Meeting of August 28, 2012

 

The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, August 28, 2012 at 1:00 p.m.

 

The meeting was called to order by Board Chairman Harms.

 

The following Commissioners were present: Hall, Wobbe, Harms, Roschen, Norman,

Motion to approve the agenda, after removing Resolution 168 from the agenda.

Whereas, Loren Benz, Wabasha County Assessor, submitted his letter of resignation August 28, 2012; and

Whereas, Loren Benz has provided several months' notice of his intentions;

Now, Therefore, be it Resolved that the Wabasha County Board of Commissioners hereby accepts the resignation of Loren Benz, with regrets, effective December 31, 2012

ROSCHEN - NORMAN

Resolution No: 2012-169

Whereas, The County Board of Commissioners of the County of Wabasha, State of Minnesota, desire to offer for sale certain parcels (listed below) of land that have been forfeited to the State of Minnesota for non-payment of taxes; and

• Parcel Number R28.00046.00, Sec 31 Twn 110 Ran 013, Whaley's Addition, Lot 2 & Lot 3 Blk 1 & 7.5' x 100' of Lot 1 Blk 1

Whereas, said parcels of land have been viewed by the Soil & Water Conservation District and have been classified as non-conservation lands as provided for in Minnesota Statutes 282.01.

Now, Therefore, Be It Resolved That the Wabasha County Board of Commissioners hereby certify that all parcels of land listed above have been viewed and comply with the Provisions of Minnesota Statutes 85.012, 92.461, 282.01, Subd 8, and 282.018 and other statutes that require the withholding of tax-forfeited lands from sale.

Be It Further Resolved That the Wabasha County Board of Commissioners hereby request approval from the Minnesota Department of Natural Resources for the sale of said lands.

Resolution No: 2012-170

Whereas, the following applicant has applied for 3.2 Beer license, and "On-Sale" and "Off-Sale,"

Russell Meyer Theilman's Sportsman's Club West Albany Township

Whereas, the applicant's request for a new license has been approved by the County Attorney, County Sheriff and West Albany Town Board and have paid the required license fee. Term of license is from Sept 1, 2012 to June 30, 2013.

Now therefore be it resolved by the Wabasha County Board of Commissioners hereby approves the new "On-Sale" and "Off-Sale" 3.2 Beer license as listed above.

Resolution No: 2012-171

Whereas, the following applicant have applied for Consumption and Display (Set up) Permit, and Consumption and Display(Set up),

Russell Meyer Theilman's Sportsman's Club West Albany Township

Whereas, the applicant has a current 3.2 percent Malt Liquor License On & Off Sale, which allows for the applying of a Consumption and Display (Set Up) Permit per MS 340A.414. The license is effective from Sept 1, 2012 to March 31, 2013.

Now therefore be it resolved by the Wabasha County Board of Commissioners hereby approves the Consumption and Display (Set up) permit as listed above.

NORMAN - WOBBE

Resolution No: 2012-172

Whereas, Wabasha County tax forfeited parcel listed below in 1997 due to non-payment of taxes; and

• Parcel Number R13.00043.06, Sec 20 Twn 111 Ran 011, 0.30 Ac, Parcel "B" being 131.3' x 140.2' x 123.2' x 71.0' in NW1/4

Whereas, it has come to the attention of the Auditor/Treasurer and Recorder that this parcel was forfeited in error;

Now, Therefore, Be It Resolved That the Wabasha County Board of Commissioners hereby approves the cancellation of forfeiture for Parcel 13.00043.06.

Commissioners set September 18 at 9:00 a.m. as a working session for the County Policy Manual.

 

HALL - NORMAN

Resolution No.: 2012-173

Whereas, the County of Wabasha on behalf of its County Probation Department desires to enter into Joint Powers Agreements with the State of Minnesota, Department of Public Safety, Bureau of Criminal Apprehension to use systems and tools available over the State's criminal justice data communications network for which the County is eligible. The Joint Powers Agreements further provide the County with the ability to add, modify and delete connectivity, systems and tools over the five year life of the agreement and obligates the County to pay the costs for the network connection.

Now, Therefore, Be It Resolved by the County Board of Wabasha, Minnesota as follows:

1. That the State of Minnesota Joint Powers Agreements by and between the State of Minnesota acting through its Department of Public Safety, Bureau of Criminal Apprehension and the County of Wabasha on behalf of its County Probation Department are hereby approved. Copies of the six Joint Powers Agreements are attached to this Resolution and made a part of it.

 

2. That the PSAP/TAC Supervisor, Blaine John Hentz, or his or her successor, is designated the Authorized Representative for the Sheriff. The Authorized Representative is also authorized to sign any subsequent amendment or agreement that may be required by the State of Minnesota to maintain the County's connection to the systems and tools offered by the State.

To assist the Authorized Representative with the administration of the agreement, PSAP/TAC Supervisor Blaine John Hentz is appointed as the Authorized Representative's designee.

 

3. That the Wabasha County Attorney, James Nordstrom, or his or her successor, is designated the Authorized Representative for the County Attorney. The Authorized Representative is also authorized to sign any subsequent amendment or agreement that may be required by the State of Minnesota to maintain the County's connection to the systems and tools offered by the State.

To assist the Authorized Representative with the administration of the agreement, Wabasha County Attorney James Nordstrom is appointed as the Authorized Representative's designee.

 

4. That David Harms, the Chair of the County of Wabasha, and the Clerk to the Wabasha County Board, are authorized to sign the State of Minnesota Joint Powers Agreements.

Resolution No: 2012-174

Contract #50720; CFDA #97.012 and authorization for Auditor's Warrant

Whereas, the Sheriff's Office has received notification of award for the 2012 Federal Boating Safety Supplemental Equipment Grant; and,

Whereas, this grant contract needs to be approved and signed by the Sheriff, County Auditor or County Administrator and County Board Chairperson; and

Whereas, the Sheriff requests the approval and signing of the 2012 Minnesota Department of Natural Resources Federal Boating Safety Supplemental Equipment Grant by the County Auditor, Chairman of the County Board, and Sheriff.

Whereas, this grant expires November 14, 2012 and all requirements (Exhibit A) must be met on or before this date in order to receive reimbursement.

Whereas, the Sheriff also requests approval for the Auditor's Office to cut an Auditor's Warrant not to exceed the award amount of $5,720.00 once the invoices are received to ensure reimbursement timelines are met.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: the 2012 Minnesota Department of Natural Resources Federal Boating Safety Supplemental Equipment Grant is hereby approved and authorizes it's signing by the Chairman of the County Board, County Auditor, and Sheriff.

Be it further Resolved by the Wabasha County Board of Commissioners that: the Auditor's Office is hereby authorized to cut an Auditor's Warrant not to exceed the award amount of $5,720.00 to the respective vendors once invoices are received.

Resolution No.: 2012-175

Whereas, On August 23rd, 2011 the Wabasha County Board agreed to authorize the County Administrator and SEMMCHRA Executive Director to execute a contract with the Minnesota DNR for the property acquisition program for properties affected by the September 2010 floods; and

Whereas, SEMMCHRA advertised for bids for the demolition of the buyout properties; and

Whereas, SEMMCHRA has approved awarding the contract to Fitzgerald Excavating and Contracting, Inc for the demolition project.

Now Therefore, be it resolved, that the Wabasha County Board of Commissioners hereby approves SEMMCHRA awarding the contract to Fitzgerald Excavating and Contracting, Inc

Resolution No.: 2012-176

Whereas, on January 25, 2011, Wabasha County and the All-American Cooperative ("All American") entered into a land swap agreement; and

Whereas, pursuant to that agreement All-American agreed to perform improvements on the portion of land that the County was to receive by April 25, 2011; and

Whereas, pursuant to an agreement entered into on August 9, 2011, the time for performance by All-American was extended to may 16, 2012

Whereas, on recently All-American approached the County to extend the time for performance to a future date; and

Now, Therefore, Be It Resolved that the Wabasha County Board approves or denies All American's request to extend the time for performance. Said date will be extended to____________.

Commissioners set the following dates for Town Hall meetings to discuss the levy and 2013 budget:

September 11, Millville Legion; September 18, Lake City City Hall; September 27, Mazeppa Community Room; October 4, Elgin at The Huddle; October 11, County Board Room, Wabasha; October 18, Plainview City Hall. All meetings start at 7:00 p.m.

 

HALL - NORMAN

Resolution Number: 2012-177

Whereas, Wabasha County wishes to remain a Delegated County for the County Feedlot Program; and

Whereas, Minnesota Rules Chapter 7020 requires that a Delegation Agreement must be reviewed and approved by a Delegated County and the Minnesota Pollution Control Agency(MPCA) annually; and

Whereas, The Environmental Services Department has prepared a 2012-2013 Delegation Agreement and Work Plan in consultation with the MPCA:

Now Therefore Be It Resolved, the Wabasha County Board of Commissioners approves the attached 2012-2013 Delegation Agreement and Work Plan.
