. §13D.05 subd. 3(a) permits closing a County Board meeting to evaluate the performance of an individual who is subject to its authority; and

Whereas, the County Board desires to conduct a performance evaluation of Interim County Administrator Michael Plante pursuant to his employment contract with the county; and

Whereas, the Board shall conduct its performance evaluation during the closed session and will summarize the results of that evaluation at its next public board meeting; and

Whereas, the referenced summary conclusion will be drafted by the Wabasha County Attorney's Office based on the recommendation and information received during the performance evaluation; and

Now, Therefore, Be It Resolved a closed meeting of the County Board will be held to conduct a performance evaluation of Interim County Administrator Michael Plante pursuant to the above referenced terms.

WOBBE - SPRINGER

Resolution No.: 2014-224

Whereas, County Attorney James Nordstrom is retiring at the end of his present term of office, on January 2, 2015; and

Whereas, the County Attorney's Office needs to hire an assistant county attorney to keep the legal staff at three attorneys; and

Whereas, it is the intent that the new hire would start no sooner than January 5, 2015.

Now Therefore Be It Resolved by the Wabasha County Board of Commissioners that the County Attorney's Office is authorized to advertise and interview applicants for the position of Assistant County Attorney.
