The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, July 10, 2012 at 9:00 a.m.

 

The meeting was called to order by Board Chairman Harms.

 

The following Commissioners were present: Hall, Wobbe, Harms, Roschen, Norman,

Resolution No: 2012-138

Whereas, Deputy Ryan Lodermeier has submitted a letter of resignation; and,

Whereas, Deputy Ryan Lodermeier began his employment with Wabasha County on March 29, 2006; and

Whereas, with heavy regret, his resignation will take effect on July 15, 2012; and

Whereas, due to this resignation, the Sheriff's Office requests approval to fill this vacancy.

Now Therefore be it Resolved, the Wabasha County Board of Commissioners hereby accepts the resignation of Deputy Sheriff Ryan Lodermeier effective July 15, 2012.

Be it Further Resolved, the Wabasha County Board of Commissioners authorizes the Sheriff's Office to fill this vacant Deputy Sheriff position.

Resolution No.: 2012-139

Whereas, Wabasha County has applied to the Commissioner of Transportation for a grant from the Minnesota State Transportation Fund for construction of Bridge 79553 on County State Aid Highway 5 under S.A.P. 079-605-013, and

Whereas, the Commissioner of Transportation has given notice that funding for this Project is available, and

Whereas, the amount of the grant has been determined to be $323,663.20 by reason of the lowest responsible bid, and

Whereas, the State of Minnesota requires the attached Local Bridge Replacement Program Grant Agreement and Declaration for S.A.P. 079-605-013 be executed by Wabasha County in order to receive the necessary funds for this Project.

Now Therefore Be It Resolved by the Wabasha County Board of Commissioners that Wabasha County does hereby agree to the terms and conditions of the grant and Local Bridge Replacement Program Grant Agreement consistent with Minnesota Statutes; 174.50, subdivision 5, clause (3), and will pay any additional amount by which the cost exceeds the estimate, and will return to the Minnesota State Transportation Fund any amount appropriated for this bridge but not required.

Be it further resolved that the Chairman of the Wabasha County Board of Commissioners and Clerk to the Board are hereby authorized to execute the attached Local Bridge Replacement Program Grant Agreement and Declaration on behalf of Wabasha County.

Resolution No: 2012-140

Whereas, the Wabasha County has adopted a mission statement to administer statutory services to citizens in a simple, efficient and fiscally responsible manner; and

Whereas, it is the responsibility and duty of the Wabasha County Board to establish and review county services and policies; and

Whereas, the June 18, 2012 public town hall meeting enabled citizens a voice regarding the Wabasha County Mailbox Policy; and

Whereas, the citizens communicated a desire to take personal responsibility regarding their mailbox installation and rejected the Wabasha County road authority mandating conformance to mailbox standards; and

Whereas, the Wabasha County Board recognizes there is no legal requirement for the road authority to inspect and remove non-conforming mailboxes; and

Now, therefore be it resolved, the Wabasha County Board adopts the revised Wabasha County Mailbox Policy dated this day, July 10, 2012. This policy will become effective immediately.

Be it further resolved, the Wabasha County road authority will immediately send a follow-up correspondence via U.S. Mail to every resident who received the May 8, 2012 mailbox notification. The correspondence shall communicate to the recipient that they are encouraged to take suggested action on their mailbox and there will be no follow-up inspections performed. The correspondence shall also include the updated mailbox policy dated July 10, 2012.

Resolution No: 2012-141

Whereas, the Wabasha County Policy Manual is a breathing document; and

Whereas, periodic review and updates to the Wabasha County Policy Manual are a necessary component to effective and quality management; and

Whereas, it is the responsibility and duty of a County Board to establish policies and procedures for central administration and county departments to meet county goals; and

Whereas, the Wabasha County Board has established a mission statement to administer statutory services to the citizens in a simple, efficient and fiscally responsible manner; and

Whereas, the Wabasha County Policy Manual (policies) should be in alignment with the mission statement; and

Whereas, the Wabasha County Board desires to have the entire updated Wabasha County Policy Manual reviewed; and

Now, therefore be it resolved that the Wabasha County Board of Commissioners hereby approves the updated policies #108, #210, Code of Ethics.

Resolution No: 2012-142

Whereas, the Wabasha County Board has adopted a mission statement to administer statutory services to citizens in a simple, efficient and fiscally responsible manner; and

Whereas, it is the responsibility and duty of the Wabasha County Board to establish county policies; and

Whereas, on April 19, 2011 the Wabasha County Board instituted a county wide hiring freeze for an indefinite period of time; and

Whereas, the Wabasha County Board continues to focus on controlling operating costs and expenditures during these unstable economic conditions; and

Whereas, the Wabasha County Sheriff's Department has repeatedly disregarded the April 19, 2011 hiring freeze resolution by means of multiple new hires; and

Whereas, pursuant to Minnesota Statute 387.14 it is the County Board's responsibility to determine the number of permanent full time deputies and other employees in the Sheriff's Office and establish the compensation for each position; and

Now, therefore be it resolved, the Wabasha County Board directs that prior to filling or creating any position in the Sheriff's Department, a formal request by the Sheriff must come before the Wabasha Board of Commissioners for approval or denial.

Whereas, the Wabasha County Board has adopted a mission statement to administer statutory services to citizens in a simple, efficient and fiscally responsible manner; and

Whereas, the Wabasha County Sheriff's Department has repeatedly disregarded the April 19, 2011 hiring freeze resolution by means of multiple new hires; and

Whereas, the Wabasha County Board has identified a need for additional supervision and administrative intervention in the Sheriff's Department; and

Whereas, pursuant to Minnesota Statute 387.31, the Wabasha County Board may establish a civil service personnel system in the sheriff's department; and

Whereas, the City of Lake City has already established a Civil Service Personnel System; and

Now, therefore be it resolved, the Wabasha County Board directs the Board Chairman to contact the City of Lake City administration to ascertain if there is interest and mutual benefit to expanding their current Civil Service Personnel System to incorporate the Wabasha County Sheriff's Department under their scope of authority.

Resolution No: 2012-144

Whereas, The County Board of Commissioners of the County of Wabasha, State of Minnesota, desire to offer for sale certain parcels (listed below) of land that have been forfeited to the State of Minnesota for non-payment of taxes; and

• Parcel Number R07.00177.00, Sec 22 Twn 109 Ran 013, 5.00 Ac, SE1/4NE1/4 Aud Lot 12, Doc # 263060

• Parcel Number R22.00144.00, Sec 09 Twn 111 Ran 012, 7.90 Ac, Ex Peters' Add, About 7.90 Ac in SW1/4NW1/4

• Parcel Number R22.02078.00, Jewel Third Addition, Sec 06 Twn 111 Ran 012, Lot 13 Blk 2

• Parcel Number R22.02402.00, Oakhurst at the Jewel, Sec 07 Twn 111 Ran 012, Lot 7 Blk 4

Whereas, said parcels of land have been viewed by the Soil & Water Conservation District and have been classified as non-conservation lands as provided for in Minnesota Statutes 282.01.

Now, Therefore Be It Resolved That the Wabasha County Board of Commissioners hereby certify that all parcels of land listed above have been viewed and comply with the Provisions of Minnesota Statutes 85.012, 92.461, 282.01, Subd 8, and 282.018 and other statutes that require the withholding of tax-forfeited lands from sale.

Be It Further Resolved That the Wabasha County Board of Commissioners hereby request approval from the Minnesota Department of Natural Resources for the sale of said lands.

Resolution No.: 2012-145

Whereas, property located in the City of Lake City described as R22.01869.00 forfeited to the State of MN for delinquent taxes in the years 2006 – 2011, as provided by the appropriate statues, and

Whereas, MS 282.241 provides for repurchase after forfeiture of tax by aggregate of all delinquent taxes and assessments, together with penalties, interest and costs which would have accrued had said land not forfeited to the State, unless prior to the time of repurchase such parcels shall have been sold, and

Whereas, this Board has determined that forfeiture of said lands has caused undue hardship to the owner and/or other parties having a legal interest in such lands, and that said repurchase would promote the use of such lands to the best interest of the public.

Now therefore be it resolved by the Wabasha County Board of Commissioners hereby approves CITI Financial be authorized to repurchase property referred to above, under the provision of the above mentioned statue, provided that payment is made in the sum of all taxes, assessments, penalties, interest and costs.

A Public Hearing will be held at the Board meeting July 24, 2012 at 1:15 p.m. for the possible issuance of an off sale liquor license for Mac's Park Place, Mazeppa Township.

Resolution No.: 2012-146

Whereas, the Wabasha County Services Building has been occupied by county staff for approximately 15 years without an improvement to the exterior door-locking mechanisms; and

Whereas, the existing lock/tumblers are not functioning efficiently; and

Whereas, the installation of proximity card readers will provide improved access to the building by staff and a higher level of security for the property; and

Whereas, the Finance Department staff requested an estimate to have the work completed, and that estimate is $4,350; and

Whereas, the Directors of Public Health and Social Services recommend this change in security to the County Services Building;

Now therefore be it resolved by the Wabasha County Board of Commissioners, to authorize the installation of proximity card readers to the exterior doors of the County Services Building. Further, that this project will be paid through existing SCHA funds, thereby not impacting the current budgets of the County.

Resolution No.: 2012-147

Whereas, Wabasha County recently adopted a Drug Testing Policy that applies to all prospective and current County employees, and

Whereas, it is necessary for Wabasha County to have a responsible authority for collecting and administering these tests, and

Whereas, MedTox already provides some of these services to the County for employees covered under Department of Transportation guidelines, and

Therefore Be It Resolved by the Wabasha County Board of Commissioners approves the expanded use of MedTox to facilitate the operation of the County's Drug Testing program and agrees to the "Pricing Agreement" provided by said agency.

Resolution No.: 2012-148

Whereas, Wabasha County is updating the Emergency Services Atlas Map Book; and,

Whereas, Wabasha County is using Business Impact Group for the professional services design of said atlas book and printing services; and,

Whereas, designated funds in the amount of $10,000.00 along with 911 funds will be used to pay for expenses incurred on said project.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that:

Wabasha County approves and commits to the services and printing of said Wabasha County Emergency Services Atlas Book by Business Impact Group; and,

Be it further Resolved by the Wabasha County Board of Commissioners that:

These atlas books will be paid from designated funds of $10,000.00 and the remaining amount from 911 funds (290 account).
