The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, December 13, 2016 at 4:00 p.m.

The meeting was called to order by Board Chairman Hall.

Resolution No: 2016-265

Resolution Authorizing the Purchase of a new K-9

and authorization for Auditor’s Warrant

Whereas, the Wabasha County Sheriff’s Office is requesting to purchase a new K-9 at a cost of approximately $8,500.  Other costs will include training, equipment, cage insert, and accessories, and;

Whereas, the money for the purchase of the K-9 and accessories will be paid from a designated donation fund not to exceed the total donation amount.  

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: funding for the purchase of this K-9 and accessories will come from designated donation funds.

Be it Further Resolved by the Wabasha County Board of Commissioners that the Auditor is authorized to issue an Auditor’s Warrant for the purchase of a new K-9 and accessories from the respective vendors when invoices arrive. 

Be it Further Resolved by the Wabasha County Board of Commissioners that the total cost for the K-9 and accessories will not exceed the designated donation amount.

Resolution No.: 2016-266

Whereas, the Wabasha County Highway Department proposes to acquire right of way in addition to the  existing right of way of County State Aid Highway 8 for the purpose of improvements under project SAP 079-608-013; and 

Whereas, improvements under project SAP 079-608-013 are necessary in order to improve this segment of County State Aid Highway 8 to provide for public health, welfare, safety and convenience; and

Whereas, the right of way necessary to be acquired for improvements for project SAP 079-608-013 is described in the attached “CSAH 8 Right of Way Descriptions”.

Now Therefore Be It Resolved by the Wabasha County Board of Commissioners that, the County Highway Engineer is hereby authorized to proceed to acquire the right of way as described above in accordance with applicable laws and statutes.

Resolution No.: 2016-267

Whereas, Northern Salt Inc. is the lowest responsible bidder for C.P. 079-17-8270.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that Wabasha County hereby accepts the bid of Northern Salt Inc. for Project C.P. 079-17-8270 in the amount of $64,465.43 and that the Chairman of the County Board and the County Administrator are hereby authorized to execute a Contract with Northern Salt Inc. for this work.

Resolution No.: 2016-268

Whereas, Roberson Lime & Rock Inc. is the lowest responsible bidder for C.P. 79-17-8260.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that Wabasha County hereby accepts the bid of Roberson Lime and Rock Inc. for C.P. 79-17-8260 – Aggregate Surfacing - in the amount of $121,320 and that the Chairman of the County Board and the County Administrator are hereby authorized to execute a Contract with Roberson Lime and Rock Inc. for this work.

Resolution No.: 2016-269

Whereas, the Wabasha County Highway Department proposes to acquire right of way in addition to the  existing right of way of County State Aid Highway 27 for the purpose of improvements under project SAP 079-627-007; and

Resolution No.:  2016-270

Whereas, Rochester Sand and Gravel – Division of Mathy Construction Company is the lowest responsible bidder for CP 079-073-003.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that Wabasha County hereby accepts the bid of and hereby awards a contract to Rochester Sand and Gravel – Division of Mathy Construction Company for CP 079-073-003 in the amount of $320,525.73 and that the Chair of the County Board and the County Administrator are hereby authorized to execute a Contract with Rochester Sand and Gravel – Division of Mathy Construction Company for this work.

Resolution No.:  2016-271

Whereas, Fitzgerald Excavating and Trucking Inc. is the lowest responsible bidder for CP 079-073-002.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that Wabasha County hereby accepts the bid of and hereby awards a contract to Fitzgerald Excavating and Trucking Inc. for CP 079-073-002 in the amount of $433,696.05 and that the Chair of the County Board and the County Administrator are hereby authorized to execute a Contract with Fitzgerald Excavating and Trucking Inc. for this work.

KEY-SPRINGER

Resolution No.: 2016-272

Whereas, Wabasha County Highway 73 as described below was previously established as a County Highway by the Wabasha County Board of Commissioners; and

Whereas, the City of Elgin and Elgin Township have agreed with the proposed revocation of County Highway 73 under the terms of separate agreements with Wabasha County; and

Whereas, a public hearing has been duly noticed and held in accordance with Minnesota Statute 163.11 Subd. 5a. on October 25, 2016; and

Whereas, the effective date of the revocation is based upon the completion of proposed improvements to be performed by Wabasha County on County Highway 73.

Now Therefore Be It Resolved by the Wabasha County Board of Commissioners that County Highway 73 described as follows be and hereby revoked effective on September 1, 2018 as a County Highway of Wabasha County and that said County Highway 73 revert to Elgin Township: provided that any such revoked highway or portion thereof lying within the corporate limits of the City of Elgin shall become a street of the City of Elgin:

Beginning at a point on T.H. No. 42 approximately at the south quarter corner of Section 27-T.108N.-R.12W.; thence extending east along or near the north line of Sections 34-T.108N.-R.12W. and 35-T.108N.-R.12W. to a point approximately at the northeast corner of said Section 35-T.108N.-R.12W.; thence south along or near the east line of said Section 35-T.108N.-R.12W. to a point on the Wabasha County Line approximately at the southeast corner of said Section 35-T.108N.-R.12W.  and there terminating.

Now Therefore Be It Resolved by the Wabasha County Board of Commissioners that Wabasha County enter into the attached “Cooperative Agreement between the Township of Elgin and Wabasha County” and “Cooperative Agreement between the City of Elgin and Wabasha County”.

Be It Further Resolved by the Wabasha County Board of Commissioners that the Chair of the County Board of Commissioners and Wabasha County Administrator are authorized to execute each of the above Agreements.

Whereas, the following applicant wishes to have their MN Lawful Gambling Exempt Permit approved:

Whereas, Exempt Permit is for gambling at BJ’s Bar & Grill 61486 County Road 86 Theilman Mn 55945, West Albany Twp.

Whereas, the application have been approved by West Albany Twp Board. The permit runs for 1 day-April 29, 2017.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners hereby approves, the MN Lawful Gambling Exempt Permit for Theilman Sportsman’s Club at BJ’s Bar & Grill.

Resolution No.: 2016-275

RESOLUTION SETTING

Employer Sponsored Dental Plan

WHEREAS, Wabasha County as required by Minnesota Statute 471.6161 requests proposals for Basic Group Dental Insurance Plans for County employees, and

WHEREAS, the aggregate value of benefits provided to employees covered by the collective bargaining agreement cannot be reduced unless agreed to by the bargaining units, and

WHEREAS, the current provider (Delta Dental of Wabasha) provided a proposal that had an increase of 8% from 2016 rates, and

WHEREAS, Wabasha County submitted a request for proposal (RFP) to procure dental plans and pricing for 2017 from Delta Dental, MetLife, and Ameritas,

WHEREAS, MetLife offered a comprehensive plan design with increased benefits with the same aggregate value,

WHEREAS, MetLife offered a decreased dollar amount rate per employee for 2017 with a 2nd year rate cap not to be increased by more than 7% above the current rates and a 3rd year rate cap not to be increased by more than 9% above the prior plan year’s rates,

WHEREAS, it is the desire of numerous County employees to participate in such a plan

NOW, THEREFORE, be it resolved that the Wabasha County Board of Commissioners approves for adoption and implementation the County’s Employer Sponsored Dental Plan from MetLife.

Resolution No.: 2016-276

Retain Counsel for Elected Official Salary Appeal

Whereas, On December 1, 2016 Wabasha County received notice that County Attorney Karrie Kelly and County Auditor/Treasurer Denise Anderson were appealing the salaries that were set for their respective positions for 2017;

Whereas, the referenced appeal was made to the Wabasha District Court;

Whereas, the County Board wishes to retain counsel to represent the County in relation to the referenced appeal;

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that Wabasha County Administrator is authorized to retain the services of Ratwik, Roszak, and Maloney to represent the County in the above referenced appeal.

Resolution No.: 2016-278

Whereas, the Integrated Public Alert and Warning System (IPAWS) is another level of alerting the public of emergencies via their phones, televisions, radios, and computers whether they are from the area or not; and

Whereas, a notification system such as CodeRED is needed in order to utilize IPAWS and Wabasha County already uses CodeRED; and

Whereas, Wabasha County has been given grant money through Region 1 MN Homeland Security & Emergency Management to cover to cost of IPAWS for 2017; and

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, Wabasha County agrees to add IPAWS to the CodeRED system for 2017.

GOIHL-SPRINGER: Motion to go into closed Session

Labor Negotiation Strategy

Resolution No.: 2016-277

Whereas,  Minn. Stat. §13D.01 subd. 1(a) permits closing a County Board meeting for the purposes of discussing labor negotiation strategy;

Whereas, the County Board desires to consult with its attorney regarding the best course of action to take during the upcoming labor negotiations;

Whereas, it is not possible to fully discuss strategy and the options available to the County in a public meeting that may be attended by the opposing party;

Whereas, without such a meeting the County will have to make decisions without the full benefit of consultation with counsel, and is concerned that in such a situation, it could make poor or uninformed decisions, exposing the County and its taxpayers to liabilities and costs that could be avoided by fully informed decision making available only in a closed session with counsel;

Whereas, certain phases of the negotiation strategy may be impaired if every discussion is available for the benefit of opposing parties;

Whereas, the County Board wishes to meet with its attorney to discuss the pros and cons, and strategy regarding the labor negotiations, and finds that such a discussion cannot be had in public session;

Whereas, based upon the foregoing the Board finds there is an absolute need for confidentiality of this matter;

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that a closed meeting of the County Board addressing the labor negotiation strategy will be held with the County Attorney and other County staff. No subject matter other than the foregoing shall be discussed at said meeting.
