Meeting of September 21, 2010
The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, September 21, 2010 at 9:00 a.m. The meeting was called to order by Board Chairman Dwelle. The following Commissioners were present: Windhorst, Dwelle, Riester, Norman and Hall.

Administrator’s Update: Move to Courthouse October 4-5, furniture arrived today; move Public Health October 18-19 AMC Fall Conference December 6-8 in St. Cloud NCRS, SWCD September 28, 11:00 a.m. AC unit replacement quotes $22K rather than $40-50K expected Union negotiations October 26; 1:30, 2:30, 3:30 p.m. District IX meeting, Freeborn County, October 25 There was no comment during the public forum.

Declaring Wabasha County as a willing participant and partner for the proposed Wabasha County SCDP rehabilitation projects contained in the business and community development application
Be It Resolved that Wabasha County is willing to participate in the proposed Wabasha County SCDP Rehabilitation Projects contained in the business and community development application to be submitted on October 7, 2010.
Now, Therefore Be It Resolved that Wabasha County agrees to participate and partner in the proposed Wabasha County SCDP Rehabilitation projects contained in the Business and Community Development Application.

Whereas, Minnowa Construction, Inc. is the lowest responsible bidder for Project S.A.P. 079-602-037.
Now Therefore be it Resolved that the Wabasha County Board of Commissioners hereby accepts the bid of Minnowa Construction, Inc. on Contract No. 10006 for Project S.A.P. 079-602-037 – Construct Bridge 79549 and Approaches on C.S.A.H. 2 - in the amount of $586,337.50 and that the Chairman of the County Board and the County Administrator are hereby authorized to execute a Contract with Minnowa Construction, Inc. for this work.

Resolution No.: 2010-179
Whereas, the Wabasha County Highway Department finds it beneficial to purchase a “New Roads Public Works Management System” software license.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Wabasha County Highway Department be authorized to purchase from ACS Enterprise Solutions a one “New Roads Public Works Management System” software license in an amount of $8,500.

Resolution No: 2010-180
Whereas, the Wabasha County Sheriff is requesting authorization to send both K-9 Deputies and their partners, Jason Lorenson and Recon and Jason Bade and Tango, to the 2010 K-9 Nationals;
Whereas, both Deputies have raised a total of $1,850.00 in donations to be used toward this event,
Whereas, this event will be held in November 2010 in Louisiana.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: K-9 Deputies Jason Lorenson and Jason Bade are hereby authorized to attend the 2010 K-9 Nationals;
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: This event will be paid from donations received.

Whereas, the Wabasha County Jail Programs Department has applied for a Family Services Grant
Whereas, the Wabasha County Family Services Collaborative Grant was approved on August 5, 2010
Whereas, this grant expires December 31, 2010 and all invoices must submitted to the Collaborative on or before this date in order to receive reimbursement (no exceptions!).
Whereas, the Wabasha County Jail Programs Department requests approval for the Auditor’s Office to cut an Auditor’s Warrant for the following purchases:
 Parenting from Prison DVD series, Internet purchase from Greystone Educational $299.00.
 Ex-Offenders Talk About Going Home DVD series, Internet purchase from Greystone Educational $399.00.
 Ex-Offenders Talk About Fatherhood series, Internet purchase from Greystone Educational $299.00.
 Camcorder with Tripod (for “RED”= Reading Every Day program, Internet purchase from Best Buy $359.00.
 Children’s books (for RED program) , Internet purchase from Amazon $100.00

 Postage (50 DVD’s @ $1.65 each) for RED program. Purchased from US Postal Service. $82.50 These amounts total $1,611.61 which is the total amount of the award.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: the Auditor’s Office is hereby authorized to cut an Auditor’s Warrant for the above-named invoices effective immediately.

Resolution Number: 2010-183
Whereas, at its meeting of September 7th, the Board approved accepting the bid of Dennis Bussian for the purchase of the Public Health Building, and;
Whereas, Mr. Bussian subsequently submitted a purchase agreement that was substantially different than the terms of the advertised bid, and per State Statute bid terms may not be changed after bids are opened, and;
Whereas, we now have a no-sale situation with this building, it is the recommendation of the County Administrator that the building be re-advertised for sale.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners authorizes the County Administrator to re-advertise the Public Health Building for sale by sealed bid.

Resolution No.: 2010-184
Whereas, Wabasha County offers Health Insurance to its employee’s, and Whereas, open enrollment is scheduled for Oct 13, 2010, and Whereas, Health Insurance plan options to be offered by the County need to be determined prior to the open enrollment date, and Whereas, the Wabasha County insurance committee has been meeting regularly and has recommended 3 plan options be made available to county employees
Now, Therefore be it Resolved by the Wabasha County Board of Commissioners that: Health Insurance options to be offered at open enrollment time be the current $250 deductable plan, the current $1,000 deductable plan, and a new option which would be a $3,000 deductible HSA/VEBA plan with an employer contribution. Current County cost of monthly premium for individual insurance is $641/month, family is $1,368/month. 2011 County costs would be $668/mo for individuals and $1,426.40 for families. For the HSA/VEBA, with the premium savings of this plan over the cost of the $250 deductable plan the county will contribute 50% of the deductable into a HSA/VEBA account.

Resolution No.: 2010-185
Whereas, the old County Jail and Sheriff’s Office have been vacated, and;
Whereas, the County no longer uses any portion of this building and foresees no future use for this building, and;
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the County Administrator be authorized to put out an RFP to determine the potential cost for demolition of the building.

HALL – WINDHORST
Resolution No.: 2010-186
Whereas, the waterlines for the old Courthouse and Maintenance garage runs through the basement of the old Sheriff’s Office and Jail Building, and;
Whereas, if the building is demolished the waterline must be relocated or if the building is not demolished, but stands vacant the basement must be kept heated to prevent freezing of these two waterlines, and;
Whereas, it would be best management practice to permanently relocate these lines, and;
Whereas, three quotes were obtained for this work and the best and most inclusive quote being that from Hartert Septic, Inc. in the amount of $12,300.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the quote from Hartert Septic, Inc. be accepted and the work authorized.

HALL - RIESTER
Resolution No.: 2010-159
Revised Whereas, the County Administrator was tasked with creating a systematic exempt/non-exempt pay grid to replace the current 39 individual pay grids that exist, and evaluate all County positions, and;
Whereas, a single new pay grid has been created and all jobs have been evaluated by a Committee consisting of Commissioner Hall, the County Administrator, Finance Director, Court Services Director, HR Coordinator, and a union representative, and;
Whereas, this proposed pay grid and reevaluated position points allow the County to pass the Minnesota State Pay Equity Study. Whereas, the county is subject to the withholding of state aid for failure to pass Pay Equity and 48% of County revenue comes from state and federal aid, and Wabasha County cannot realistically function without state and federal aid.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the proposed new position evaluation points be approved and implemented and that the proposed pay grid be approved and implemented on January 1, 2011, by the method of leaving employees at their present rate of pay and moving them a partial step to the next highest step at their 2011 anniversary date.

Resolution No.: 2010-187
Whereas, Mr. Krusmark is requesting a grandfather clause for his operation under the terms of the zoning ordinance as prior use is allowed “for any principal use permitted in the zoning district”. Since the principal use, agriculture, is permitted in the A-3 zoning district, this qualifies as a proper nonconforming use. He is stating that it is his belief therefore, that a conditional use permit is not required. Whereas, under Article 1, Section 4, the practice being requested was a nonconforming use prior to the ordinance, but may be continued, extended or changed subject to Article 20 of this ordinance regulating nonconforming uses.
Whereas Article 20, Subd.1 a nonconforming preexisting lot of record may be used for any principal use permitted in the zoning district in which the lot is located.
Therefore the Wabasha County Board would allow the practice requested under the initial conditional use request with proof that it was in operation prior to the ordinance. Also that if granted Mr. Krusmark will abide by the terms in his conditional use permit application, such as setbacks and safety precautions as deemed appropriate by the county board for this operation.
