WABASHA COUNTY BOARD OF ADJUSTMENT MEETING - JULY 12, 2016


Minutes

1.The meeting was called to order at 7:00 p.m. by Vice-Chair Jon Beckman. Other members present were Ken Jacob, Mike Wallerich, Jon Beckman, and Gayle Gillespie.

2. Motion by Jacob/Gillespie to approve the agenda as presented. Motion carried.

3. Motion by Wallerich/Jacob to approve the minutes of the June 14, 2016 meeting. Motion carried.

4. Robert Walkes arrived at 7:03 and chaired the rest of the meeting.

5. Public Hearing:

• Application submitted by James Bartholome requesting a variance from Section 5, Subdivision 512 of the Wabasha County Feedlot Ordinance to allow for the construction of a new manure pit located less than 2,640’ from an incorporated municipality. The property on which the request is being made is described as parcel R01.00047.00 located in Section 5, Township 110 North, Range 14 West, Town of Chester (25432 County 16 Blvd., Goodhue, MN).

6. Motion by Gillespie/Beckman to close the public hearing and to move to the findings. Motion carried.

7. Motion by Gillespie/Beckman to approve the Batholome variance request as presented. Motion carried.

8. Public Hearing:

• Application submitted by Hyde Park Holsteins, LLP requesting a variance from Section 5, Subdivision 512 of the Wabasha County Feedlot Ordinance to allow for the construction of two new barns that are located less than 300’ from a public road, less than 1000’ to an existing dwelling on an adjacent property, and less than 300’ to a wetland. The property on which the request is being made is described as parcel R07.00019.00 located in Section 4, Township 109 North, Range 13 West, Town of Hyde Park (35129 Hwy. 60, Zumbro Falls, MN).

9. Motion by Beckman/Jacob to close the public hearing and to move to the findings. Motion carried.

10. Motion by Jacob/Gillespie to approve the Hyde Park Holsteins variance request as presented. Motion carried.

11. Public Hearing:

• Application submitted by Tim and Shari Bartlett requesting a variance from Chapter 394.36, Subd. 4 Minn. Stats. to allow for the expansion of a nonconforming structure. The property on which the request is being made is described as parcel R13.00234.00 located in Section 24, Township 111 North, Range 11 West, Town of Pepin (70563 206th Ave., Reads Landing, MN).

12. Motion by Beckman/Jacob to close the public hearing and to move to the findings. Motion carried.

13. Motion by Jacob/Beckman to approve the Bartlett variance request as presented. Motion carried

14. Public Hearing:

• Application submitted by Alex Hagedorn requesting an after-the-fact variance from Chapter 11.02(7) of the Wabasha County Zoning Ordinance to allow for the placement of a driveway on a slope greater than 30%. The property on which the request is being made is described as parcel R16.00220.03 located in Section 28, Township 110 North, Range 12 West, Town of West Albany (29865 640th St., Millville, MN).

15. Motion by Beckman/Gillespie to extend the public hearing to the August or September meeting and to extend the 60-day review period for another 60-days. Motion carried.

16. Public Hearing:

• Application submitted by Dan Miller on behalf of Phifer Nicholson requesting a variance from Article 13, Section 9, Subd. 5 of the Wabasha County Zoning Ordinance to allow for the impervious surfaces of a lot to exceed the allowable 25%. The property on which the request is being made is described as parcel R05.00741.00 located in Section 2, Township 110 North, Range 10 West, Town of Greenfield (67978 Cnty. Rd. 76, Wabasha MN).

17. Motion by Beckman/Wallerich to close the public hearing and to move to the findings. Motion carried.

18. Motion by Wallerich/Jacob to approve the Nicholson variance request as presented with two conditions. Motion carried. The two conditions are as follows:

1. The stormwater run-off from any impervious surface (gravel driveways and paths are considered impervious) that is in excess of the 25% limit shall be directed to a rain garden or subsurface drainage system. The stormwater system shall be designed by a Minnesota licensed engineer or accredited landscape architect and shall accommodate the stormwater for the 24 hour-2 year return cycle storm event.

2. A shoreland buffer of native perennial vegetation shall be established in the shore impact zone on the property (37.5’ landward and running parallel to the shoreline) except for the areas that currently have pavers which are utilized as part of the stairs and patio. The restoration plan shall be designed by an accredited landscape architect and shall include a timeline for installation prior to a building permit being issued. A document shall be recorded on the parcel for the buffer to remain as required by this decision.

19. Other business: the next meeting will be held on August 16th.

20. Motion by Gillespie/Jacob to adjourn at 8:16 p.m. Motion carried.
