The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, August 16, 2011 at 9:00 a.m.

 

The meeting was called to order by Board Chairman Norman.

Resolution No.: 2011-164

Whereas, the County of Wabasha on behalf of its County Attorney and Sheriff desires to enter into Joint Powers Agreements with the State of Minnesota, Department of Public Safety, Bureau of Criminal Apprehension to use systems and tools available over the State's criminal justice data communications network for which the County is eligible. The Joint Powers Agreements further provide the County with the ability to add, modify and delete connectivity, systems and tools over the five year life of the agreement and obligates the County to pay the costs for the network connection.

Now, Therefore, be it Resolved by the County Board of Wabasha, Minnesota as follows:

1. That the State of Minnesota Joint Powers Agreements by and between the State of Minnesota acting through its Department of Public Safety, Bureau of Criminal Apprehension and the County of Wabasha on behalf of its County Attorney and Sheriff are hereby approved. Copies of the two Joint Powers Agreements are attached to this Resolution and made a part of it.

2. That the PSAP/TAC Supervisor, Blaine John Hentz, or his or her successor, is designated the Authorized Representative for the Sheriff. The Authorized Representative is also authorized to sign any subsequent amendment or agreement that may be required by the State of Minnesota to maintain the County's connection to the systems and tools offered by the State.

To assist the Authorized Representative with the administration of the agreement, PSAP/TAC Supervisor Blaine John Hentz is appointed as the Authorized Representative's designee.

3. That the Wabasha County Attorney, James Nordstrom, or his or her successor, is designated the Authorized Representative for the County Attorney. The Authorized Representative is also authorized to sign any subsequent amendment or agreement that may be required by the State of Minnesota to maintain the County's connection to the systems and tools offered by the State.

To assist the Authorized Representative with the administration of the agreement, Wabasha County Attorney James Nordstrom is appointed as the Authorized Representative's designee.

4. That Merl Norman, the Chair of the County of Wabasha, and David Johnson, the Wabasha County Administrator, are authorized to sign the State of Minnesota Joint Powers Agreements.

Resolution No: 2011-165

Whereas, the Wabasha County Sheriff's Office has been invited to participate and renew the Minnesota Internet Crimes Against Children Task Force Joint Powers Agreement; and

Whereas, the Sheriff's Office has received the 2011-2012 grant agreement which needs to be approved and signed by the Sheriff and County Board Chairperson; and

Whereas, the Sheriff requests the approval and signing of the 2011-2012 Minnesota Internet Crimes Against Children Task Force Joint Powers Agreement by the Chairman of the County Board.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: the 2011-2012 Minnesota Internet Crimes Against Children Task Force Joint Powers Agreement is hereby approved and authorizes it's signing by the Sheriff and Chairman of the County Board.

Resolution No.: 2011-166

Whereas, Wabasha County Emergency Management develops and maintains a county-wide All-Hazard Emergency Operations Plan (EOP) that must contain at least 18 Superfund Amendments and Reauthorization Act of 1986 (SARA) Title III items listed in the Local Emergency Operations Plan Crosswalk;

Whereas, said EOP is updated and reviewed yearly by a 4-year-cycle review process developed by the Minnesota Division of Homeland Security and Emergency Management;

Be it Resolved, that the Wabasha County Board of Commissioners hereby authorizes execution of the 2011 Wabasha County All-Hazard Emergency Operations Plan (EOP) with its revisions and updates by signing the EOP Certification of Plan Approval page.

Resolution No.: 2011-167

Whereas, Wabasha County is obligated to maintain County State Aid Highways within cities throughout the County, and

Whereas, it is more expedient for the citizens of the listed cities to have those cities perform the maintenance activities of snow and ice control and removal, and sweeping and removal of debris.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the County of Wabasha enter into the attached agreements for the maintenance activities described above with the City of Elgin, Kellogg, Mazeppa, Millville, Plainview and Wabasha, and authorizes the Chairman of the Board and County Administrator to execute the Agreements. The table below is a summary of the mileages and payment amounts of the agreements.

Resolution No.: 2011-168

Whereas, Hoffman Construction Company is the lowest responsible bidder for S.P. 055-610-021, S.P. 079-604-044, S.A.P. 055-610-023 and S.A.P. 079-604-047.

Now Therefore be it Resolved that the Wabasha County Board of Commissioners hereby accepts the bid of and awards a Contract to Hoffman Construction Company for S.P. 055-610-021, S.P. 079-604-044, S.A.P. 055-610-023 and S.A.P. 079-604-047 Minn. Project No. STPX 8811(258) – Grading, Aggregate Base, Concrete Surface, Bridge 55J81 and 79548 - in the amount of $6,570,108.28 and that the Chairman of the County Board and the County Administrator are hereby authorized to execute a Contract with Hoffman Construction Company for this work.

Resolution No.: 2011-169

Whereas, Wabasha County owns real estate shown on Wabasha County Right of Way Plat No. 41 as shown as Parcel A, B, C and D; and

Whereas, the real estate described as Parcel A, B, C, and D will no longer be necessary for County highway purposes upon completion of State Aid Project 079-607-021; and

Whereas, Wabasha County has the authority to sell real estate owned by the County; and

Whereas, before selling real estate owned by Wabasha County property the advertisement for bids needs to be published.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Wabasha County Administrator be authorized to advertise for bids for the aforementioned real estate described as attached as Parcel A, B, C and D upon the completion of S.A.P. 079-607-021.

Be it further resolved by the Wabasha County Board of Commissioners that the proceeds from the sale of the above described property be directed to the County Road and Bridge Fund.

Resolution No.: 2011-170

Whereas, the Wabasha County Highway Department proposes to acquire land along the existing right of way of County State Aid Highway 7 for the purpose of replacing Bridge 6563 under S.A.P. 079-607-021; and

Whereas, S.A.P. 079-607-021 is necessary in order to improve this segment of County State Aid Highway 7 to provide for public health, welfare, safety and convenience; and

Whereas, the lands necessary to be acquired for S.A.P. 079-607-021 are described in Wabasha County Highway Right of Way Plat No. 41.

Now therefore be it resolved that the Wabasha County Board of Commissioners hereby accepts Wabasha County Highway Right of Way Plat No. 41, designating the definite location of the right of way.

Be it further resolved, that the Wabasha County Board of Commissioners hereby authorizes the County Highway Engineer to proceed to acquire the necessary lands as described in Wabasha County Highway Right of Way Plat No. 41 in accordance with applicable laws and statutes.

Resolution No.: 2011-171

Whereas, the Wabasha County Jail is beginning the demolition process, and;

Whereas, the Board expressed interest in salvaging the old stone Wabasha County Jail sign, and directed the County Administrator to secure pricing for the salvage, and;

Whereas, a quote was obtained from Landwehr Construction in the amount of $3,500 for this salvage.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that Landwehr Construction be authorized payment in the amount of $3,500 for the removal of the aforementioned jail sign.

Resolution No.: 2011-172

Whereas, the concrete block wall along the sidewalk in front of the Wabasha County Services Building has deteriorated significantly and is need of replacement, and;

Whereas, the County Administrator was asked to obtain quotes for replacement of the wall, and;

Whereas, quotes were obtained for a DOT block wall and poured concrete wall, and;

Whereas, the DOT block wall was significantly less expensive, with the same life expectancy as the poured wall, with the quotes ranging from $9,056.52 to $15,120 for the block wall.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the quote from Danckwart Landscaping in the amount of $9,056.52 be accepted and the existing wall replaced.

Resolution No.: 2011-174

Whereas, the Wabasha County Sheriff's Office is requesting authorization to purchase a APX dual-band portable radio per county purchase policy #19 (over $5,000.00); and,

Whereas, Motorola provided a bid thru state contract pricing; and,

Whereas, the cost incurred in this purchase is quoted at $6,549.55, plus shipping and handling; and,

Whereas, the monies for this purchase will come from the 911 (291 account) and reimbursed by 2008 HSEM Grant (no match) and 2007 PSIC Grant (20% match) monies;

Whereas, this grant expires August 31, 2011 and all requirements must be met on or before this date in order to receive reimbursement (no exceptions!).

Whereas, the Sheriff requests approval for the Auditor's Office to cut an Auditor's Warrant in the amount of $6,549.55 plus shipping and handling regarding Motorola invoice quote (total is unknown at this time).

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: The Sheriff's Office is hereby authorized to purchase (1) APX Dual-Band Portable Radio.

Be it further Resolved by the Wabasha County Board of Commissioners that: The Auditor's Office is hereby authorized to cut an Auditor's Warrant once the final invoice amount is received. This amount will not exceed $6,549.55, plus shipping and handling.

Be it further Resolved by the Wabasha County Board of Commissioners that: The funding will come from the 911 (01-291) account.
