The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, July 24, 2012 at 1:00 p.m.

 

The meeting was called to order by Board Chairman Harms.

Whereas, Randy Rouhoff from Mac's Park Place has applied for an Off Sale Liquor License. Currently Mac's Park Place has an On Sale & Sunday Liquor License, current Food & Beverage License and Certificate of Liability Insurance.

Whereas, Mazeppa Township has approved an Off Sale Liquor License at Mac's Park Place.

Whereas, Wabasha County Attorney and Wabasha County Sheriff have approved the Off Sale Liquor License.

Whereas, Wabasha County Auditor/Treasurer published a public hearing date in the Lake City Graphic, Plainview News and Wabasha County Herald, regarding the Off Sale License. Wabasha County Board of Commissioners held a public hearing on 07/24/12 at 1:15 pm to hear concerns from interested parties on the issuance of an Off Sale Liquor License to Mac's Park Place.

Now therefore be it resolved by the Wabasha County Board of Commissioners hereby approves issuing an Off Sale Liquor License to Randy Rouhoff, Mac's Park Place, Mazeppa Township, 57444 406th Ave, Mazeppa. License period will run from 08/01/12 to 07/31/13. License fee of $500.00 has been paid.

Resolution No.: 2012-151

Whereas, Project CP 79-12-8045 – Apply Traffic Paint with any and/or all Supplemental Agreements, Change Orders or Work Orders, has been completed.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Wabasha County Auditor/Treasurer be authorized to issue a warrant for final payment to AAA Striping Service Company in the amount of $2360.73.

Resolution No.: 2012-152

Whereas, Wabasha County has applied to the Commissioner of Transportation for a grant from the Minnesota State Transportation Fund for construction of Bridge 79J61 on County State Aid Highway 25 under S.A.P. 079-625-016, and

Whereas, the Commissioner of Transportation has given notice that funding for this Project is available, and

Whereas, the amount of the grant has been determined to be $53,331.30 by reason of the lowest responsible bid, and

Whereas, the State of Minnesota requires the attached Local Bridge Replacement Program Grant Agreement and Declaration for S.A.P. 079-625-016 be executed by Wabasha County in order to receive the necessary funds for this Project.

Now Therefore Be It Resolved by the Wabasha County Board of Commissioners that Wabasha County does hereby agree to the terms and conditions of the grant and Local Bridge Replacement Program Grant Agreement consistent with Minnesota Statutes; 174.50, subdivision 5, clause (3), and will pay any additional amount by which the cost exceeds the estimate, and will return to the Minnesota State Transportation Fund any amount appropriated for this bridge but not required.

Be it further resolved that the Chairman of the Wabasha County Board of Commissioners and Clerk to the Board are hereby authorized to execute the attached Local Bridge Replacement Program Grant Agreement and Declaration on behalf of Wabasha County

Resolution No.: 2012-153

Whereas, Project SAP 079-599-076 – Bridge and Bridge Approaches with any and/or all Supplemental Agreements, Change Orders or Work Orders, has been completed.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that the Wabasha County Auditor/Treasurer be authorized to issue a warrant for final payment to Minnowa Construction Inc. in the amount of $25,289.29.

Resolution No.: 2012-154

Whereas, Transportation enhancement projects receive federal funding from the Surface Transportation Program (STP) of the Safe, Accountable, Flexible, Efficient, Transportation Equity Act: A Legacy for Users (SAFETEA-LU); and

Whereas, The Federal Highway Administration (FHWA) requires that states agree to operate and maintain facilities constructed with federal transportation funds for the useful life of the improvement and not change the use of right of way or property ownership acquired without prior approval from the FHWA; and

Whereas, The Federal Highway Administration (FHWA) requires applicants to provide a minimum of 20% match of the estimated cost of proposed projects.

Whereas, The Minnesota Department of Transportation (Mn/DOT) has determined that for projects implemented with enhancement funds, these above requirements should be applied to the project sponsor; and

Whereas, Wabasha County is the project sponsor for the transportation enhancements project identified as Wabasha County and Cities Sidewalk Improvement Project.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that Wabasha County act as sponsoring agency for "Transportation Enhancements" project identified as Wabasha County and Cities Sidewalk Improvement Project and acknowledges herewith that it is willing to be the project sponsor; and accepts responsibility for seeing this project through to its completion, with compliance of all applicable laws, rules and regulations, including a commitment to secure and guarantee the local share of a minimum of 20% of the costs of this project.

Be it further resolved that the project sponsor hereby agrees to assume full responsibility for the operation and maintenance of property and facilities related to the aforementioned enhancement project. The project sponsor also agrees to assume full responsibility for the preparation and submittal of necessary project plans, specifications and bid documents on or before April 15 of the project year

Be it further resolved that the primary contact shall be the Wabasha County Engineer and is hereby authorized to act as agent on behalf of this applicant.

Resolution No.: 2012-155

Whereas, Wabasha County Emergency Management develops and maintains a County-wide All-Hazard Emergency Operations Plan (EOP) that serves a guideline for responding to hazards that can affect the county;

Whereas, the Plan contains the 18 SARA Title III items as well as up to 82 other items listed in the Local Emergency Operations Plan Crosswalk provided by the Minnesota Division of Homeland Security and Emergency Management (MnHSEM);

Whereas, said Plan is updated and reviewed annually in a 4-year Plan Review cycle as required by MnHSEM and the Emergency Management Performance Grant;

Be It Resolved, that the Wabasha County Board of Commissioners hereby approves the 2012 Wabasha County-wide All-Hazard Emergency Operations Plan (EOP) with its revisions and updates by signing the Certification of Plan Approval page.

Resolution No. 2012-111

Whereas, the Minnesota Pollution Control Agency has established an animal feedlot program designed to assist animal feedlot operators in efficient and environmentally sound management of animal wastes; and

Whereas, the Minnesota Pollution Control Agency's program provides for county involvement in the processing of animal feedlot permit applications and administration of the animal feedlot program in accordance with Minn. Stat. 16.07 subd. 7 (1992) and Minn. Rules ch. 7020.1600 (October 23, 2000); and as specified in the attached county delegation agreement;

Now, Therefore, Be It Resolved by the Wabasha County Board of Commissioners that the County of Wabasha assumes certain responsibilities for the administration of the animal feedlot program and processing of animal permit application in accordance with Minn. 116.07, subd. 7 (1992), and Minn. Rules ch. 7020.1600 (October 23, 2000); and the attached delegation agreement that describes the administration of the county feedlot program as specified in Minn. Rules ch. 7020.1600, subpart 3;

Be It Further Resolved, notwithstanding the dates of the signatures of the parties, the term of this Resolution shall be from July 1, 2012 through June 30, 2013, unless earlier terminated by law or according to the provisions of this Resolution.

Be It Further Resolved, The County Feedlot Officer is the Planning and Zoning Administrator, who has the final review and approval authority for issuance of feedlot permits and enforcement of feedlot rules pursuant to the MPCA Feedlot Program in Wabasha County and specifically retains the authority to:

a) Review and issue feedlot permits, a copy of which will be provided to the SWCD;

b) Tell the SWCD of changes in county policy and procedures related to the issuance of feedlot permits and enforcement of feedlot rules;

c) Notify the SWCD of feedlot complaints received by the county;

d) Provide all relevant data, forms, and information currently available in county datasets, including GIS parcel data, which would aid the SWCD in the processing of feedlot permits and enforcement of feedlot rules;

e) Provide administrative assistance as needed related to issuance of feedlot permits or manure handling, at an hourly rate applied towards in-kind match of the NRBG grant;

f) Review and approve and sign the MPCA required annual report and annual work plan prepared by the SWCD;

g) Any liabilities brought forth due to past employees actions will be under Wabasha County jurisdiction and dealt with by Wabasha County staff and attorney, SWCD will be exempt from any legal action;

h) Allow usage of County vehicles and fuel through the Planning and Zoning/Environmental Services office for official Wabasha County Feedlot Officer assistant business, as an in-kind match;

i) Allow usage of letterhead, envelopes, and postage for official mailings and business, and this will count towards in-kind match.

j)

Be It Further Resolved, The County Feedlot Officer Assistant is employed by the Wabasha County SWCD, and provides technical and administrative assistance to the County Feedlot Officer by performing the administrative functions the county is required to perform related to the MPCA Feedlot program, except those functions specifically retained by the County above. Such services will be completed by the County Feedlot Officer Assistant which will be hired to complete the following:

a) Administer animal feedlots and manure storage areas registration programs according to Minn. Rules ch. 7020.0350;

b) Locate and register all animal feedlots and manure storage areas that remain unregistered by January 1, 2002;

c) Distribute permit application and registration forms to owners required to make application for a permit. Permit application forms must contain the information required in Minn. Rules ch 7020.0505. subpart 3;

d) Review permit applications and ensure issuance of construction short-form and interim permits in accordance with Minn. Rules 7020.0535, and in the approved delegation agreement;

e) Inspect all animal feedlots and manure storage areas in accordance with the approved delegation agreement;

f) Review and process complaints;

g) Provide assistance to owners completing permit applications;

h) Maintain a record of all correspondence and material relating to permit application, inspections, and complaints;

i) Maintain a record of all notifications received from livestock production facility operators claiming the hydrogen sulfide ambient air quality standard exemption including the days the exemption was claimed and the cumulative days used as provided in Minn. Stat. 116.0713, items (2)(b) and (2)(c);

j) Submit an annual report to the commissioner by April 1 of each year, in a format requested by the commissioner, that includes the following;

1) All newly acquired and updated registration information required under Minn. Rules ch. 7020.0350;

2) Inspection summary information from the previous year;

3) Permitting summary information from the previous year including information regarding permits for facilities with less than 1000 animal units that are CAFO's under the 40C.F.R. part 122, Appendix B(b);

4) Complaint and complaint response summary information from the previous year;

5) Outreach and education summary information from the previous year; and

6) Summary of the progress toward achieving the goals identified in the approved delegation agreement and, if applicable, proposed adjustments t the goals or plans to meet the goals in the approved delegation agreement;

k) Complete the required county feedlot pollution control officer training as necessary to perform the duties described under this part assigned to the county feedlot pollution control officer, and

l) Forward to the commissioner all permit applications, inspection reports and all other applicable documents for the facilities identified in Minn. Rules ch. 7020.1600, subp. 4, item B.

m)

Be It Further Resolved, The SWCD agrees to utilize the complete NRBG grant allocation strictly for county feedlot activities, including salary and project money, not to be applied towards the annual Wabasha SWCD budget, and designating a specific SWCD employee to work with the County Feedlot Officer and follow County policies and procedures for the MPCA Feedlot program;

Be It Further Resolved, that the County of Wabasha agrees to notify the Minnesota Pollution Control Agency in writing if any changes in the program as outlined herein and attached hereto;

Be It Finally Resolved, that the County of Wabasha respectfully submits this resolution and the attached delegation agreement to the Minnesota Pollution Control Agency and respectfully requests that the Minnesota Pollution Control Agency approve the County's participation in the animal feedlot program.

Resolution No.: 2012-156

Whereas, the Director of Social Services has received a letter of resignation from Ms. Alyssa Larson, and

Whereas, Ms. Larson is an employee in good standing with over 4 years of employment with Wabasha County;

Now therefore be it resolved by the Wabasha County Board of Commissioners to accept, with reluctance and appreciation, the resignation of Ms. Alyssa Larson, effective the end of the day on July 27, 2012.

Resolution No.: 2012-149

Be It Resolved, that the Wabasha County Board of Commissioners hereby makes a conditional job offer of the County Coordinator position to Bridgett Hoffman subject to pre-employment screening; and

Be It Resolved that the pre-employment screening shall include the following:

• Conducting reference checks

• Verifying prior employment

• Verifying the candidate's reported education

• Successful completion of a criminal background check

• Successful completion of a pre-employment drug screening; and

Be It Resolved, that the probationary period for this position shall be for a minimum of one (1) year with periodic job evaluations and reviews; and

Be It Resolved that Commissioner Harms and Assistant County Attorney Plante speak with Ms. Hoffman to encourage Ms. Hoffman to undertake training in areas that the Board and staff have addressed at past Board meetings; and

Be It Resolved, that successful completing of this screening is subject to the approval or disapproval by the Board at its sole discretion.

Now therefore be it Resolved by the Wabasha County Board of Commissioners hereby approves the Minnesota Lawful Gambling – Premise Permit Application for the Plainview Firefighters Relief Association at BJ's Bar & Grill in Highland Township, subject to the approval of the State of Minnesota Gambling Control Board.

Resolution No: 2012-159

Whereas, the Wabasha County Policy Manual is a breathing document; and

Whereas, periodic review and updates to the Wabasha County Policy Manual are a necessary component to effective and quality management; and

Whereas, it is the responsibility and duty of a County Board to establish policies and procedures for central administration and county departments to meet county goals; and

Whereas, the Wabasha County Board has established a mission statement to administer statutory services to the citizens in a simple, efficient and fiscally responsible manner; and

Whereas, the Wabasha County Policy Manual (policies) should be in alignment with the mission statement; and

Whereas, the Wabasha County Board desires to have the entire updated Wabasha County Policy Manual reviewed; and

Now, therefore be it resolved that the Wabasha County Board of Commissioners hereby approves the updated policies: General Information, 102 Employment Processing, 109 Payroll.
