WABASHA COUNTY BOARD OF ADJUSTMENT MEETING - November 14, 2017


Minutes


1. Chairman Bob Walkes called the meeting to order at 7:02 p.m. Other members present were Gayle Gillespie, Mike Wallerich, and Ken Jacob.

2. Motion by Jacob/Gillespie to approve the agenda as presented. Motion carried.

3. Motion by Wallerich/Jacob to approve the minutes of the October 10 , 2017 meeting. Motion carried.

4. Motion by Gillespie/Jacob to open the public hearing for the application submitted by Kevin Fuerstneau requesting a variance from Chapter 394.36, Subd. 4 Minn. Stats. to allow for the expansion of a nonconforming dwelling that is located 10’ from a property line. The subject property is described as parcel R05.00993.00 located in Section 11, Township 110 North, Range 10 West, Town of Greenfield. Motion carried.

5. Motion by Gillespie/Jacob to close the public hearing. Motion carried.

6. Motion by Jacob/Gillespie to approve the request as presented with two conditions. Motion carried. The two conditions are as follows:

• The landowner shall abide by all representations and commitments presented in the application.

• The impervious surfaces for the parcel shall not exceed the 25% allowable limit.

7. Motion by Gillespie/Wallerich to open the public hearing for the application submitted by Craig Johnson requesting a variance from Chapter 13.07(2) and Chapter 13.10(4)(d) of the Wabasha County Zoning Ordinance to allow for the construction of a new home 68’ from Lake Zumbro and to have more than 25% impervious surfaces on the property. The subject property is described as parcel R17.00321.00 located in Section 34, Township 109 North, Range 14 West, Town of Zumbro. Motion carried.

8. Motion by Gillespie/Jacob to close the public hearing. Motion carried.

9. Motion by Jacob/Wallerich to approve the request as presented with four conditions. Motion carried. The four conditions are as follows:

• The landowner shall abide by all representations and commitments presented in the application or during the public hearing.

• A shoreland buffer of native vegetation shall be established along the shoreline on the property to an average depth of twenty-five feet (measured landward and running parallel to the normal pool level) except for an area approximately 15’ wide (measured parallel to the normal pool level) which can serve as an access corridor to the lake. A vegetation planting and maintenance plan, designed by a professional native landscape designer, shall be approved by the Wabasha County Zoning Administrator prior to any land use permits being issued for the property. The planting plan shall include a specific time when the plants or seed will be planted. The buffer of native vegetation shall remain in perpetuity as long as the dwelling is located less than 100’ from Lake Zumbro.

• Any retaining wall located in the buffer area shall consist of stacked natural limestone to provide a more natural characteristic to the buffer area.

• The stormwater run-off from any impervious surface that is in excess of the 25% limit shall be directed to a rain garden or subsurface drainage system. The stormwater system shall be designed by a Minnesota licensed engineer and shall accommodate the stormwater for the 24 hour-2 year return cycle storm event. The maximum allowable limit of impervious surfaces shall be 30% for the property.

Motion by Jacob/Gillespie to adjourn at 7:53 p.m. Motion carried.
