Meeting of September 15, 2015 


The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, September 15, 2015 at 9:00 a.m.

The meeting was called to order by Board Chairman Wobbe.

The following Commissioners were present: Goihl, Hall, Key, Springer, Wobbe

Motion to approve the agenda.

Resolution No: 2015-201

Whereas, on October 9, 2012 resolution No. 2012-203 was approved authorizing the Sheriff to maintain a pert-time staff level up to at a total of 25 employees to help fill shifts for the positions of Deputy and Dispatcher without returning to the County Board each time staff is hired; and

Whereas, the Wabasha County Sheriff is requesting this resolution to be amended to include authorization to hire part-time staff to fill Jailer shifts as needed.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that

Resolution No. 2012-203 is amended authorizing the Sheriff to hire part-time staff to fill shifts as needed for the position of Deputy, Jailer and Dispatcher not to exceed a total of 25 without returning to the County Board each time staff is hired.

Be it Further Resolved by the Wabasha County Board of Commissioners that the hours worked by the part-time staff is not to exceed 29 hours in a standard work week.

Resolution No.: 2015-202

Whereas, Wabasha County no longer performs the functions of Food, Beverage, Lodging, Mobile Home Park, Campground and pools licensing and inspection, and

Whereas, the authority to enact measures to ensure safe drinking water at transient, non-community public water supplies was contained in the ordinances governing the above activities, and

Whereas, the county continue to have legal authority over ensuring safe drinking water at transient, non-community public water supplies, the county is in need of an ordinance that addresses this issue, and

Whereas, a public hearing was held on September 15, 2015 by the Wabasha County Board of Commissioner for the purpose of gaining public input on the proposed public Water Supply ordinance; and

Whereas, there was no additional changes recommended to the board to the proposed ordinance wording;

Now Therefore be it Resolved, by the Wabasha County Board of Commissioners that the Wabasha County Public Water Supply Ordinance be adopted as presented.

Resolution No.: 2015-203

Whereas, A land parcel with a legal description matching a parcel owned by Carl and Marjorie Myer was forfeited for non-payment of property taxes;

Whereas, After researching the notes of former Wabasha County Auditor Charles McDonald, it has been determined that the forfeiture of this parcel of land was done in error and the property tax payments on this parcel are current;

Whereas, The recorded forfeiture document is a title impediment to the sale of the Carl and Marjorie Myer property and the Wabasha County Auditor/Treasurer has received a landowner request to rectify this error;

Whereas, Denise M. Anderson, Wabasha County Auditor/Treasurer, has completed an Application for Cancellation of Forfeiture with the Minnesota Department of Revenue, and such application requires certification of approval by the Wabasha County Board of Commissioners;

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Cancellation of Forfeiture of the Myer property is hereby certified and recommended for approval by the Minnesota Department of Revenue.

Resolution No.: 2015-204

Whereas, on August 19, 2015 Brian Hager was granted a Conditional Use Permit to operate a trucking business on parcel R10.00093.00 located in the SE ¼. Section 30, Township 109 North, Range 9 West (57291 132nd Ve., Alture); and

Whereas, this permit was provided with the understanding that it would be used as an alternative option to parcel R10.00086.00 where said trucking operation was and is being operated in violation of County zoning ordinances; and

Whereas, Wabasha County Zoning Administrator provided notice to Hager in a letter dated September 5, 2014 that the Conditional Use Permit may be revoked if not utilized; and

Whereas, Hager has not made any substantial steps to use or comply with the Conditional Use Permit on R10.00093.00, and has continued to operate in violation of ordinance on R10.00086.00.

Now, Therefore, be it Resolved that the Wabasha County Board of Commissioners hereby revokes the conditional use permit for Brian Hager issued for lot R10.00093.00.

SPRINGER - KEY

Resolution No.: 2015-205

Whereas, the Wabasha County Board of Commissioners has been notified by the Minnesota Board of Water and Soil Resources that the Wabasha County Comprehensive Local Water Management Plan has been approved according to Minnesota Statutes §103B.301:

Now, Therefore, Be it Resolved, the Wabasha County Board of Commissioners hereby adopts and will begin implementation of its approved Comprehensive Local Water Management Plan.

Be it Further Resolved after the adoption of the Comprehensive Local Water Management Plan, the Wabasha County Board of Commissioners shall amend existing water and related land resources plans and official controls as necessary to conform them to the applicable and approved comprehensive water plan.

Be it Further Resolved after the adoption of the Comprehensive Local Water Management Plan, Wabasha County shall notify local units of government within the County of the adoption of the plan or amendments to the plan. The local units of government are required to submit existing water and related land resources plans and official controls within 90 days to the County Board of Commissioners for review.

Be it Further Resolved that within 180 days, the Wabasha County Board of Commissioners shall review the submitted plans and official controls and identify any inconsistencies between the local plans and official controls, and Comprehensive Local Water Management Plan. The Wabasha County Board of Commissioners shall specify applicable and necessary measures to bring the local plans and official controls into conformance with the Comprehensive Local Water Management Plan.

Be it Further Resolved if a local unit of government disagrees with any changes to its plan, the local unit has 60 days after receiving the county's recommendations to appeal the recommendations to the Board of Water and Soil Resources.

Be it Further Resolved after receiving the recommendations of the Wabasha County Board of Commissioners, or a resolution of an appeal, a local unit of government has 180 days to initiate revisions to its plan or official controls. The new or revised plans and official controls must be submitted to the Wabasha County Board of Commissioners for review and recommendations.

Resolution No.: 2015-206

Whereas, Minn. Stat. §13D.05 subd. 3(C)(3) permits closing a County Board meeting to develop or consider offers or counteroffers for the purchase or sale of real or personal property.

Whereas, the County Board desires to consider making an offer for the purchase or real or personal property; and

Whereas, it is not possible to fully discuss strategy and the options available to the County in a public meeting; and

Now, Therefore, Be It Resolved a closed meeting of the County Board meeting to develop or consider offers or counteroffers for the purchase or sale of real or personal property. No subject matter other than the foregoing shall be discussed at said meeting.

Now Therefore Be It Resolved by the Wabasha County Board of Commissioners that, the County Administrator and/or his designee(s) are hereby authorized to negotiate a purchase price and prepare a purchase agreement for the County Board's consideration at a later date for the purchase of the for sale and available property in Lake City being considered as a replacement of the existing Lake City Highway Shop.
