Minutes October 09, 2018




1. Bob Walkes called the meeting to order at 7:00 p.m. Other members present were Gayle Gillespie, Jon Beckman, Ken Jacob, and Mike Wallerich.

2. Motion by Beckman/Gillespie to approve the agenda as presented. Motion carried.

3. Motion by Jacob/Gillespie to approve the minutes of the September 11, 2018 meeting. Motion carried.

4. Motion by Gillespie/Wallerich to open the public hearing for the application submitted by Beth Ballinger requesting a variance from Chapter 394.36, Subd. 4 Minn. Stats. to allow for the expansion of a nonconforming dwelling. The subject property is described as parcel R05.00573.00 located in Section 1, Township 110 North, Range 10 West, Town of Greenfield. Motion carried.

5. Motion by Gillespie/Beckman to close the public hearing. Motion carried.

6. Motion by Beckman/Wallerich to approve the Ballinger request as presented with six conditions. Motion carried. The six conditions are as follows:

• The landowner shall abide by all representations and commitments presented in the application or presented to the Board of Adjustment.

• A shoreland buffer of native vegetation shall be established along the shoreline on the property to an average depth of 30 feet (measured landward and running parallel to the normal pool level). The stairway (no more than 4’ wide) to access the river and the concrete sea-wall shall be exempt from the requirement of being planted to native vegetation.

• A restoration plan for the shoreland buffer shall be approved by the Zoning Administrator prior to any land use permits being issued for the property.

• The shoreland buffer shall be planted with the native vegetation as described in the restoration plan within one year from the date the variance was approved and shall be fully established after three years from the date of approval. A shoreland buffer of native vegetation as described herein shall be maintained in perpetuity on the property.

• The structure as remodeled shall not be located any closer to the ordinary highwater level as the existing structure. This would include steps to access any part of a water oriented accessory structure.

• The property shall not exceed the 25% impervious surface limits.

Motion by Gillespie/Jacob to adjourn at 7:43 p.m. Motion carried.
