Meeting of November 4, 2008
The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Services Building, in the City of Wabasha, Minnesota on Tuesday, November 4, 2008 at 9:00 a.m. The meeting was called to order by Board Co-Chairman Springer. The following Commissioners were present: Windhorst, Dwelle, McNallan, and Springer. Commissioner Riester was absent.

Motion to approve the agenda.

Commissioners reported on meetings they had attended. Scott Becklund spoke to the Board on his concerns about the Millville Bridge during the Public Forum.

Resolution No.: 2008-235
Be it resolved by the Wabasha County Board of Commissioners that the County of Wabasha enter into an agreement with the Soo Line Railroad Company (d/b/a/ Canadian Pacific Railway) and the Commissioner of Transportation for the installation and maintenance of railroad crossing signal circuitry at the intersections of Lakewood Ave. (CSAH 9), Grant Blvd. (CSAH 59) and Gambia Ave. (CSAH 64) with the tracks of the Soo Line Railroad Company (d/b/a/ Canadian Pacific Railway) in Lake City and Wabasha, Minnesota, and appointing the Commissioner of Transportation agent for the County to supervise said project and administer available Federal Funds in accordance with Minnesota Statute, Section 161.36. The County’s share of the cost shall be (0) percent of the total signal cost.
Be it further resolved, that the County Engineer and County Administrator be and they are hereby authorized to execute said agreement and any amendments thereto for and on behalf of the County.

Resolution Number: 2008-232
Whereas, Wabasha County owns a parcel of land in the county which is only accessible by crossing over the property of David and Laurie Balow; and
Whereas, another landowner, Mark Pritzl, owns a parcel of land adjacent to the County land which is also only accessible by crossing over the property of David and Laurie Balow; and
Whereas, continuous access to this property by the County is necessary to maintain critical emergency communications equipment; and
Whereas, the parties wish to enter into an agreement concerning the easement over the Balow property and the upkeep of the road thereon; and Whereas, the negotiated terms of the agreement, attached hereto, have been agreed upon by all parties and appear to equitably spread the costs and responsibilities of maintenance of the easement,
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: The Chairperson of the Wabasha County Board of Commissioners is hereby authorized to sign the attached Roadway Easement and Agreement between David E. Balow, Laurie J. Balow, Mark M. Pritzl, Shelly J. Pritzl and Wabasha County. Abstained: McNallan

Resolution 2008-236
Whereas, the Wabasha County Board of Commissioners recognizes the importance of participation in the Association of Minnesota Counties; and
Whereas, the Association of Minnesota Counties’ by-laws state; “Each member county shall be entitled to a number of delegates equal to three more than the number of persons on the Board of County Commissioners of the member county’; and
Whereas, the AMC by-laws state: “Delegates shall be appointed annually by the County Board from among the officials and employees of the County”; Now, Therefore, Be It Resolved, that the Wabasha County board of Commissioners hereby appoints County Administrator David Johnson to serve as a voting delegate to the Association of Minnesota Counties to represent Wabasha County.
