Meeting of November 15, 2016


The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, November 15, 2016 at 9:00 a.m.

The meeting was called to order by Board Chairman Hall.

The following Commissioners were present:  Goihl, Hall, Key, Springer, Wobbe

Resolution Number 2016-246

Resolution Authorizing Disposal of a 2002 Buick

Whereas, a 2002 Buick vehicle with over 177,000 miles is considered a surplus; and,

Whereas, the Wabasha County Sheriff’s Office is requesting that this vehicle be sold on Ebay; and,

Whereas, the Wabasha County Sheriff’s Office is requesting that the proceeds from the sale of this vehicle be deposited to the respective DWI Forfeiture funds split between the Sheriff’s Office and County Attorney’s Office.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: the Sheriff’s Office is authorized and directed to sell the 2002 Buick (ICR 2005-640) bearing VIN #1G4HP54K52U101176 on Ebay as noted above.

Be it Further Resolved by the Wabasha County Board of Commissioners that: funds from the sale be deposited to the appropriate DWI Forfeiture funds as noted above.

Resolution No.:  2016-247

Whereas, CP 079-086-007 with any and/or all Supplemental Agreements, Change Orders or Work Orders, has been completed. 

Now Therefore be it Resolved by the Wabasha County Board of Commissioners the Wabasha County Auditor/Treasurer be authorized to issue a warrant for final payment to Rochester Sand and Gravel – Division of Mathy Construction Company for completion of CP 079-086-007 in the amount of $25,354.85.

 

Resolution No.:  2016-248

Whereas, SAP 079-630-015 with any and/or all Supplemental Agreements, Change Orders or Work Orders, has been completed. 

Now Therefore be it Resolved by the Wabasha County Board of Commissioners the Wabasha County Auditor/Treasurer be authorized to issue a warrant for final payment to Chippewa Concrete Services Inc. for completion of SAP 079-630-015 in the amount of $25,000.

Resolution No.:  2016-249

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that,

Wabasha County hereby accepts the proposal of AAA Striping Service Company for CP 79-17-8280 in the amount of $23,620.48 and that the County Engineer is hereby authorized to utilize AAA Striping Service Company for CP 79-17-8280.

Resolution No.:  2016-250

Whereas, Wabasha County has designated First State Bank of Wabasha as a depository of its public funds pursuant to Minnesota Statues, Chapter 118A; and

Whereas, the Finance Director was authorized to open a account to manage the jail inmate funds; and

Whereas, it has become necessary to update the signatures due to personnel changes.

Now therefore be it resolved by the Wabasha County Board of Commissioners that,

Todd Babb, Leo Vanwey and Jon Klug are removed as authorized signers on the Jail Inmate Account at First State Bank.

Be it further resolved by the Wabasha County Board of Commissioners that, Jack Cole is added as an authorized signer on the Jail Inmate account at First State Bank

Resolution No.: 2016-251

A RESOLUTION APPROVING THE APPOINTMENT OF THE COMMISSIONER TO THE MULTI-COUNTY HOUSING AND REDEVELOPMENT AUTHORITY KNOWN AS SOUTHEASTERN MINNESOTA MULTI-COUNTY HOUSING AND REDEVELOPMENT AUTHORITY, consisting of the Counties of Wabasha, Winona, Goodhue, and Dodge.

Whereas, by the County Board of Wabasha County, Minnesota, that the recommendation by the Chair of the County Board of Wabasha, Wabasha County, Minnesota, of Laura Mielke to serve as the Commissioner representing the County of Wabasha, Minnesota of the Southeastern Minnesota Multi-County Housing and Redevelopment Authority for a period of five (5) years, the Recommendation of Appointment dated 11/15/16 be and the same is approved and said Commissioner is hereby appointed.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that,

The Motion to adopt such resolution was made by Commissioner Wobbe and seconded by Commissioner Key and upon roll call the following voted:

Resolution No.:  2016-252

Whereas, Rochester Sand and Gravel – Division of Mathy Construction Company is the lowest responsible bidder for SP 079-630-017 Minn. Proj. TA 7917(061).

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that Wabasha County hereby accepts the bid of and hereby awards a contract to Rochester Sand and Gravel – Division of Mathy Construction Company for SP 079-630-017 Minn. Proj. TA 7917(061) in the amount of $336,647.85 and that the Chair of the County Board and the County Administrator are hereby authorized to execute a Contract with Rochester Sand and Gravel – Division of Mathy Construction Company for this work.

Motion to approve the petition request made by Commissioner Wobbe.  The motion failed for lack of a second

Motion to Deny the request made by Springer / Goihl

Resolution No.:  2016-253

Whereas, a petition was received on June 27th, 2016 requesting the additional paving of shoulders along County State Aid Highway 30 from approximately Binner Way to Trail crossing; and

Whereas, a public hearing was held on July 19, 2016 at which no additional public feedback was received; and

Whereas, the approximate cost of requested improvements is $90,507 based upon most recent bid opening for similar work; and

Whereas, there is an existing bike trail paralleling and adjacent to County State Aid Highway 30 at the requested location; and

Whereas, the Wabasha County Board of Commissioners has investigated the matter and heard all interested persons regarding the petition.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the above requested petition is hereby denied.

SPRINGER-KEY

Resolution No.:  2016-254

Whereas, Edge Contracting Inc. is the lowest responsible bidder for SAP 079-628-001 and 079-628-002.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that Wabasha County hereby accepts the bid of and hereby awards a contract to Edge Contracting Inc. for SAP 079-628-001 and 079-628-002 in the amount of $206,283 and that the Chair of the County Board and the County Administrator are hereby authorized to execute a Contract with Edge Contracting Inc. for this work.

Resolution No.:  2016-255

Whereas, the Wabasha County Fee schedule is reviewed on an annual basis by department heads; and

Whereas, the fee schedule includes both fees set by the County and outside agencies; and

Whereas, the updated fee schedule for 2017 has been attached.

Now therefore be it resolved by the Wabasha County Board of Commissioners that, the following changes to the fee schedule are approved:

·         GIS searches/surrounding property owners-deleted

·         SSTS operating permit (approved  7/26/16-resolution  2016-179)-$85 annually

·         Infuenza Vaccine-$30 ($10 decrease)

·         Plain Copy-Electronic/Manual-updated for Recorder’s new records system

·         RecordeEase Web Fee Schedule-deleted Landshark fee schedule and added new system fees as approved  on 9/20/16 resolution 2016-217

·         Ordination Filing Fee-$20 (new)

·         Warrantied Address Sign Replacement-$7 (new)           

·         Highway- changes to amounts charged for the use of various construction equipment

Springer / Key – To close the meeting and enter into a closed session

Labor Negotiation Strategy

Resolution No.: 2016-256

Whereas,  Minn. Stat. §13D.01 subd. 1(a) permits closing a County Board meeting for the purposes of discussing labor negotiation strategy;

Whereas, the County Board desires to consult with its attorney regarding the best course of action to take during the upcoming labor negotiations;

Whereas, it is not possible to fully discuss strategy and the options available to the County in a public meeting that may be attended by the opposing party;

Whereas, without such a meeting the County will have to make decisions without the full benefit of consultation with counsel, and is concerned that in such a situation, it could make poor or uninformed decisions, exposing the County and its taxpayers to liabilities and costs that could be avoided by fully informed decision making available only in a closed session with counsel;

Whereas, certain phases of the negotiation strategy may be impaired if every discussion is available for the benefit of opposing parties;

Whereas, the County Board wishes to meet with its attorney to discuss the pros and cons, and strategy regarding the labor negotiations, and finds that such a discussion cannot be had in public session;

Whereas, based upon the foregoing the Board finds there is an absolute need for confidentiality of this matter;

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that a closed meeting of the County Board addressing the labor negotiation strategy will be held with the County Attorney and other County staff. No subject matter other than the foregoing shall be discussed at said meeting.
