WABASHA COUNTY BOARD OF ADJUSTMENT MEETING - June 12, 2018


Minutes

1. Bob Walkes called the meeting to order at 7:00 p.m. Other members present were Gayle Gillespie, Jon Beckman, Ken Jacob, and Mike Wallerich.

2. Motion by Beckman/Gillespie to approve the agenda as presented. Motion carried. 

3. Motion by Wallerich/Jacob to approve the minutes of the June 12, 2018 meeting. Motion carried.

4. Motion by Gillespie/Beckman to open the public hearing for the application submitted by Wayne Peters requesting a variance from Section 5, Subdivision 512 of the Wabasha County Feedlot Ordinance to allow for the construction of a heifer barn less than 200 feet from a property line. The subject property is described as parcel R11.00079.06 located in Section 9, Township 111 North, Range 13 West, Town of Mount Pleasant. Motion carried.

5. Motion by Gillespie/Beckman to close the public hearing. Motion carried.

6. Motion by Beckman/Jacob to approve the Peters request as presented with one condition. Motion carried. The one condition is as follows:

•The landowner shall abide by all representations and commitments presented in the application.

7.Motion by Gillespie/Jacob to open the public hearing for the application submitted by Wayne Evers requesting a variance from Section 5, Subdivision 512 of the Wabasha County Feedlot Ordinance to allow for the construction of a free-stall barn less than 200 feet from a property line. The subject property is described as parcel R06.00096.00 located in Section 10, Township 109 North, Range 11 West, Town of Highland. Motion carried.

8.Motion by Gillespie/Jacob to close the public hearing. Motion carried.

9.Motion by Beckman/Wallerich to approve the Evers request as presented with one condition. Motion carried. The one condition is as follows:

• The landowner shall abide by all representations and commitments presented in the application.

10. Motion by Jacob/Beckman to open the public hearing for the application submitted by Mike and Lisa Viker requesting a variance from Chapter 7.06(2) and Chapter 13.10(4)(d) of the Wabasha County Zoning Ordinance to allow for the construction of a new home to be less than 15’ from a property line and to have more than 25% of the property consist of an impervious surface. The subject property is described as parcel 05.00470.00 located in Section 18, Township 110 North, Range 9 West, Town of Greenfield. Motion carried.

11. Motion by Gillespie/Jacob to close the public hearing. Motion carried.

12. Motion by Beckman/Jacob to approve the Viker request as presented with three conditions. Motion carried. The three conditions are as follows:

• A shoreland buffer of native vegetation shall be maintained along the shoreline on the property to an average depth of 25 feet (measured landward and running parallel to the normal pool level) except for the existing stairway which can serve as an access corridor to the lake. Any retaining wall located in the buffer area in the future shall only consist of stacked natural limestone to provide a more natural characteristic to the buffer area.

• The stormwater run-off from any impervious surface that is in excess of the 25% limit shall be directed to a rain garden or subsurface drainage system. The stormwater system shall be designed by a Minnesota licensed engineer and shall accommodate the stormwater for the 24 hour-2 year return cycle storm event. The stormwater system shall be installed within one year from when the building/land use permit was issued for the dwelling.

• The landowner shall abide by all representations and commitments presented in the application or presented to the Board of Adjustment.

13. Motion by Wallerich/Jacob to adjourn at 8:02 p.m. Motion carried.
