WABASHA COUNTY BOARD OF ADJUSTMENT MEETING - July 11, 2017


Minutes


1. Chair Robert Walkes called the meeting to order at 7:00 p.m. Other members present were Gayle Gillespie, Mike Wallerich, Jon Beckman, and Ken Jacob.

2. Motion by Jacob/Wallerich to approve the agenda as presented. Motion carried.

3. Motion by Gillespie/Jacob to approve the minutes of the June 13, 2017 meeting. Motion carried.

4. Motion by Gillespie/Jacob to open the public hearing for the application submitted by Mike and Joe Durigan requesting an after-the-fact variance from Chapter 13.09(6) and Article 14, Section 4 of the Wabasha County Zoning Ordinance to allow for the construction of a retaining wall in a shoreland impact zone and floodway using manufactured stone. The subject property is described as parcel R17.00355.00 located in Section 34, Township 109 North, Range 14 West, Town of Zumbro. Motion carried.

5. Motion by Beckman/Gillespie to close the public hearing and to consider each of Mr. Durigan’s requests separately. Motion carried.

6. Motion by Jacob/Gillespie to deny the variance request from Article 14, Section 4 of the Wabasha County Zoning Ordinance. Motion carried. The findings determined to deny the request are as follows:

• The request is not in harmony with the general purpose and intent of the County’s Zoning Ordinance and Comprehensive Plan.

• The plight of the landowner is created by the landowner and not due to circumstances unique to the property.

7. Motion by Beckman/Wallerich to move to the findings for the request submitted by Mr. Durigan for a variance from Chapter 13.09(6). Motion carried.

8. Motion by Wallerich/Beckman to grant a variance from Chapter 13.09(6) of the Wabasha County Zoning Ordinance to Mr. Durigan with three conditions. Motion carried. The conditions of approval are as follows:

• A shoreland buffer of native vegetation shall be established along the shoreline on the property to an average depth of 25’ (measured landward and running parallel to the normal pool level) except for an area approximately 5’ wide along the southern property line (measured parallel to the normal pool level) which can serve as an access corridor to the lake. A restoration plan for the shoreland buffer consisting of native vegeation shall be designed by an accredited landscape architect and shall include a timeline for installation prior to any land use permits being issued for the property. A document shall be recorded on the parcel for the buffer to remain as required by this decision.

• The project shall fully comply with the floodplain provisions of the Wabasha County Zoning Ordinance before any land use permit is issued for the project.

• The landowner shall abide by all representations and commitments presented in the application or presented to the Board of Adjustment.

9. Motion by Gillespie/Beckman to open the public hearing for the application submitted by Thomas Ostrom requesting a variance from Chapter 7.06(1) and Chapter 7.06(2) of the Wabasha County Zoning Ordinance to allow for the construction of a garage 3’ from the road right-of-way and 3’ from a property line. The subject property is described as parcel R05.00487.12 located in Section 19, Township 110 North, Range 9 West, Town of Greenfield. Motion carried.

10. Motion by Gillespie/Beckman to close the public hearing for the application submitted by Mr. Ostrom and to move to the findings. Motion carried.

11. Motion by Beckman/Wallerich to grant a variance from Chapter 7.06(1) and Chapter 7.06(2) of the Wabasha County Zoning Ordinance to Mr. Ostrom with three conditions. Motion carried. The three conditions are as follows:

• A boundary survey of the respective parcel shall be completed before issuance of any land use/building permit to ensure the garage does not encroach any closer to the right-of-way line or property line as approved.

• The landowner shall abide by all representations and commitments presented in the application or presented to the Board of Adjustment.

• The impervious surfaces for the parcel shall not exceed the 25% allowable limit.

12.Discussion about training and outline for meetings.

Motion by Jacob/Gillespie to adjourn at 9:30 p.m. Motion carried.
