Meeting of November 16, 2010
The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, November 16, 2010 at 6:00 p.m. The meeting was called to order by Board Chairman Dwelle. The following Commissioners were present: Windhorst, Dwelle, Riester, Norman and Hall.

Resolution No.: 2010-217
Whereas, the Wabasha County Zoning Ordinance, Article 3, Section 14B. Wind Generators was adopted as an amendment some 7 years ago.
Whereas, much has changed in the demand, technology, and information surrounding the development of Wind Energy Conversion Systems (WECS).
Whereas, our present ordinance was outdated and did not address today’s concerns and protection of the citizens and resources of Wabasha County.
Whereas the County Board of Commissioners on November 17, 2009 made a resolution to place a Moratorium on any Wind Energy Conversion System Applications and the construction of any such systems for one year and ordered the review and rewrite and of our existing ordinance of any proposed systems within the borders of Wabasha County is accomplished.
Whereas the staff in the Environmental Services department accomplished this task within the time frame as directed by the board. Therefore it be resolved that the revised document set forth by the Environmental Services Department staff be adopted as amended.

Resolution No: 2010-218
Whereas, Wabasha County accepted a quote from Qwest for moving 911 phone equipment to the new facility and;
Whereas, Qwest provided the necessary equipment and labor to accomplish the required move to the new facility.
Whereas, the Wabasha County Sheriff’s Office is hereby requesting payment in the amount of $9,041.63 be paid from Building funds. Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: The Wabasha County Board of Commissioners hereby authorizes payment to Qwest in the amount of $9,041.63.
Be it further Resolved that this payment be paid from Building Funds.

Resolution No.: 2010-219
Whereas, the Director of Social Services has provided detailed information to the Human Services Board on the vehicles available through the State bid contract; and
Whereas, funds for the replacement vehicles are available from one-time funding through South Country Health Alliance (SCHA); and Whereas, the Malibu used by Public Health Services is no longer operating; and
Whereas, the 2008 Grand Caravan will to be moved to the general county car pool upon purchase of the 2011 Ford Fusion; and
Whereas, the purchase of vehicles by the Department of Social Services provides the highest level of reimbursement and is cost-effective;
Whereas, the Directors of Public Health Services and Social Services recommend the purchase of two 2011 Ford Fusions and transfer of the 2008 Grand Caravan to the general car pool; and
Whereas, Wabasha County Policy requires capital purchases approved by the Human Services Board to also be approved by the Wabasha County Board of Commissioners;
Whereas, the Human Services Board has recommended approval of this purchase; and
Now, therefore be it resolved, the Wabasha County Board of Commissioners hereby approves the purchase of two 2011 Ford Fusions at a cost of $15,759.43 (plus cost for second set of keys), as bid by Tom Heffernan Ford of Lake City.

Whereas, Wabasha County has advertised, taken and reviewed applications and conducted interviews for one vacant Highway Maintenance Worker Position,
Now Therefore be it Resolved that the Wabasha County Board of Commissioners hereby authorizes the hiring of James Webster as a Highway Maintenance Worker.

Resolution No. 2010-221
Whereas, Wabasha County must enter into a grant agreement with the State of Minnesota Division of Homeland Security and Emergency Management and the Minnesota Department of Natural Resources; and
Whereas, the Southeastern Minnesota Multi-County Housing and Redevelopment Authority (SEMMCHRA) has the financial, technical, and managerial capacity to ensure proper construction, operation and maintenance of the project for its design life; and
Therefore Be It Resolved By the Wabasha County Board of Commissioners of Wabasha County that the County is selecting the Southeastern Minnesota Multi-County Housing and Redevelopment Authority (SEMMCHRA) as the administrative entity for the complete buyout, property elevation, and house only buyout program.
Be It Further Resolved That the SEMMCHRA Executive Director is authorized to execute the grant agreement on behalf of the County.

Resolution No. 2010-222
Whereas, Under the FEMA Disaster Assistance Policy (DAP 9523.4) Wabasha County has the authority to take the necessary steps to alleviate health and safety threats in the County; and
Whereas, Wabasha County has identified the need to remove flood-damaged mobile homes; and unsafe structures which endanger the life and property resulting form a major disaster; and
Whereas, Wabasha County, as the Local Government Unit (LGU), has the financial, technical, and managerial capacity to ensure demolition of private structures; and
Therefore Be It Resolved By the Wabasha County Board of Commissioners that they shall serve as the LGU for the demolition and debris program under the guidance of the FEMA Disaster Assistance Policy.
Be It Further Resolved That Wabasha County is authorized to administer the demolition and debris program through the FEMA Disaster Assistance Program.

Resolution No.: 2010-223
Whereas, the County of Wabasha experienced a disaster on September 23-24, and;
Whereas, said disaster caused extensive property damage to residential and/or agricultural properties in the County of Wabasha, and; Whereas, the County of Wabasha has been declared a disaster area by Presidential declaration, and;
Whereas, Minnesota Statutes, section 273.1234 provides for property tax relief upon reassessment of homestead properties damaged by disaster upon application to the Governor of the State of Minnesota and the Executive Council, and;
Whereas, the minimum requirements of the aforementioned statute have been met.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners requests that the homestead property damage from the disaster that occurred on September 23-24 be reassessed for the purpose of the Homestead Disaster Credit under the provisions of Minnesota Statutes, section 273.1234.

Resolution No.: 2010-224
Whereas, the County is mandated under State fire codes to secure a specific fire inspection and maintenance services, and;
Whereas, Wabasha County presently has four contracts with three separate vendors for the prescribed services totaling more than $7,000 per year, and;
Whereas, these services can be consolidated into a single contract with one vendor at a savings in excess of $1,300 per year.
Now Therefore be it Resolved by the Wabasha County Board of Commissioners that a contract with Summit Fire Protection in the amount of $5,654 annually for smoke alarm, fire alarm, sprinkler, CO2, kitchen hood, and fire extinguisher inspection and maintenance
