Meeting of September 7, 2010
The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, September 7, 2010 at 9:00 a.m. The meeting was called to order by Board Chairman Dwelle. The following Commissioners were present: Windhorst, Dwelle, Riester, Norman and Hall.

Resolution No.: 2010-162
Whereas, the Wabasha County Planning Commission’s duties are to review all applications for Conditional Use Permits and Plans for the Subdivision of Land in Wabasha County, and;
Whereas, The Wabasha County Planning Commission shall consist of five (5) members, with one member being selected from each Commissioner District by the duly elected Commissioner from their respective District, and;
Whereas, In the event that a member is unwilling or unable to fulfill a term, the Board shall appoint someone to fulfill the remainder of the term, and;
Whereas, the seats from the Districts of Commissioners Hall and Riester have been vacated.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that Commissioner Hall appoint Kent Zarling for the term of September 7, 2010 to December 31, 2010; and Commissioner Riester appoint Patrick Gustafson for the term of September 7, 2010 to December 31, 2010 to the Wabasha County Planning Commission.

Resolution No.: 2010-165
Whereas, the Wabasha County Board of Adjustment shall have the authority to order the issuance of variances, hear and decide appeals from and review any order, requirement, decision or determination made by any administrative official charged with enforcing any ordinance , and;
Whereas, The Wabasha County Planning Commission shall consist of seven (7) members, at least three members shall be from the unincorporated area of the County and one member shall also be a member of the Planning Commission, and;
Whereas, In the event a vacancy occurs as a result of death, incapacity, resignation or removal of any member by the Board of Adjustment, a new member shall be appointed, but only for the unexpired term of the predecessor and;
Whereas, the seats from the Districts of Commissioners Hall and Dwelle have been vacated.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that Commissioner Dwelle appoint Jon Beckman for the term of September 7, 2010 to December 31, 2010 to the Wabasha County Board of Adjustment. Commissioner Hall did not make an appointment to the Board of Adjustment.

Whereas, the Planning Commission held a public hearing on July 26, 2010 and reviewed the Rezone Request Application by WILLIAM & JEAN KRUSMARK, 29860 640TH STREET, MILLVILLE, MN 55957. The request involves the following described property: E1/2 SW1/4 Section 21, T.110 N. – R.12 W. (80 Acres) West Albany Township The request is to rezone 80 acres of land from A-3 Classification to A-1 Classification under Article 17. Section 2 Subd. 1A.
Whereas, the Planning Commission approved the request 3-0 and recommends approval from the County Board with the following conditions: None

Resolution No.: 2010-167
Whereas, the Planning Commission held a public hearing on July 26, 2010 and reviewed the Rezone Request Application by WILLIAM & JEAN KRUSMARK, 29860 640TH STREET, MILLVILLE, MN 55957. The request involves the shooting preserve under Article 9, Section 3, Subd. 7, on the following described property: E1/2 SW1/4 Section 21, T.110 N. – R.12 W. (80 Acres) West Albany Township
Whereas, the Planning Commission denied the request 2-1 and recommends denial of the request from the County Board as per the following findings: The conditional use would be injurious to the use and enjoyment of other property in the immediate vicinity for the purposes already permitted, and will substantially diminish and impair property values within the immediate vicinity.

Resolution No: 2010-168
Whereas, there is a need for personnel to fill sick and vacation hours, and;
Whereas, the Wabasha County Sheriff is requesting authorization to create a part-time roster list and to hire four (4) part-time Dispatchers from this list.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: The Wabasha County Sheriff’s Office is hereby authorized to create a part-time Dispatch roster list;
Now Therefore be it further Resolved by the Wabasha County Board of Commissioners that: The Wabasha County Sheriff’s Office is also authorized to hire a total of four (4) part-time Dispatchers from this roster, effective immediately.

Resolution No: 2010-169
Whereas, the Wabasha County Sheriff’s Office is requesting the acceptance of the retirement of K-9 Ringo, effective immediately; and, Whereas, the handler, Deputy Jason Bade, has agreed to the terms of the attached Canine Transfer Agreement to take over the liability of K-9 Ringo; and,
Whereas, K-9 Tango will take over the full-time K-9 duties.
Now Therefore Be it Resolved by the Wabasha County Board of Commissioners that: the retirement of K-9 Ringo is hereby accepted, effective immediately.
Now Therefore Be it further Resolved by the Wabasha County Board of Commissioners that: K-9 Tango will take over K-9 Ringo’s full-time K-9 duties.

Resolution No: 2010-170
Resolution Authorizing Auditor’s Warrant for Minnesota DNR 2010 Federal Boating Safety Sub Grant Contract #B44221
Whereas, the Wabasha County Sheriff’s Office has been authorized to participate in the 2010 Federal Boating Safety Sub Grant; and Whereas, the 2010 Minnesota Department of Natural Resources Federal Boating Safety Sub Grant was approved on June 22, 2010 by resolution no. 2010-122.
Whereas, this grant expires September 14, 2010 and all requirements (Exhibit A) must be met on or before this date in order to receive reimbursement (no exceptions!).
Whereas, the Sheriff requests approval for the Auditor’s Office to cut an Auditor’s Warrant for the following invoices effective immediately:
 Invoice #R10067883 payable to Whitewater Wireless, Inc. in the amount of $143.05 (VHF Marine Antenna/Radio).
 Invoice #R10068067 payable to Whitewater Wireless, Inc. in the amount of $652.58 (LED lights).
 Invoice #R10068013 payable to Whitewater Wireless, Inc. in the amount of $72.24 (800 MHz antenna/roof mount cable/UHF connector).  Partial invoice #13802811 payable to Motorola in the amount of $6,072.13 (Radios). These amounts total $6,940 which is the total amount of the award.
Now Therefore Be it Resolved by the Wabasha County Board of Commissioners that: the Auditor’s Office is hereby authorized to cut an Auditor’s Warrant for the above-named invoices effective immediately.

Resolution No.: 2010-171A
Whereas, The County offered the Public Health Building located at 107 East 3rd Street, Wabasha, MN described as lots 6 & 7, block 22, parcel #27.00343.00 in Wabasha, MN, for sale by sealed bid, in “as-is” condition, and;
Whereas, A total of 2 bids were received, one from Dennis Bussian in the amount of $85,000, subject to a building inspection, and another from the Wabasha Area Community Resource Center in the amount of $1, and;
Whereas, The $85,000 offer is contingent upon an inspection of the property even though the property was advertised “as-is”.
Whereas, it is in the best interest of the County to have the property on the tax roll, and;
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the bid from Dennis Bussian be accepted and the building be sold at the bid amount of $85,000.

A petition by landowners for the Lake Zumbro Improvement District was filed with the County Auditor’s Office, and a Public Hearing must be held within 30 days after receiving certification from the County Auditor. The Board of County Commissioners set the LID Public Hearing date for October 5 at the Mazeppa Community Center, 6:30 p.m.

Whereas, the Wabasha County Board of Commissioners per Minnesota Statute 275.065 is required to adopt a proposed property tax levy for taxes payable year 2011 and certify that amount to the county auditor on or before September 15; and
Whereas, based upon the proposed budget the following amounts have been determined to be needed for the 2011 proposed property tax levy.

Now, Therefore, be it resolved by the Wabasha County Board of Commissioners that the County Auditor-Treasurer is to certify the 2011 proposed property tax levy to the Minnesota Department of Revenue as presented.

Resolution No.: 2010-174
Whereas, the Southeastern Minnesota Multi-County Housing and Redevelopment Authority was created by action of the Boards of Commissioners of Dodge, Goodhue, Wabasha and Winona Counties pursuant to Minnesota Statutes; and
Whereas, the Wabasha County Board of Commissioners has considered the Authority’s request to approve a special benefit tax to be levied upon all taxable market value of taxable property within the Authority’s area of operation within Wabasha County.
Now, Therefore, be it Resolved by the Wabasha County Board of Commissioners instructs the County Auditor-Treasurer to certify a 2011 proposed special benefit property tax levy in the amount of $63,461 for Southeastern Minnesota Multi-County Housing Redevelopment to the Minnesota Department of Revenue.

Resolution No.: 2010-175
Whereas, The Wabasha County Board of Commissioners approved a Special Benefit Tax agreement dated July 1, 2005 with Southeastern Minnesota Multi-County Housing and Redevelopment Authority for the purpose of paying, in part the debt service on the Authority’s Tax Increment Revenue notes, Series 2005; and
Whereas, pursuant to this agreement, the Wabasha County Board of Commissioners does hereby certify the proposed special benefit property tax levy in the amount of $50,000.00 for the Southeastern Minnesota Multi-County Housing Redevelopment Authority, a Special Taxing district.
Now, Therefore, be it Resolved by the Wabasha County Board of Commissioners instructs the County Auditor-Treasurer to certify the above 2011 proposed special benefit property tax levy for Southeastern Minnesota Multi-County Housing Redevelopment Authority to the Minnesota Department of Revenue.

Whereas, the Wabasha County Board of Commissioners has considered the duties of each and every office, department and agency and the experience, qualifications and performance of employees, elected officials and appointed employees in the development of this budget; and
Whereas, capital expenditures included in the 2011 budget shall be made only after approval of the Board of Commissioners per the County Purchasing Policy.
Now, Therefore, be it Resolved by the Wabasha County Board of Commissioners that the 2011 Wabasha County Proposed Budget is adopted as presented.
