Meeting of May 8, 2012

 

The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, May 8, 2012 at 9:00 a.m.

 

The meeting was called to order by Board Chairman Harms.

 

The following Commissioners were present: Hall, Wobbe, Harms, Roschen, Norman,

Motion to approve the agenda.

Staff Update: Consensus of the Board (4/1) to give feedlot position to the state.

Resolution No.: 2012-083

Whereas, the Zumbrowatha Trails Snowmobile Clubs of Wabasha County request that Wabasha County be their local sponsoring unit of government for pass-through of MN DNR snowmobile trail system funding,

Now therefore be it Resolved by the Wabasha County Board of Commissioners that: Wabasha County act as the sponsor for an application for funding to the State of Minnesota Department of Natural Resources for development of maintenance of snowmobile trails managed by the clubs of Zumbrowatha Trails-Wabasha County for the 2012-2013 snow season,

Be it further resolved: that upon approval of its application by the state, that Wabasha County may enter into an agreement with the State of Minnesota for the above referenced project and that it will act as the pass-thru for funds to the clubs as outlined in the Assistance Program manual,

Be it further Resolved: that the County Auditor/Treasurer and/or Deputy Auditor/Treasurer is hereby authorized to serve as the fiscal agent for the above referenced project,

Be it further resolved: that Marvin Howatt is appointed to be a County Trail Coordinator to work with the county clubs and assist the county in administering this program.

Resolution No.: 2012-084

Whereas the State of Minnesota DNR along with Wabasha County has approved the Zumbrowatha Trails Association of Wabasha County's request for the County to act as the sponsoring unit of government for pass-through of funds to the snowmobile clubs for the 2012-2013 snow year as outlined in the Assistance Program Manual.

Therefore, be it resolved that the Wabasha County Commissioners enter into a County-Club contract with each of the five snowmobile clubs within the Zumbrowatha Trails Association to administer their club's portion of the trail system for the 2012-2013 snow year according to the regulations outlined in the attached contract. The five snowmobile clubs consist of the Zumbro Valley, Wabasha Driftskippers, Cliff & Coulee Climbers, Elba Snowbirds and the Four Seasons.

Resolution No.: 2012-085

Whereas, Bluff Valley Campground has applied for a new tobacco license and paid the pro-rated license fee.

Whereas, The Wabasha County Board of Commissioners has approved issuance of a tobacco license for Bluff Valley Campground, effective for the period 5/10/12 to 9/30/12.

Now Therefore be it Resolved, by the Wabasha County Board of Commissioners that: Bluff Valley Campground is licensed to sell tobacco products according to Wabasha County Ordinance No. 40.

Resolution No.: 2012-086

Now Therefore be it Resolved that the Wabasha County Board of Commissioners hereby authorizes the County Highway Engineer to hire the following applicants for 2012 Part-Time Temporary Summer Employment at $10.00/hour; Blaine Miller and Michael Pick, and at $9.50/hour; Garret Miller.

Resolution No.: 2012-087

Now Therefore be it Resolved that the Wabasha County Board of Commissioners hereby authorizes the donation of the building formerly used as a salt storage shed located at the intersection of Mn TH 42 and County Highway 4 in Plainview to Whitewater Township.

Be it further resolved that the Wabasha County Engineer is authorized to advertise for sealed bids for the sale of the garage building on the same property as above.

Resolution No.: 2012-088

Whereas, the Wabasha County Highway Department has received proposals for herbicide application contract services; and

Whereas, the proposal from Central Applicators, Inc. was the lowest proposal received per unit price at $195.00 per mile.

Now Therefore be it Resolved that the Wabasha County Board of Commissioners hereby authorizes the County Engineer to purchase herbicide application contract services from Central Applicators, Inc.

Resolution No.: 2012-089

Whereas, the Wabasha County Board has abolished the administrator position; and

Whereas, the Wabasha County Board passed resolution on 2/7/12 (2012-023) to hire a part-time county coordinator; and

Whereas, the Wabasha County Board has identified administrative and human resource concerns that would be best managed by a full time County Coordinator; and

Whereas, the Wabasha County Board anticipates an off-setting reduction in overall payroll resulting from the Early Retirement Incentive Program; and

Whereas, the severance benefit for the previous administrator position has come to a close resulting in considerable savings to Wabasha County; and

Now Therefore be it Resolved by the Wabasha County Board of Commissioners hereby authorizes the hiring of a full time County Coordinator; and

Be it Further Resolved, the County Coordinator will enter employment with Wabasha County at pay grade 7, step 1; and

Be if Finally Resolved, the County Coordinator applicants will be screed and selected for interview by the Board Chair and one additional commissioner, with interviews and final selection for hiring carried out by the full Wabasha County Board.

Resolution No. 2012-090

A Resolution Setting Forth Findings in Support of a Special Closed Meeting

Whereas, Minn. Stat. §13D.05 subd. 3(b) permits closing a County Board meeting if such closure is permitted by the attorney-client privilege;

Whereas, litigation was brought against the County of Wabasha ("County") on April 19, 2012 by service of a Summons and Complaint captioned:

Dennis and Ruth Weber,

John and Lorraine Brinkman, AND

Rodger and Sylvia Brown,

Plaintiffs,

Vs.

Wabasha County, Richard J. Bremer,

Cheryl A. Sprick, and Skyline Materials, Ltd.,

An Iowa corporation

Defendants

Whereas, the County Board desires to consult with its attorney regarding the litigation.

Whereas, the County Attorney has advised the Board that it is not possible to fully discuss strategy and the options available to the County in a public meeting that may be attended by the plaintiffs who initiated the litigation.

Whereas, without such a meeting the County will have to make decisions without the full benefit of consultation with counsel, and is concerned that in such a situation, it could make uninformed decisions, exposing the County and its taxpayers to liabilities and costs that could be avoided by fully informed decision making available only in a closed session with counsel.

Whereas, in the closed session, the only subject to be discussed is the pending litigation.

Whereas, certain phases of the litigation strategy may be impaired if every discussion is available for the benefit of opposing parties;

Whereas, based upon the foregoing the Board finds there is an absolute need for confidentiality of this matter.

Now, Therefore, Be It Resolved,, a closed meeting of the Wabasha County Board addressing the above referenced matter will be held with the County Attorney and the MCIT provided attorney, Jason J. Kuboushek, on May 8, 2012 at approximately 1:00 p.m.
