Meeting of June 7, 2016


The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, June 7, 2016 at 9:00 a.m.

The meeting was called to order by Board Chairman Hall.

The following Commissioners were present: Goihl, Hall, Key, Springer, Wobbe

Resolution Accepting Resignation of Nel Garness

and authorization to fill vacant Jail Programs Coordinator position

Whereas, Nel Garness has submitted a letter of resignation and his resignation will take effect on June 10, 2016; and,

Whereas, due to this resignation, the Sheriff’s Office requests approval to fill this Jail Programs Coordinator vacancy.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: the resignation of Programs Coordinator Nel Garness is hereby accepted effective June 10, 2016.

Be it Further Resolved that the Wabasha County Board of Commissioners authorizes the Sheriff’s Office to fill this vacant Jail Program Coordinator position created by this resignation.

Resolution No.: 2016-143

Whereas, 2 of the health plans in Wabasha County now require that a nurse must be a certified public health nurse in order to receive reimbursement from the health plans for Public Health Nurse clinic visits, and

Whereas, currently Wabasha County Public Health has only 3 PHN staff nurses, and

Whereas, all three of these positions are already doing only work that requires a PHN certification, and

Whereas, these reimbursements are a significant amount of revenue for Public Health, and

Whereas, Wabasha County needs additional PHN staff in order to continue to receive reimbursements from these health plans for Public Health Nurse Clinic visits,

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that,

they authorize the hiring of a certified public health nurse to fill the current open nursing position in the department.

Resolution No.: 2016-144

Resolution to Support Zumbro River Watershed One Watershed One Plan Efforts

Whereas: the Minnesota Board of Soil and Water Resources has developed policies for coordination and development of comprehensive watershed management plans, also known as One Watershed, One Plan, consistent with Minnesota Statutes, Chapter 103B.801, Comprehensive Watershed Management Planning Program; and

Whereas: Minnesota Statutes, Chapter 103B.301, Comprehensive Local Water Management Act, authorizes Minnesota Counties to develop and implement a local water management plan; and

Whereas: Minnesota Statutes, Chapter 103D.401, Watershed Management Plan, authorizes Minnesota Watershed Districts to develop and implement a watershed management plan; and

Whereas: Minnesota Statutes, Chapter 103C.331, subdivision 11, Comprehensive Plan, authorizes Minnesota Soil and Water Conservation Districts to develop and implement a comprehensive plan; and

Whereas: the 6 counties, 6 soil and water conservation districts, and the Bear Valley Watershed District within the Zumbro River watershed, as delineated in the attached One Watershed One Plan Suggested Boundary Map as #30 (excluding Mississippi River Lake Pepin Watershed), have interest in developing a comprehensive watershed management plan for this area.

Now, therefore, be it resolved, that Wabasha County recognizes and supports watershed-scale planning efforts consistent with Minnesota Statutes, Chapter 103B.801, also known as One Watershed One Plan; and

Be it further resolved that Wabasha County welcomes the opportunity to collaborate with the counties, soil and water conservation districts, and watershed districts within the Zumbro River watershed for watershed-scale planning efforts in the future; and

Be it further resolved that the Wabasha County supports an application to the Board of Water and Soil Resources for a planning grant to develop a comprehensive watershed management plan and anticipates entering into a Memorandum of Agreement with the counties, soil and water conservation districts, and watershed districts within the Zumbro River Watershed, to collaborate on this effort, pending selection as a recipient of a planning grant.

Resolution Number: 2016-145

Danckwart Conditional Use Permit Amendment

Whereas, John and Bruce Danckwart were granted a conditional use permit on March 26, 2013 for the operation of a solid waste transfer facility on parcel R05.00357.00 located in Sec. 34, T. 110 N., R. 10 W., Town of Greenfield (16269 627st St., Kellogg, MN) ; and

Whereas, An application was submitted on April 20, 2016 to amend the hours of operation established in the original CUP issued; and

Whereas, The Wabasha County Planning Commission conducted a public hearing on May 23, 2016 to provide an opportunity for the public to present any testimony related to the request; and

Whereas, The Wabasha County Planning Commission discussed the matter after the public hearing and with a vote of 5-0 recommends to the Wabasha County Board of Commissioners that the hours of operation be extended as recommended by the Planning Commission.

Now Therefore Be It Resolved, the Wabasha County Board of Commissioners approves amending the hours of operation for the solid waste transfer facility to be as follows:

• Monday through Friday hours shall be limited to 5:00 a.m. to 9:00 p.m. Saturday hours shall be limited to 7:00 a.m. to 1:00 p.m. except for those Saturdays in which the applicant is part of a city-wide cleanup which then shall allow for extended hours of 7:00 a.m. to 6:00 p.m. Sunday hours shall be limited to 1:00 p.m. to 8:00 p.m. and shall be utilized only for load-out.

Resolution Number: 2016-146

Jech Conditional Use Permit

Whereas, Steve Jech submitted an application for a Conditional Use Permit to allow for the operation of an excavation business on parcel R02.00235.00 located in Sec. 26, T. 108 N., R. 12 W., Town of Elgin (27854 County Road 73, Elgin, MN); and

Whereas, The Wabasha County Planning Commission conducted a public hearing on May 23, 2016 to provide an opportunity for the public to present any testimony related to the request; and

Whereas, The Wabasha County Planning Commission discussed the matter after the public hearing and with a vote of 5-0 recommends to the Wabasha County Board of Commissioners that the request be approved with four conditions.

Now Therefore Be It Resolved, the Wabasha County Board of Commissioners approves the Conditional Use Permit for Steve Jech with the conditions as follows:

1. Any structure utilized as part of the excavation business shall meet all requirements of the Minnesota State Building Code and shall adhere to the building code by January 1, 2018 or the CUP shall automatically terminate.

2. No gravel, recycled asphalt, recycled concrete, sand, or other fill material shall be stored in the open on the property.

3. The Conditional Use Permit shall only allow for an excavation business with equipment being stored and serviced on the property and the business shall not be expanded unless by a revised CUP issued by Wabasha County.

4. The owner of the property shall abide by all representations and commitments presented in the application or presented to the Planning Commission and shall adhere to all conditions as approved by the County Board.

Motion to Recess to closed session

Resolution No.: 2016-147

Whereas, Minn. Stat. §13D.01 subd. 1(a) permits closing a County Board meeting for the purposes of discussing labor negotiation strategy;

Whereas, the County Board desires to consult with its attorney regarding the best course of action to take during the upcoming labor negotiations;

Whereas, it is not possible to fully discuss strategy and the options available to the County in a public meeting that may be attended by the opposing party;

Whereas, without such a meeting the County will have to make decisions without the full benefit of consultation with counsel, and is concerned that in such a situation, it could make poor or uninformed decisions, exposing the County and its taxpayers to liabilities and costs that could be avoided by fully informed decision making available only in a closed session with counsel;

Whereas, certain phases of the negotiation strategy may be impaired if every discussion is available for the benefit of opposing parties;

Whereas, the County Board wishes to meet with its attorney to discuss the pros and cons, and strategy regarding the labor negotiations, and finds that such a discussion cannot be had in public session;

Whereas, based upon the foregoing the Board finds there is an absolute need for confidentiality of this matter;

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that a closed meeting of the County Board addressing the labor negotiation strategy will be held with the County Attorney and other County staff. No subject matter other than the foregoing shall be discussed at said meeting.
