Meeting of May 17, 2011

 

The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, May 17, 2011 at 9:00 a.m.

 

The meeting was called to order by Board Chairman Norman.

The following Commissioners were present: Norman, Hall, Roschen, Wobbe, Harms

Resolution No.: 2011-102

Whereas, the county seeks to reduce costs and operate more efficiently, and;

Whereas, Laser Product Technologies, Inc. has developed a proposal to manage, maintain and supply our printers, and;

Whereas, the information obtained through this service will enable us to make better informed decisions about printing and encourage greater efficiency and reduced costs, and;

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the County Administrator be authorized to sign the 2 year agreement with Laser Product Technologies, Inc.

Resolution No.: 2011-103

Whereas, Wabasha County Public Health Service (WCPHS) has the opportunity to offer funding to help improve the health of Wabasha County residents through the Statewide Health Improvement Program (SHIP);

Whereas, the Wabasha County Regional Rail Authority (WCRRA) could work in partnership with WCPHS to implement the goals of the SHIP grant;

Now, Therefore be it Resolved that the Wabasha County Board issues the following order:

1. Wabasha County finds it beneficial to allow the WCRRA to receive SHIP funding;

2. That the WCPHS agrees to provide SHIP funding in the amount of $4,964.51 to the WCRRA;

3. That in return for said funding the WCRRA agrees to provide the services outlined in the "CONTRACT to Implement SHIP Intervention C-PA-C1" that will be entered into by both parties;

Resolution No.: 2011-104

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Wabasha County Highway Department be authorized to purchase one Ford F250 in an amount of $23,020 from Tom Heffernan Ford and hereby authorizes the County Auditor/Treasurer to issue warrants for applicable sales tax and license fees of the truck.

Be it further resolved that the Wabasha County Board of Commissioners hereby declares Unit 941 – GMC Pickup as Excess Equipment and authorizes the County Engineer to dispose at a consignment auction.

Resolution No.: 2011-105

Whereas, the Wabasha County Board has, by resolution, authorized the County Engineer to acquire the necessary lands along the existing right of way of County State Aid Highway 4 for the purpose of reconstructing the highway under S.P. 079-604-044; and

Whereas, S.P. 079-604-044 is necessary in order to improve this segment of County State Aid Highway 4 to meet Minnesota State Aid standards and provide for public health, welfare, safety and convenience; and

Whereas, Wabasha County has been unable to successfully negotiate the acquisition of the following necessary lands:

Owner: Donald J. Lee and Virginia M. Lee Co-trustees of Donald J. Lee Revocable Trust and Michael J. Lee and Marcie J. Lee

Described as follows: That part of the Northwest Quarter of the Southeast Quarter and Southwest Quarter of the Southeast Quarter of Section 20, Township 108 North, Range 11 West, shown as Parcel 15 on Wabasha County Right of Way Plant No. 40 on file in the office of the County Recorder in and for Wabasha County, Minnesota;

Containing 4.17 acres more or less of which 1.95 acres more or less is existing right-of-way previously acquired by written instrument or by prescription and 2.22 acres more or less is new Highway Right of Way.

Together with other rights as set forth below:

A temporary construction easement over, under and across that part of the above described lands not acquired herein. Said temporary easement is for the right to construct back slopes, shoulder slopes, ditches and entrances outside of the Platted Right of Way. Said Temporary Easement expires on December 31, 2013 and contains 0.13 acres, more or less, as shown on plans on file in the Wabasha County Engineers Office.

Whereas, Wabasha County has the authority to acquire the necessary lands for this project by eminent domain.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the County Attorney is hereby authorized to commence eminent domain proceedings for the acquisition of said lands.

ROSCHEN - HALL

Resolution No.: 2011-106

Whereas, Blitz Construction is the lowest responsible bidder for S.A.P. 079-608-012.

Now Therefore be it Resolved that the Wabasha County Board of Commissioners hereby accepts the bid of Blitz Construction on Contract No. 11007 for S.A.P. 079-608-012 in the amount of $717,488.63 and that the Chairman of the County Board and the County Administrator are hereby authorized to execute a Contract with Blitz Construction for this work.

Resolution No.: 2011-107

Now Therefore be it Resolved that the Wabasha County Board of Commissioners hereby authorizes the County Highway Engineer to hire the following applicants for 2011 Part-Time Temporary Summer Employment at $10.00/hour; Jason Straskowski, and at $9.50/hour; Blaine Miller and Michael Pick.

Resolution No.: 2011-108

Be it resolved by the Wabasha County Board of Commissioners that Wabasha County enter into the attached Sub-Grant Agreement with the State of Minnesota acting through its Commissioner of Public Safety, Division of Homeland Security and Emergency Management, and .

Be it further resolved that the Chairman of the Wabasha County Board of Commissioners and County Administrator are hereby authorized to execute the attached Sub-Grant Agreement on behalf of Wabasha County.

Resolution No.: 2011-097

Whereas, the Planning Commission held a public hearing on April 25, 2011 and reviewed the Conditional Use Permit Application by Michael LaVigne, 65 ASHLEY LANE, ELGIN MN 55932 for a commercial business, in accordance with Article 9, Section 3, Subd. 23 of the Wabasha County Zoning Ordinance. The request involves the following described property:

Parcel # 12.00340.03

56170 278TH Avenue Plainview MN 55964 The West 470 feet of the North 470 feet of the SE ¼ of the SW ¼, Section 35, T.109 N. – R.12W (Oakwood Township).

Whereas, the Planning Commission approved the request 5-0 and recommends approval from the County Board with the following conditions: Mr. LaVigne gets proper building permit and inspection on Ag building.

Now therefore be it resolved that the Wabasha County Board of Commissioners approves the Conditional Use request with listed conditions.

No action taken; 60-day extension granted.

Resolution Number: 2011-109

Whereas, the Planning Commission held a public hearing on April 25, 2011 and reviewed the Conditional Use Application by William Fitzgerald, 16489 South County Road 24, Wabasha MN 55981 The purpose of the hearing was to consider an Application to Rezone. The request involves the following described property:

Parcel # 05.00223.00

W1/2 of NE1/2 Section 24, T.110 N. – R.10 W. (Greenfield Township)

The application is a request to rezone 80 acres of land from A-1, Ag Protection Classification to R-1, Rural Residential Classification under Article 17. Section 2 Subd.of the Wabasha County Zoning Ordinance.

Whereas, the Planning Commission approved the request 5-0 and recommends approval from the County Board with the following conditions: None

Now therefore be it resolved that the Wabasha County Board of Commissioners approves the Rezone Request.

Resolution No.: 2011-110

Whereas, the Planning Commission held a public hearing on April 25, 2011 and reviewed the Conditional Use Permit Application by William Fitzgerald, 16489 South County Road 24, Wabasha MN 55981 The purpose of the hearing is to consider an Application for a Preliminary Plat. The request involves the following described property:

Parcel # 05.00223.00

W1/2 of NE1/2 Section 24, T.110 N. – R.10 W. (Greenfield Township)

The application is for a preliminary plat on 80 acres of land as per the Wabasha County Subdivision Ordinance.

Whereas, the Planning Commission approved the request 5-0 and recommends approval from the County Board with the following conditions:

1) Miner road information and adjustments as recommended by the County Engineer.

2) Drainage and stormwater containment as recommended by the County Engineer and SWCD staff i.e. permanent storm water storage, and define drainage outlets.

Now therefore be it resolved that the Wabasha County Board of Commissioners approves the Conditional Use request with listed conditions.

Resolution No.: 2011-111

A Flood Hazard Mitigation Grant Agreement was entered into between the State of Minnesota, acting by and through its Commissioner of Natural Resources (hereinafter the "State") and Wabasha County, Minnesota, 625 Jefferson Avenue, Wabasha, Minnesota 55981 (hereinafter the "Grantee").

Whereas, the State is authorized by Laws of Minnesota, 2010, Second Special Session, Chapter 1, Article 1, Section 9, Subdivision 4, to provide flood response and recovery grants to local units of government for removal of flood debris from public waters resulting from the floods of September 2010; and

Whereas, the Grantee has submitted an application to the State for an In-stream Debris Removal grant; and

Whereas, the State has determined that the Grantee should receive In-stream Debris Removal assistance; and

Whereas, the Grantee represents that it is duly qualified and willing to perform the services set forth herein.

Whereas, Environmental Services, upon entering into the grant, entered into a partnership with Minnesota DNR for boats and motors and with Workforce Development to supply the needed labor,

Whereas the DNR provided the boats and WorkForce Development could not come up with the required labor force for the project

Now Therefore be it resolved that the Wabasha County Board of Commissioners approves the request to hire up to 6 summer students for up to 12 weeks or upon depletion of the grant funding.
