WABASHA COUNTY BOARD OF ADJUSTMENT MEETING - NOVEMBER 10, 2015


Minutes

1. The meeting was called to order by Chairman Robert Walkes.  Other members present were Gayle Gillespie, Ken Jacob, and Mike Wallerich.

2. Motion by Wallerich/Gillespie to approve the agenda as presented.  Motion carried.

3. Motion by Gillespie /Jacob to approve the minutes of the October 13, 2015 meeting.  Motion carried.

4. Public Hearing:

¬∑Application submitted subsistence by Judd Lindeen requesting variances from Article 4, Section 3, Subd. 1 & 3 of the Wabasha County Zoning Ordinance; Article 12, Section 5, Subd. 4 of the Wabasha County Zoning Ordinance; Article 13, Section 8, Subd. 4 of the Wabasha County Zoning Ordinance; Article 13, Section 9, Subd. 5 of the Wabasha County Zoning Ordinance; and Chapter 394.36, Subd. 4 Minn. Stats to allow for the expansion of a nonconforming dwelling that will increase the impervious surface of the parcel to be 47%, be located in a bluff impact zone, be less than 15' to a side property line, and be less than 100' to the ordinary highwater mark of Lake Zumbro.  The property where the variance is being requested is described as parcel R17.00299.06 located in Sec. 34, T. 109 N., R. 14 W., Town of Zumbro (40280 Ryan's Bay Road, Zumbro Falls).

5. Motion by Wallerich/Jacob to close the public hearing on the request and to move to the findings.  Motion carried.

6. Motion by Gillespie/Jacob to deny the request submitted by Judd Lindeen on the basis that the new structure will not adhere to the sideyard setback; will substantially increase the impervious surface of the parcel; the new structure cannot meet the water setback; and the new structure will be an expansion of a nonconforming structure which is prohibited by state statue.  Motion carried.

7. Public Hearing:

¬∑Application submitted by Larry and Marilyn Kappers requesting a variance from Article 12, Section 5, Subd. 3 & 4 of the Wabasha County Zoning Ordinance to allow for the construction of a dwelling located less than 15' to a property line.  The property where the variance is being requested is described as parcel 09.00430.00 located in Sec. 34, T. 109 N., R. 14 W., Town of Mazeppa (56814 402nd Ave., Mazeppa).

8. Motion by Gillespie/Jacob to close the public hearing and to move to the findings.  Motion carried.

9. Motion by Jacob/Wallerich to approve the Kappers variance request as presented.  Motion carried.

10. Public Hearing:

¬∑Application submitted by Richard Morris requesting a variance from Article 12, Section 5, Subd. 3 of the Wabasha County Zoning Ordinance to allow for the construction of a shed to be 50' from the center of a public road.  The property where the variance is being requested is described as parcel R17.00410.03 located in Sec. 34, T. 109 N., R. 14 W., Town of Zumbro (56451 400th Ave., Zumbro Falls).

11. Motion by Gillespie/Jacob to close the public hearing and to move to the findings.  Motion carried.

12. Motion by Gillespie/Wallerich to approve the Morris variance request as presented.  Motion carried.

13. No additional business discussed.

14. Motion by Wallerich/Jacob to adjourn at 8:47 p.m.  Motion carried.
