Meeting of January 15, 2008
The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Services Building, in the City of Wabasha, Minnesota on Tuesday, January 22, 2008 at 11:00 a.m.
The meeting was called to order by Board Chairman Riester at 11:00 a.m.
The following Commissioners were present: Windhorst, Dwelle, McNallan, Riester and Springer.
DWELLE – McNALLAN
Motion to approve the agenda, with the exceptions: Personnel Policies tabled to next meeting; and Employee Disciplinary action under review by the County Attorney’s Office.

There were no Commissioners’ reports.
There was no public comment during the public forum.
SPRINGER – DWELLE
Motion to approve the consent agenda including the following: Claims Meal Vouchers SSIS Claims Minutes: January 15, 2008 Sheriff’s Office: Southeastern Minnesota Drug Task Force – matching funds

A Public Hearing was held in regard to the County’s application in the 2008 Countywide Small Cities Program. Joe Wheeler explained the program in detail. Motion by Dwelle, seconded by Windhorst to close the public hearing. Motion Carried.

Resolution 2008-021
Wabasha Countywide (excluding the Cities of Elgin, Lake City, and Wabasha).
Whereas: The Cities of Hammond, Kellogg, Mazeppa, Millville, Minneiska, Plainview, and Zumbro Falls have recognized a common problem in providing safe and sanitary housing, and providing for commercial building stabilization to the residents of these seven cities, and
Whereas: The Cities of Hammond, Kellogg, Mazeppa, Millville, Minneiska, Plainview, and Zumbro Falls have reviewed and endorse the Southeastern Minnesota Multi-County HRA Comprehensive Plan, and
Whereas: a significant waiting list for housing, rental, and commercial rehabilitation has been developed by the Southeastern Minnesota Multi-County HRA, and this waiting list is distributed among the cities as follows; City Housing Waiting List Commercial Waiting List Hammond 0 0 Kellogg 2 3 Mazeppa 6 3 Millville 1 0 Minneiska 0 0 Plainview 11 7 Zumbro Falls 3 2 Out County 2 1 TOTAL 25 16 and;
Whereas: The Cities of Hammond, Kellogg, Mazeppa, Millville, Minneiska, Plainview, and Zumbro Falls and the SEMMCHRA have agreed to utilize recaptured Revolving Loan Funds for housing rehabilitation activities and private lenders have committed funds to assist in housing, rental, and commercial rehabilitation; and
Whereas: Wabasha County has been invited by the Department of Employment & Economic Development to submit a full application on behalf of the Cities of Hammond, Kellogg, Mazeppa, Millville, Minneiska, Plainview and Zumbro Falls to provide housing, rental, and commercial rehabilitation as defined in the Small Cities Development Program Full Application, and such activities are to be completed within thirty (30) months of project award. Now Therefore
Be It Resolved, that all of the undersigned cities agree that Wabasha County is hereby designated as the official applicant/recipient for the 2008 Wabasha Countywide (excluding the cities of Elgin, Lake City, and Wabasha) Small Cities Development Program application to be submitted on or before January 31, 2008,
Be It Further Resolved that the undersigned cities recognize the need to deliver these funds on an equitable basis to the residents within the participating cities and also in a timely manner to comply with the grant delivery requirements. To assure availability to residents in all participating communities a preliminary unit goal has been developed and consists of the following goals by city : City Unit Goal Owner Rehab Unit Goal Commercial Rehab Hammond 1 1 Kellogg 2 2 Mazeppa 3 2 Millville 1 1 Minneiska 2 1 Plainview 3 3 Zumbro Falls 2 0 Out County 1 0 TOTAL 15 10 To achieve the Owner Occupied Rehabilitation goals the Cities’ rehabilitation policies will provide that direct contact with all those on the submitted waiting list occur upon grant award and allow up to December 31, 2008, for any owner rehabilitation applications to be submitted from residents of each community. After this date, the policies will allow applications for funds to be committed in from any location within the Cities of Hammond, Kellogg, Mazeppa, Millville, Minneiska, Plainview, and Zumbro Falls may be processed and funds for owner rehabilitation. In the event that applications are not received from a city, the grant administration policies shall allow that individual applications shall be processed on a ‘first-come-first-served’ basis to assure that all grant funds are delivered within the approved grant period. To achieve the Commercial Rehabilitation goals the Wabasha County SCDP Application rehabilitation policies will provide that direct contact with all those on the submitted commercial waiting list occur upon grant award and allow any commercial rehabilitation funds to be committed to properties in cities with a listed commercial rehab goal by December 31, 2008. After this date, the policies will allow applications for funds to be committed in any participating city willing to designate a "commercial rehabilitation project area" may be processed. In the event that a sufficient number of applications are not received, the grant administration policies shall allow that commercial rehabilitation applications shall be processed on a ‘first-come-first-served’ basis to assure that all grant funds are delivered within the approved grant period.
Be It Further Resolved that, if required by DEED, within two (2) months of grant award, the undersigned participating cities will agree to a Cooperative Agreement for the above outlined rehabilitation program. Any cities failing to agree to the Cooperative Agreement will become ineligible for participation under this rehabilitation program.

Resolution 2008-022
Be It Resolved that Wabasha County act as the legal sponsor for project(s) contained in the Business and Community Development Application to be submitted on January 31, 2008 and that the Board Chair and County Administrator are hereby authorized to apply to the Department of Employment and Economic Development for funding of this project on behalf of Wabasha County.
Be It Further Resolved that Wabasha County has the legal authority to apply for financial assistance, and the institutional, managerial, and financial capability to ensure adequate construction, operation, maintenance and replacement of the proposed project for its design life.
Be It Further Resolved that Wabasha County has not violated any Federal, State or local laws pertaining to fraud, briery, graft, kickbacks, collusion, conflict of interest or other unlawful or corrupt practice.
Be It Further Resolved that upon approval of its application by the state, Wabasha County may enter into an agreement with the State of Minnesota for the above referenced project(s), and that Wabasha County certifies that it will comply with all applicable laws and regulations as stated in all contract. Now, Therefore
Be It Resolved that the Board Chair and County Administrator, or their successors in office, are hereby authorized to execute such agreements, and amendments thereto, as are necessary to implement the project(s) on behalf of the Applicant.

McNALLAN - SPRINGER
Resolution No.: 2008-023
Whereas, the following applicant wishes to have its County On Sale and Sunday Liquor License approved: On Sale & Sunday Liquor WD’s Bar & Grill Inc The Hill Supper Club & Lounge Plainview Township, and
Whereas, the applicant does have current food & beverage licenses issued by Wabasha County Public Health, and
Whereas, the application has been approved by the County Attorney and County Sheriff. The Wabasha County Auditor/Treasurer has received a certificate of insurance and the appropriate license fee. The liquor license will run from February 1, 2008 to July 31, 2008. Now therefore
Be it resolved that Wabasha County Board of Commissioners hereby approves the Liquor License to the individual listed above, subject to the approval of the State of Minnesota Liquor Control Commissioner.

Whereas, the following applicant wishes to have his County On Sale and Sunday Liquor License approved: On Sale & Sunday Liquor Kevin Kautz Zumbro Falls Golf Course Zumbro Township
Whereas, the applicant does have current food & beverage license issued by Wabasha County Public Health, and
Whereas, the application has been approved by the County Attorney and County Sheriff. The Wabasha County Auditor/Treasurer has received a certificate of insurance and the appropriate license fee. The liquor license will run from April 1, 2008 to July 31, 2008. Now therefore
Be it resolved that Wabasha County Board of Commissioners hereby approves the Liquor License to the individual listed above, subject to the approval of the State of Minnesota Liquor Control Commissioner.

WINDHORST - McNALLAN
Resolution No: 2008-025
Whereas, the Wabasha County Board of Commissioners recognize that current GIS software is critical to the efficient processing and data entry of GIS maps, and;
Whereas, ESRI Software Maintenance is determined by the Wabasha County GIS Coordinator to be the most cost effective solution to receiving quality software and support, and;
Whereas, the Wabasha County Board of Commissioners has adopted the 2008 budget for GIS, and that $5,082 has been allocated for the purpose of continuing the software maintenance agreement with ESRI. Now Therefore
Be it Resolved, that the Wabasha County Board of Commissioners authorize the payment of $5,065 to ESRI for the purpose of GIS software support and maintenance.

Resolution No: 2008-026
Whereas, the Wabasha County Board of Commissioners recognize that aerial photography is a great asset to Wabasha County, and;
Whereas, the expected cost of proposed high resolution aerial photography for Wabasha County is expected to cost between $75,000 and $100,000, and;
Whereas, Minnesota law requires that all purchases over $50,000 require advertisement and a formal bid process.
Whereas, Wabasha County GIS, with assistance from the Wabasha County Attorney’s Office, has developed an RFP that is in compliance with state law, and will comply with other requirements posted in the Wabasha County Purchasing Policy and Minnesota Statutes 471.345. Now Therefore
Be it Resolved, that the Wabasha County Board of Commissioners authorize the request for proposals, and that proposals will be accepted until February 21st, at 2:00 PM. Ayes: Riester, Springer, Dwelle, Windhorst Nay: McNallan

Resolution No.: 2008-027
Whereas, the Wabasha County Administration Office will have a vacancy in the full-time position of IT Coordinator as of February 1st, 2008,
Whereas, the County Interim Administrator recommends the advertising the vacancy in order to solicit applications to fill the position, Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Wabasha County Interim Administrator is authorized to advertise the vacant position of IT Coordinator.
Adopted Unanimously with regrets Approve Proclamation that January is Mentoring Month for Wabasha County. Motion by Windhorst, seconded by McNallan.

McNALLAN - DWELLE
Resolution 2008-028
Whereas, an employee in the Veterans Service Office has requested to be placed on FMLA leave status, and
Whereas, if approved, the County Employee will be on extended leave, possibly through April 9, 2008, and
Whereas the Veterans Service Officer needs another staff member to run day-to-day operations, Now Therefore
Be it Resolved, the Wabasha County Board of Commissioners approves the Veteran Service Officer’s request to hire a temporary replacement while the employee is on FMLA status.

Chair Riester recognized Lisa Jaeger, VSO, who spoke on the need for obtaining a temporary secretary while her assistant is out on leave. Authorized Chair and Administrator, working with Assistant County Attorney, to review and act on a contract.
