The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, October 18, 2011 at 9:00 a.m.

 

The meeting was called to order by Board Chairman Norman.

 

The following Commissioners were present: Norman, Hall, Roschen, Wobbe, Harms

Resolution No.: 2011-216

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the continued increasing cost of the employment contract is no longer affordable to the county. The board needs to decrease the 2012 expenses approximately $693,000 to meet its goal of a 0% increase. Therefore we opt to terminate the employment contract with County Administrator David Johnson.

Resolution No.: 2011-217

Whereas, Wabasha County currently requires all county employee's to enroll in a health insurance plan ("Insurance Plans");

Whereas, the board of commissioners is interested in giving county employees the right to opt out of the county's offered Insurance Plans;

Whereas, the savings associated with such a provision could prove to be economically beneficial to the county;

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that:

Wabasha County shall allow its employees to have the right to opt out of the county's offered Insurance Plans during the times of open enrollment. It is understood that nothing in this resolution would change the level of service provided under the current Insurance Plans, but rather gives employees the right to choose to not participate in the Insurance Plans.

Resolution No. 2011-218

BE IT RESOLVED that the Wabasha County Board of Commissioners hereby authorizes payments in the amounts listed below:

$35,360.12 from the MN Board of Water and Soil Resources Clean Water Grant funds to the Jon Wallerich feedlot water quality fix project

$15,000.00 from the 319 low cost cost share program to the Jon Wallerich feedlot water quality fix project

$4,000.00 and $8200.00 for final payment once money is allocated to the county through B.W.S.R. for the Stelling and Wallerich projects.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that they appoint Commissioner Wobbe to the LaCrosse County Landfill Board for the remainder of the calendar year.

WOBBE - HARMS

Resolution No.: 2011-220

Whereas, Public Health is required to provide communicable disease activities, and

Whereas, Minnesota Dept. of Health is offering a grant to assist with the expenses of providing perinatal hepatitis B care coordination and Immunization Improvement Programming with the Medical Clinics located within our county.

Now Therefore be it Resolved, by the Wabasha County Board of Commissioners that: the Perinatal Hepatitis B and IPI grant offered by Minnesota Department of Health be accepted.

Resolution No.: 2011-208

Whereas, Wabasha County Sheriff's Office is requesting authorization to purchase a Network Management Terminal to support the ARMER 800mhz radio system; and

Whereas, this purchase will be made through Motorola under state contract pricing; and

Whereas, the cost incurred in this purchase is bid at $16,395.00; and

Whereas, the monies for this purchase will be paid through 911 ARMER (01-291-216) account and reimbursed through the State Local Enhancement Grant (50% match);

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: The Wabasha County Sheriff's Office is hereby authorized to purchase said Network Management Terminal from Motorola, at a cost not to exceed $16,395.00.

Be it further resolved that: funding of this upgrade will come from the 911 ARMER (01-291-216) Account and reimbursed through the State Local Enhancement Grant at a 50% match.

ROSCHEN - WOBBE

Resolution No: 2011-221

Whereas, The Wabasha County Sheriff Office is requesting to approve the City of Mazeppa Police Services Contract commencing January 1, 2012. This is an open contract and will not terminate unless terminated by either party upon 60 days prior notice to the other party in writing. Please see attached contract document.

Whereas, Each year is figured at a 2.5% increase.

Whereas, There has been no change in the language or conditions in the contract except for the 2.5% increase and it being an open contract vs. a 3-year contract as previously defined.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: the Wabasha County Board of Commissioners approve the City of Mazeppa Police Services Contract effective January 1, 2012.

Resolution No.: 2011-222

Whereas, Wabasha County has applied to the Commissioner of Transportation for a grant from the Minnesota State Transportation Fund for construction of Bridge 79548 on County State Aid Highway 4 under S.A.P. 079-604-047, and

Whereas, the Commissioner of Transportation has given notice that funding for this Project is available, and

Whereas, the amount of the grant has been determined to be $303,328 by reason of the lowest responsible bid, and

Whereas, the State of Minnesota requires the attached General Obligation Bond Proceeds Grant Agreement – Construction Grant for S.A.P. 079-604-047 be executed by Wabasha County in order to receive the necessary funds for this Project.

Now Therefore Be It Resolved by the Wabasha County Board of Commissioners that Wabasha County does hereby agree to the terms and conditions of the grant and attached Agreement consistent with Minnesota Statutes; 174.50, subdivision 5, clause (3), and will pay any additional amount by which the cost exceeds the estimate, and will return to the Minnesota State Transportation Fund any amount appropriated for this Project but not required.

Be it further resolved that the Chairman of the Wabasha County Board of Commissioners and County Administrator are hereby authorized to execute the attached General Obligation Bond Proceeds Grant Agreement – Construction Grant and Declaration on behalf of Wabasha County.

Resolution No.: 2011-223

Whereas, the Commissioner of Transportation has given notice that funding for this Project is available, and

Whereas, the amount of the grant has been determined to be $1,484,920 by reason of the lowest responsible bid, and

Whereas, the State of Minnesota requires the attached General Obligation Bond Proceeds Grant Agreement – Construction Grant for S.A.P. 079-607-021 be executed by Wabasha County in order to receive the necessary funds for this Project.

Now Therefore be it Resolved that the Wabasha County Board of Commissioners hereby authorizes the Wabasha County Engineer to apply for grants for the repair and mitigation of flood damage as may be available and applicable.

Resolution No.: 2011-225

Whereas, Minnowa Construction Inc. is the lowest responsible bidder for S.A.P. 079-607-021.

Now Therefore be it Resolved that the Wabasha County Board of Commissioners hereby accepts the bid of and awards a Contract to Minnowa Construction Inc. for S.A.P. 079-607-021 – Bridge 79550 and Approaches - in the amount of $1,692,764 and that the Chairman of the County Board and the County Administrator are hereby authorized to execute a Contract with Minnowa Construction Inc. for this work.

Resolution No. 2011-226

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Wabasha County Highway Engineer be authorized to advertise for bids for Project S.A.P. 079-599-076.

Now Therefore be it Resolved that the Wabasha County Board of Commissioners hereby adopts the Mailbox Installation and Support Policy.

ROSCHEN - HALL

Resolution No.: 2011-228

Now Therefore be it Resolved that the Wabasha County Board of Commissioners hereby authorizes the Wabasha County Engineer to make the necessary sidewalk and curb and gutter replacements along County Highway 56 at and near the Lyons' property in Plainview.

Resolution No.: 2011-229

Whereas, there is an Agreement between All American Cooperative and the Wabasha County Board of Commissioners; and

Whereas, the Agreement states the existing trail will be allowed to stay open until the new asphalt trail in complete; and

Whereas, the Agreement also states that all improvements under the Agreement are to be completed by May 16, 2012; and

Whereas, at this time the above conditions are not in the best interest of the County.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Agreement be revised as follows:

1. The existing trail be closed and detoured for that portion of the trail proposed to be relocated upon the start of site work for the proposed development on All-American's property or the agreed upon trail relocation. The existing trail shall be closed and detoured in accordance with the Minnesota Manual on Uniform Traffic Control Devices. It is the responsibility of All-American to maintain all traffic control devices used for the detour of the trail for the duration of the detour.

2. All trail relocation work shall be completed by June 1, 2012 barring unforeseeable delays that could not be overcome with reasonable adjustments to construction activities and progress, as determined by Wabasha County.
