Meeting of April 27, 2010
The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Services Building, in the City of Wabasha, Minnesota on Tuesday, April 27, 2010 at 11:00 a.m. The meeting was called to order by Board Chairman Dwelle. The following Commissioners were present: Windhorst, Dwelle, Riester, Norman and Hall.

Whereas, the Wabasha County Regional Rail Authority (WCRRA) is a member of the Minnesota High Speed Rail Commission (MHSRC), and Whereas, the WCRRA share of the 2010 budget in the amount of $2,047 has been paid from for the WCRRA authority fund, and
Whereas, the Wabasha County Board of Commissioners has agreed to provide the financial support for the membership into the MHSRA, Now therefore be is resolved by the Wabasha County Board of Commissioners that the Finance Director be authorized to approve an interfund transfer from the General Fund (Fund 01) to the Regional Rail Authority Fund (Fund 50) in the amount of $2,047 to cover the WCRRA’s share of the 2010 budget.

Whereas, it is necessary to publish the advertisements for bids for the following projects: SAP 079-605-012; Replacement of Bridge 92422 and Approach Grading SAP 079-602-036; Replacement of Bridge 92426 and approach Grading
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Wabasha County Highway Engineer be authorized to advertise for bids for the above referenced projects.

Resolution No.: 2010-081
Whereas, Wabasha County has reviewed the pertinent data on bridges requiring replacement, rehabilitation, or removal; and Whereas, Wabasha County has identified those bridges that are high priority and has previously established a list of those bridges that require replacement, rehabilitation, or removal; and
Whereas, the following additional bridge has been since identified as also requiring replacement, rehabilitation, or removal.

Whereas, the Dept. of Social Services is in need of various items of electronic equipment for routine functions of the Department; and Whereas, use of an existing color printer will not be available to Social Services with the relocation of Departments from the County Services Building to the Courthouse/Annex; and
Whereas, the staff have identified a HP Color LaserJet (copier/printers/fax/scanner) as the preferred equipment to meet the continued needs of the Department; and Whereas, IT staff have reviewed this request, brought forward a cost estimate, and agree with the selected piece of equipment; and
Whereas, the Finance Director has requested the Dept. of Social Services acquire this equipment as a cost-effective solution to the current access;
Now, therefore be it resolved, the Wabasha County Board of Commissioners hereby approves the purchase of a HP Color LaserJet, model CM2320Fxi at a price of $798.99 (+ tax) for the Department of Social Services.

Whereas, the following applicant wishes to have their Minnesota Lawful Gambling – Premise Permit Application approved: Plainview Lions Club at Piper Hills Golf Course in Plainview Township, 55152 County Road 4, Plainview, and
Whereas, the application is good for two years.
Now therefore be it Resolved by the Wabasha County Board of Commissioners hereby approves the Minnesota Lawful Gambling – Premise Permit Application for the Plainview Lions Club at Piper Hills Golf Course in Plainview Township, subject to the approval of the State of Minnesota Gambling Control Board.

Resolution No. 2010-084
Whereas, all relevant requirements of law have been fulfilled. The Board has proper jurisdiction in the matter of issuing an order to stay the establishment of the Lake Zumbro Lake Improvement District, parts of that District being located in Wabasha County, pursuant to Minnesota Statutes , 103B.545, Subd. 1.
Whereas, the majority of the property owners within the proposed Lake Improvement District, on Lake Zumbro submitted a petition to the Wabasha County Board, which met the requirements set forth in M.S. Section 103B.521, Subd. 1 and Minnesota Rules 6115.0970, Subp. 1;
Whereas, on January 19, 2010, the Wabasha County Board convened the public hearing, in the Wabasha County Government Offices, on the petition to establish the Lake Zumbro Lake Improvement District, pursuant to M.S. 103B.521, Subd. 2, and comments from persons for and against the creation of the District was received and considered;
Whereas, on February 16, 2010, the Wabasha County Board of Commissioners reconvened in the Wabasha County Board Room, and approved the petition initiating establishment of the Lake Zumbro Lake Improvement District, pursuant to M.S. Section 103B.521;
Whereas, on March 7, 2010, Wabasha County Board and Olmsted County Board, held a joint meeting of the Boards to discuss the details of the formation of the District Board, which was delegated to the Olmsted-Wabasha Joint Powers Board; and an ad hoc task force of 4 residents within the proposed District would be included in the Joint Powers Board, to offer suggestions, but do not vote.
Whereas, the Joint Powers Board and resident task force met on April 8, 2010 and April 15, 2010 to discuss these details and upon reaching agreement, issued a resolution and order on April 15, 2010 setting forth the basic operating structure for the Lake Zumbro Lake Improvement District Board; and
Whereas, pursuant to M.S. Section 103B.545, Subd. 1, a referendum on the establishment of a Lake Improvement District, was initiated by petition of at least twenty-six (26%) of the property owners within the Lake Improvement District, and submitted to Wabasha County on April 8, 2010, and Olmsted County April 9, 2010, before the effective date of its establishment, which was set to occur not later than 30 days following the issuance of an order by the joint county authority establishing the powers of the District Board;
Whereas, the Wabasha County Auditor’s Department and the Olmsted County Property Records and Licensing Department have verified the signatures on the petitions, and verified that these signatures meet the statutory requirements of M.S. 103B.545.
Whereas, pursuant to M.S. Section 103B.545, Subd. 1, after receiving the petition for referendum, the two County Boards, must each issue an order staying the establishment of the Lake Zumbro Lake Improvement District until a referendum vote is taken of all qualified voters and property owners within the Lake Improvement District;
Whereas, the resolution and order of the Olmsted – Wabasha Lake Zumbro Joint Powers Board need not be approved and published until the outcome of the referendum is determined.
Now Therefore Be It Resolved that the Wabasha County Board hereby issues the following Order:
1) The establishment of the Lake Zumbro Lake Improvement District shall be stayed until a referendum vote is taken of all qualified voters and property owners within the proposed Lake Improvement District, to take place on August 23, 2010. Olmsted County and Wabasha County will work to coordinate the details involved in holding this election.
2) The action to approve the order of the Olmsted – Wabasha County Lake Zumbro Joint Powers Board establishing the details regarding the formation and operation of the District Board is hereby tabled pending the outcome of the aforementioned election to take place.

Whereas, the County is in the process of consolidating offices to better serve the residents of Wabasha County, and
Whereas, it will not be practical to utilize much of the existing office furniture due to changes in office configuration, and
Whereas, Wabasha County found that the purchase of high-quality used office furniture is a more economical strategy, and
Whereas, Wabasha County was very pleased with the price and product provided by Brothers Office Furniture for the Criminal Justice Center, and
Whereas, it is necessary to purchase desks, work stations and other furniture for the Recorder’s Office (five people), Auditor-Treasurer’s Office (five people), Environmental Services Office (five people), Finance Office (two people), Human Resources-Payroll Office (one person), Assessor’s Office (six people), Extension Office (two people) six Social Service offices (nine people), and Social Services-Finance (three people), for a total of 38 office units, plus conference room furniture.
Whereas, Brothers has provided a quote for all of the furniture necessary to complete our consolidation that is cost effective for Wabasha County,
Now, Therefore Be It Resolved by the Wabasha County Board of Commissioners approve the purchase of all necessary office furniture from Brothers Office Furniture at the quoted price of $40,168.97, and authorize payment by Auditor’s warrant.

Resolution No.: 2010-086
Whereas, the Wabasha county Attorney’s Office has provided prosecution services to the City of Plainview for 2008 (April) and 2009 (April) to April 2010.
Whereas, the City of Plainview wishes to extend the contract for one year starting April 2010.
Whereas, the County Board of Commissioners, with the recommendation of the County Attorney that said contract be extended at a cost to the City of Plainview of $1,600 per month.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Chairman of the County Board and its Administrator sign said contract, a copy of which is attached to this resolution.

Resolution No.: 2010-087
Whereas, Wabasha County has not had an STS crew since 12/31/2001 and,
Whereas, the Department of Corrections funding has been reduced from 50% to 25% reimbursement to counties, effective 7/1/2010 and is no longer authorizing additional crews in Minnesota and,
Whereas, Goodhue County has requested that Wabasha County equally share a fulltime STS crew effective 7/1/2010 and,
Whereas, Wabasha County would be responsible for 50% of program costs for a full-time crew, which is estimated $28,496 and, Whereas, Wabasha County would enter into a one year contract with Goodhue County for the period of 07/01/2010 through 6/30/2011, Whereas, this would be an opportunity to implement a half-time program in Wabasha County while taking advantage of the DOC reimbursement and benefits (vehicle and maintenance, liability insurance, training and equipment/tools) and,
Whereas, STS is a valuable sentencing alternative for the offender, Court, Probation and Sheriff’s Department that also benefits Wabasha County, the local cities and townships.
Now Therefore, Be It Resolved, that the Wabasha County Board of Commissioners hereby approves that Wabasha County enter into a contract with Goodhue County to share a fulltime STS crew from 07/01/2010 through 6/30/2011 at the previous stated cost.
