Wabasha County Board of Commissioners Meet of June 7, 2011
The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, June 7, 2011 at 9:00 a.m.
The meeting was called to order by Board Chairman Norman. The following Commissioners were present: Norman, Hall, Roschen, Wobbe, Harms
HARMS - WOBBE Motion to approve the agenda. Adopted Unanimously Commissioners reported on meetings they attended. HALL - HARMS Motion to approve the consent agenda including the following: Claims Meal Vouchers SSIS Claims Minutes: May 24, 2011 Adopted Unanimously ROSCHEN – HALL Resolution No.: 2011-116 Whereas, Wabasha County would like to submit an application to the Minnesota Department of Public Safety – Homeland Security and Emergency Management through the Hazard Mitigation Grant Program property acquisition projects; and, Whereas, the Southeastern Minnesota Multi-County Housing and Redevelopment Authority (hereinafter referred to as HRA) has the staff capability to prepare and submit an application for the Hazard Mitigation Grant Program for Wabasha County; Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Board of Commissioners of Wabasha County authorizes County Administrator David Johnson and the HRA Executive Director, Joseph P. Wheeler to submit an application to the Minnesota Department of Public Safety- Homeland Security and Emergency Management. Adopted Unanimously HALL – ROSCHEN Resolution No.: 2011-117 Now Therefore be it Resolved by the Wabasha County Board of Commissioners that Wabasha County enter into a sub-grant agreement with the Division of Homeland Security and Emergency Management in the Minnesota Department of Public Safety for the program entitled Hazard Mitigation Assistance Program for Presidential Disaster Declaration FEMA 1941-DR-MN. Joseph P. Wheeler, SEMMCHRA Executive Director, and David Johnson, Wabasha County Administrator, are hereby authorized to execute and sign such sub-grant agreements and any amendments hereto as are necessary to implement the project on behalf of Wabasha County. Adopted Unanimously HALL - HARMS Resolution No.: 2011-127 Whereas, Wabasha County would like to submit an application to the Minnesota Department of Natural Resources through the Flood Damage Reduction Grant Program for property acquisition projects, and; Whereas, the Southeastern Minnesota Multi-County Housing and Redevelopment Authority (hereinafter referred to as HRA) has the staff capability to prepare and submit an application for the Flood Damage Grant Program for Wabasha County; Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Board authorizes County Administrator David Johnson and the HRA Executive Director, Joseph P. wheeler to submit an application to the Minnesota Department of Natural Resources. Adopted Unanimously HARMS - WOBBE Resolution No.: 2011-118 Whereas, Wabasha County has applied to the Commissioner of Transportation for a grant for 2010 Local Road and Bridge Disaster Relief, and Whereas, the Commissioner of Transportation has given notice that funding for this Project is available, and Whereas, the amount of the grant has been determined to be $1,146,033, and Whereas, the State of Minnesota requires the attached 2010 Local Road and Bridge Disaster Relief Grant Agreement be executed by Wabasha County in order to receive the necessary funds for this Project. Now Therefore Be It Resolved by the Wabasha County Board of Commissioners that Wabasha County does hereby agree to the terms and conditions of the grant and attached Agreement. Be it further resolved that the Chairman of the Wabasha County Board of Commissioners and County Administrator are hereby authorized to execute the attached 2010 Local Road and Bridge Disaster Relief Grant Agreement on behalf of Wabasha County. Adopted Unanimously ROSCHEN - HARMS Resolution No.: 2011-119 Be it resolved by the Wabasha County Board of Commissioners that pursuant to Minnesota Statute 161.36, the Commissioner of Transportation be appointed as Agent of Wabasha County to accept as its agent, federal aid funds which may be made available for eligible transportation related projects. Be it further resolved by the Wabasha County Board of Commissioners that the County Board Chair and the County Administrator are hereby authorized and directed for and on behalf of the County to execute and enter into an agreement with the Commissioner of Transportation prescribing the terms and conditions of said federal aid participation as set forth and contained in "Minnesota Department of Transportation Agency Agreement No. 98907", a copy of which said agreement was before the County Board and which is made a part hereof by reference. Adopted Unanimously ROSCHEN - HALL Resolution No.: 2011-120 Now Therefore be it Resolved that the Wabasha County Board of Commissioners hereby authorizes the County Engineer to purchase concrete culvert repair services for an existing concrete box culvert underneath County Highway 33 including labor and materials from Mike Cronin Concrete. Adopted Unanimously WOBBE - HARMS Resolution No.: 2011- 121 Whereas, the County of Wabasha is planning to construct SP 088-070-025 in the year 2011, which has been programmed by the ATP in the STIP or work plan for the year 2011, and Whereas, said County is prepared to proceed with the construction of said project through the use of an advance from the County State Aid Highway Fund to supplement the available funds expected Federal Aid funds, and Whereas, repayment of the funds so advanced will be made from Federal funds no later than the year in which the ATP has programmed the project. Now, therefore be it resolved by the Wabasha County Board of Commissioners that the Commissioner of Transportation be and is hereby requested to approve this advance for financing SP 088-070-025 of the County of Wabasha in an amount up to $1,152,794 in accordance with Minnesota Rules 8820.1500, Subp. 9, and to authorize repayments from Federal Aid funds. Adopted Unanimously WOBBE – HARMS Recessed Reconvened at 11:25 a.m. Adopted Unanimously HARMS - HALL Resolution No.: 2011-122 Whereas, the Wabasha County Human Services Board has previously entered into a Chemical Health Care Home Pilot Services Grant Contract with the Minnesota Department of Human Services, providing chemical health services to individuals on a voluntary basis; and Whereas, the Chemical Health Care Home Pilot Services Grant is providing chemical health services to individuals in the 10 counties of Southeast Minnesota and Washington County; and Whereas, the participating counties and the Department of Human Services have agreed to extend the Pilot project for the State Fiscal Years 2012-2013; and Whereas, the Director of Social Services has recommended approval of the contract amendment; Now, therefore be it resolved by the Wabasha County Board of Commissioners to accept the recommendation of the Social Services Director, extending the Chemical Health Care Home Pilot Services Grant through the State Fiscal Year, ending June 30, 2013. The Board further authorizes the Director of Social Services and County Administrator to execute the contract amendment on behalf of the Wabasha County Board of Commissioners. Adopted Unanimously HALL - ROSCHEN Resolution No.: 2011-123 Now Therefore be it Resolved by the Wabasha County Board of Commissioners that they hereby appoint to the Wabasha County Board of Adjustment, Mike Wallerich, effective on this date, with said appointment to expire on the first Tuesday after the first Monday in January, 2013. Abstained: Wobbe Adopted HALL - HARMS Resolution No. 2011-124 Be It Resolved that the Wabasha County Board of Commissioners hereby authorizes payment from the Feedlot V Low Cost Share Fix 319 Grant for Jack Stamschror in the amount of $3,000.00 Adopted Unanimously ROSCHEN - WOBBE Resolution No.: 2011-125 Whereas, Minnesota State Statute 259.11(b) states when a person applies for a name change Courts shall determine if the person has a criminal history in this or any other state and the Court may conduct a search of National records through the FBI. A Court that has access to the Criminal Justice Data Communication Network (CJDN) operated by the State of Minnesota Bureau of Criminal Apprehension may also directly conduct a check via the CJDN, a court without CJDN access may also have a law enforcement agency perform the search via the CJDN access provided the agency and the Court have an agreement in place to perform such searches and protect the search data, and; Whereas, a joint powers agreement is necessary for this to take place. Now Therefore be it Resolved by the Wabasha County Board of Commissioners that a joint powers agreement between the Wabasha County Sheriff's Office and the State of Minnesota Third Judicial District be approved for this purpose. Adopted Unanimously ROSCHEN - HALL Resolution No.: 2011-126 Whereas, Wabasha County advertised for bids for the demolition of the Old Jail/Sheriff's Office, and; Whereas, four bids were received from three bidders, and; Whereas, Landwehr Excavating of St. Cloud, Minnesota was the lowest responsible and responsive bidder with a bid in the amount of $93,410 if materials are taken to the La Crosse Landfill and $76,410 if the materials are taken to the Austin Landfill. Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the bid from Landwehr Excavating of St. Cloud in the amount of $76,410 be accepted and the County Administrator is directed to authorize the work to start as soon as possible.
