WABASHA COUNTY BOARD OF ADJUSTMENT MEETING - September 11, 2018


Minutes

1. Bob Walkes called the meeting to order at 7:00 p.m. Other members present were Gayle Gillespie, Jon Beckman, Ken Jacob, and Mike Wallerich.

2. Motion by Gillespie/Jacob to approve the agenda as presented. Motion carried.

3. Motion by Wallerich/Beckman to approve the minutes of the August 21, 2018 meeting. Motion carried.

4. Motion by Jacob/Beckman to open the public hearing for the application submitted by Beth Ballinger requesting a variance from Chapter 394.36, Subd. 4 Minn. Stats. to allow for the expansion of a nonconforming dwelling. The subject property is described as parcel R05.00573.00 located in Section 1, Township 110 North, Range 10 West, Town of Greenfield. Motion carried.

5. Motion by Gillespie/Jacob to close the public hearing. Motion carried.

6. Motion by Beckman/Gillepsie to table the request until the October meeting when someone is available to represent the applicant. Motion carried.

7. Motion by Gillespie/Jacob to open the public hearing for the application submitted by International Ingredient requesting a use variance from Chapter 394.36, Subd. 1 Minn. Stats. and Chapter 7.03 of the Wabasha County Zoning Ordinance to allow for the expansion of a nonconforming use. The subject property is described as parcel R03.00040.00 and parcel R03.00042.00 located in Section 5, Township 110 North, Range 13 West, Town of Gillford. Motion carried.

8. Motion by Beckman/Gillepsie to close the public hearing. Motion carried.

9. Motion by Wallerich/Jacob to approve the International Ingredient request as presented with three conditions. Motion carried. The three conditions are as follows:

• The use variance being granted does not change the zoning district of the property nor does it classify the business as a conforming use. The use variance simply provides a variance to allow the applicant to expand the existing business by way of the plan submitted. Any future change of use or expansion of the business would require another use variance or compliance with the Wabasha County Zoning Ordinance.

• The landowner shall abide by all representations and commitments presented in the application.

• Parcel 03.00040.00 and parcel 03.00042.00 shall be combined to be one tax parcel within three months of approval.

10. Motion by Gillespie/Jacob to open the public hearing for the application submitted by Jeffrey Graner requesting an after-the-fact variance from Article 14, Section 4(3) & Section 7(1) of the Wabasha County Zoning Ordinance for the construction of an accessory structure in a floodway. The subject property is described as parcel R10.00039.00 located in Section 9, Township 109 North, Range 9 West, Town of Minneiska. Motion carried.

11. Motion by Beckman/Jacob to close the public hearing. Motion carried.

12. Motion by Gillespie/Jacob to deny the request from Jeffrey Graner based upon four findings. Motion carried. The four findings for denial are as follows:

• The variance, if approved, would permit a structure that is not a permissible use in the floodway district. A use variance cannot be granted for an illegal structure.

• The accessory structure violates the minimum standards of the State’s floodplain regulations.

• The plight of the landowner is created by the landowner.

• The variance, if granted, has the potential to impact the public health, safety, and welfare of the citizens of Wabasha County by placing a structure in a floodway.

13. Motion by Beckman/Jacob to adjourn at 8:26 p.m. Motion carried.
