The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, June 12, 2012 at 3:00 p.m.

 

The meeting was called to order by Board Chairman Harms.

Resolution No. 2012-096

Whereas, Wabasha County must take the necessary steps to alleviate health and safety threats in the County; and

Whereas, Wabasha County has identified the need to remove flood-damaged mobile homes; and

Whereas, the Southeastern Minnesota Multi-County Housing and Redevelopment Authority has the financial, technical, and managerial capacity to ensure proper construction, operation and maintenance of the project for its design life; and

Whereas, the Southeastern Minnesota Multi-County Housing and Redevelopment Authority will charge an administrative fee up to 15% of the total project costs through the Authority's 2013 levy request to the County; and

Therefore Be It Resolved By the Wabasha County Board of Commissioners that the Southeastern Minnesota Multi-County Housing and Redevelopment Authority shall serve as the administrative entity for the demolition and debris program through the FEMA Public Assistance Program.

Be It Further Resolved That Wabasha County will submit payment received by the County from FEMA to the Southeastern Minnesota Multi-County Housing and Redevelopment Authority for the expenses incurred for this project.

Resolution No. 2012-097

Whereas, Wabasha County must enter into a contract with the Minnesota Department of Public Safety – Division of Homeland Security and Emergency Management for the property acquisition program for properties affected by the September 2010 floods; and

Now, Therefore Be it Resolved the Wabasha County Board of Commissioners authorizes the Wabasha County Auditor/Treasurer and SEMMCHRA Executive Director to execute the contract with the Minnesota Department of Public Safety – Division of Homeland Security and Emergency Management.

Resolution No.: 2012-098

Be It Resolved that Wabasha County is willing to participate in the Rental Rehabilitation Deferred Loan Program through the Minnesota Housing Finance Agency; and

Be It Resolved that the Southeastern Minnesota Multi-County Housing and Redevelopment Authority be the administrative entity for the Rental Rehabilitation Deferred Loan Program.

Now, Therefore Be it Resolved that Wabasha County agrees to participate and partner in the Rental Rehabilitation Deferred Loan program through the Minnesota Housing Finance Agency.

Resolution No.: 2012-099

Whereas, Wabasha County Probation will have an vacancy of Administrative Assistant, effective 6/29/12, upon the retirement of Cheryl Stark who has been with the department for 24 years; and,

Whereas, the filling of this vacancy will result in a budget savings in 2012 and future years; and

Whereas, on 5/22/12, the County Board approved the Probation Director to advertise and fill the Probation Administrative Assistant position immediately.

Whereas, Anne Meurer, is a current member of Local #3542 Union/Courthouse Unit. She applied for the job and interviewed on June 5, 2012. Per union contract, the position was offered to her on June 6, 2012 and she accepted the offer, pending Criminal History Check and County Board approval; and

Therefore, Be It Resolved, that the Wabasha County Board of Commissioners authorizes the hiring of Anne Meurer, as Probation Administrative Assistant, at Grade 7, Step 2, at the rate of $ 17.67 per hour effective 7/2/2012.

Whereas, Minnowa Construction Inc. is the lowest responsible bidder for S.A.P. 079-605-013.

Now Therefore be it Resolved that the Wabasha County Board of Commissioners hereby accepts the bid of and awards a Contract to Minnowa Construction Inc. for S.A.P. 079-605-013 – Bridge 79553 and Approaches - in the amount of $565,725.60 and that the Chairman of the County Board and the Clerk of the Board are hereby authorized to execute a Contract with Minnowa Construction Inc. for this work.

Resolution No.: 2012-101

Whereas, Schumacher Excavating Inc. is the lowest responsible bidder for S.A.P. 079-625-016.

Now Therefore be it Resolved that the Wabasha County Board of Commissioners hereby accepts the bid of and awards a Contract to Schumacher Excavating Inc. for S.A.P. 079-625-016 in the amount of $147,931.00 and that the Chairman of the County Board and the Clerk of the Board are hereby authorized to execute a Contract with Schumacher Excavating Inc. for this work.

Resolution No.: 2012-102

Be it resolved by the Wabasha County Board of Commissioners that the attached Wabasha County Right-to-Know Program is hereby adopted, and the Highway Engineer, Dietrich Flesch, is hereby designated as the Program Coordinator.

Resolution No.: 2012-103

Whereas, the Wabasha County Sheriff's Office is requesting authorization to purchase XTS2500 radios for law enforcement per county purchase policy #19 (over $5,000.00); and,

Whereas, Motorola provided a bid thru state contract pricing; and,

Whereas, the cost incurred in this purchase is quoted at $33,842.64, plus shipping and handling (a discount is currently being negotiated); and,

Whereas, the monies for this purchase will come from the 911 account (01-291-243) in which the amount of $31,950.02 will be fully reimbursed by the 2011 SHSP Grant 2911-SHSP-44188 (no match) monies;

Whereas, any balance will come from the Radio Designation fund;

Whereas, this grant expires June 30, 2013 and all requirements must be met on or before this date in order to receive reimbursement.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: The Sheriff's Office is hereby authorized to purchase XTS2500 portable radios for law enforcement.

Be it further Resolved by the Wabasha County Board of Commissioners that: The funding will come from the 911 account (01-291-243) specially assigned to this grant and any remaining balance will come from the Radio Designation Fund.

Whereas, the applicant's request for renewed license has been approved by the County Attorney, County Sheriff and their respective Town Boards and have paid the required license fee. Term of license is from July 1, 2012 to June 30, 2013.

Now therefore be it resolved by the Wabasha County Board of Commissioners hereby approves the renewal of "On-Sale" and "Off-Sale" 3.2 Beer licenses as listed above.

Resolution No: 2012- 105

Whereas, the Wabasha County Policy Manual is a breathing document; and

Whereas, periodic review and updates to the Wabasha County Policy Manual are a necessary component to effective and quality management; and

Whereas, it is the responsibility and duty of a County Board to establish policies and procedures for central administration and county departments to meet county goals; and

Whereas, the Wabasha County Board has established a mission statement to administer statutory services to the citizens in a simple, efficient and fiscally responsible manner; and

Whereas, the Wabasha County Policy Manual (policies) should be in alignment with the mission statement; and

Whereas, the Wabasha County Board desires to have the entire updated Wabasha County Policy Manual reviewed; and

Now, therefore be it resolved that the Wabasha County Board of Commissioners hereby approves the updated policy #101;

Resolution No: 2012- 106

Whereas, Wabasha County has not had a Drug and Alcohol Policy: and

Whereas, a Wabasha County Drug and Alcohol Policy is a necessary component to effective management and required by Minnesota Employment Law for testing purposes; and

Whereas, it is the responsibility and duty of a County Board to establish policies and oversee the county personnel system that establish conditions of employment; and

Whereas, the Wabasha County Board will not tolerate drug or alcohol use, sale, possession or the like in the workplace; and

Whereas, the Wabasha County Drug and Alcohol Policy is a formal communication to employees regarding possible consequences of violation of this policy; and

Now, therefore be it resolved that the Wabasha County Board of Commissioners hereby approve the Wabasha County Drug and Alcohol Policy.

Resolution No: 2012-107

Whereas, the Wabasha County Board is responsible for personnel administration and policies; and

Whereas, the Wabasha County Board has decided to review and update the Wabasha County Policy Manual; and

Whereas, the Wabasha County Board has determined it is in the best interest of the taxpayers to have the Wabasha County Policy Manual reviewed by an independent or outside legal firm; and

Whereas, the court has found that the hiring of outside legal counsel is permissible in extraordinary occurrences and for specific purposes when the county attorney is unable to render effective service to properly represent the interests of the county; and

Whereas, seeking outside legal counsel and the decision to do so is within the authority of the board; and

Whereas, the hiring of Mohrman & Kaardal will provide the competent and diligent representation necessary in regard to the identified issues and ensure that the Wabasha County Board receives objective and unbiased legal advice and opinions on the Wabasha County Policy Manual; and

Whereas, the Mohrman & Kaardal Law Firm has already performed extensive research and developed dependable and accurate opinions for Wabasha County;

Now therefore be it resolved, that the Wabasha County Board of Commissioners hereby authorizes the Wabasha County Board Chair to solicit a retainer agreement with Mohrman & Kaardal Law Firm for the purpose of reviewing the Wabasha County Policy Manual.

Whereas, the Wabasha County Pay Equity and associated state job matches resulted in substantial wage increases for several staff; and

Whereas, periodic review and updates to the Wabasha County Pay Scale and associated state job matches are a necessary component to effective and quality management; and

Whereas, it is the responsibility and duty of a County Board to oversee the county personnel system and establish salaries; and

Whereas, the Wabasha County Board has established a mission statement to administer statutory services to the citizens in a simple, efficient and fiscally responsible manner; and

Whereas, the Wabasha County desires to have an Employee Classification Study, External Market Survey and Compensation Study; and

Whereas, the Wabasha County Board has received proposals for an Employee Classification Study, External Market Survey and Compensation Study; and

Whereas, the Wabasha County Board has determined it is in the best interest of the taxpayers to have an outside firm study and evaluated our current system; and

Now, therefore be it resolved that the Wabasha County Board of Commissioners hereby approves and accepts the following proposal: ; and

Now, therefore be it finally resolved, the Board Chair will work with the aforementioned firm to begin the process of re-evaluation of our current pay system.

By consensus, the Board moved the June 26 Board meeting to June 25, 2012, 1:00 p.m.

 

ROSCHEN - WOBBE

Resolution No. 2012-109

Whereas, On March 20, 2012, The County Board voted to offer an early retirement incentive for employees and officers who were eligible for a full or reduced pension through PERA or would be eligible for the current County retiree health insurance program following retirement, in addition to any other continued paid insurance benefits provided by union contracts or County Policy Manual; and

Whereas, this was a one-time offer and available to employees from all Departments; and

Whereas, it was agreed upon that all participants who chose to enroll in the Early Retirement Incentive Program (ERIP) would receive:

• Severance pay equal to 75% of unused sick leave and 100% of unused vacation accumulated as of the last day of employment. Sick leave and vacation severance will be paid out as a lump sum cash payment upon separation from employment at the employee's current hourly rate of pay as of the date of separation, less appropriate payroll deductions and subject to all withholding taxes. The lump sum payment from the employees' accrued sick time will be deposited with the Minnesota State Retirement System Health Savings Plan as required by any collective bargaining agreement or in conformity with County Policy.

• Employees will receive two (2) years of County contribution to any health or medical plan offered by the County, not to exceed $681.50 per month. Any plan selected over the County's contribution limit may be elected with the retiree responsible for reimbursing Wabasha County the cost difference between the plans. Under no circumstances shall payment be made to an employee who selects a plan with a lower County contribution limit nor will the County be required to make any contribution to any Health Savings Accounts that an employee may maintain. The County may, at its discretion, change insurance carriers and/or change or modify the level of benefits during this period. If an eligible participating employee receives health insurance coverage at no cost through another employer, the County health/medical insurance coverage shall be secondary.

Whereas, the ERIP application period has closed; and,

Whereas, Wabasha County received two applications accepting the offered ERIP; and,

Be It Resolved, that the applications of Cheryl Stark of the Wabasha County Probation Department and Laurie Hodgson of the Wabasha County Public Health Department be accepted and signed by the Chair of the Wabasha County Board under the terms and conditions outline in the ERIP plan offering.
