The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, May 6, 2014 at 9:00 a.m.

 

The meeting was called to order by Board Chairman Springer.

The following Commissioners were present: Springer, Wobbe, Hall, Harms, Roschen

Resolution No.: 2014-130

Whereas, The County Board of Commissioners of the County of Wabasha, State of Minnesota, desire to transfer the certain tax forfeited parcel (listed below) of land to MN Department of Natural Resources; and

• Parcel Number R22.00144.00

o Tax Description: Sec 09 Twn 111 Ran 012, 7.90 Ac, Ex Peters' Add, About 7.90 Ac in SW1/4NW1/4

o Full Legal Description: That part of Lot 6, J.B. Hawley's Survey, being the SW1/4 of the NW1/4 of Section 9. Township 111 North, Range 12 West, Wabasha County, MN, lying southerly of the southerly line of Peters Addition. 7.7 acres more or less.

Whereas, said parcel of land have been classified as non-conservation by Wabasha County Board of Commissioners as provided for in Minnesota Statutes 282.01.

Now, Therefore, Be It Resolved That the Wabasha County Board of Commissioners hereby certify that the parcel of land listed above be re-classified as conservation to allow the transfer to MN Department of Natural Resources.

Henry Koch, La Crosse Solid Waste, gave a presentation to the Board regarding the operations of the landfill and benefits the county is receiving by sending its solid waste to the facility.

 

HALL – HARMS

Resolution No: 2014-131

Minnesota DNR 2014 State Boat and Water Safety Grant Contract #75972

Whereas, the Wabasha County Sheriff's Office has been authorized to participate in the 2014 State Boat and Water Safety Grant; and,

Whereas, the Sheriff's Office has received the 2014 contract which needs to be approved and signed by the Sheriff, County Auditor or County Administrator and County Board Chairperson; and,

Whereas, the Sheriff requests the approval and signing of the 2014 Minnesota Department of Natural Resources State Boat and Water Safety Grant by the County Administrator and Chairman of the County Board.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that: the 2014 Minnesota Department of Natural Resources State Boat and Water Safety Grant is hereby approved and authorizes it's signing by the County Administrator and Chairman of the County Board.

WOBBE - SPRINGER

Resolution No.: 2014-132

Whereas, Fitzgerald Excavating & Trucking Inc. is the lowest responsible bidder for S.A.P. 079-596-009.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that,

Wabasha County hereby accepts the bid of and awards a Contract to Fitzgerald Excavating & Trucking Inc. for S.A.P. 079-596-009 in the amount of $429,453.75 and that the Chair of the County Board and the Clerk of the Board are hereby authorized to execute a Contract with Fitzgerald Excavating & Trucking Inc. for this work.

Resolution No.: 2014-133

Whereas, the City of Elgin requests a solution to a current drainage problem; and

Whereas, the agreeable solution is to install an additional culvert under County Road 73; and

Whereas, the City of Elgin proposes to pay for 50% of the costs to install a culvert under County Road 73.

Now Therefore Be It Resolved by the Wabasha County Board of Commissioners that, Wabasha County shall contribute _______% of the costs or other such as labor and/or equipment to install the requested culvert.

WOBBE – HALL

Resolution No.: 2014-134

Whereas, Wabasha County has reviewed the pertinent data on bridges requiring replacement, rehabilitation, or removal; and

Whereas, Wabasha County has identified those bridges that are high priority and has previously established a list of those bridges that require replacement, rehabilitation, or removal; and

Whereas, the following additional bridge has been since identified as also requiring replacement, rehabilitation, or removal.

Now Therefore Be It Resolved by the Wabasha County Board of Commissioners that, the following bridge is a high priority and Wabasha County intends to replace, rehabilitate, or remove this bridge as necessary when funds are available.

Township or State Bridge Funds: 150,000

Be It Further Resolved that Wabasha County does hereby request authorization to replace, rehabilitate, or remove such bridge and authorizes the Wabasha County Engineer to request funds.

A discussion was held in regard to the Draft 2014-2023 Road & Bridge Improvement Plan.

 

HARMS - ROSCHEN

Resolution No.: 2014-122

Whereas, a letter of resignation has been tendered by John Graupner, effective June 2, 2014; and

Whereas, this will create a vacancy in the maintenance department; and

Whereas, the Wabasha County Administration department is requesting authorization to fill the position of custodian.

Now therefore be it Resolved by the Wabasha County Board of Commissioners that, the Wabasha County Board hereby accepts the resignation of John Graupner, Custodian.

Be it further Resolved by the Wabasha County Board of Commissioners that, the Interim Administrator is hereby authorized to advertise and fill the position of custodian in order to ensure the continued effective and efficient operations of the of the Maintenance Department.

Discussion was held in regard to the City of Wabasha Prosecution RFP. Consensus was given to allow the County Attorney's Office to submit a bill.

Commissioners met with Wabasha County high school students for County Day from 10:45 to 11:15, followed by a luncheon at the American Legion at 11:30 a.m.

Motion to go into closed session.

Resolution No.: 2014-135

Whereas, Minn. Stat. §13D.01 subd. 1(a) permits closing a County Board meeting for the purposes of discussing labor negotiation strategy;

Whereas, the County Board desires to consult with its attorney regarding the best course of action to take during the upcoming labor negotiations.

Whereas, the County Attorney has advised the Board that it is not possible to fully discuss strategy and the options available to the County in a public meeting that may be attended by the opposing party

Whereas, without such a meeting the County will have to make decisions without the full benefit of consultation with counsel, and is concerned that in such a situation, it could make poor or uninformed decisions, exposing the County and its taxpayers to liabilities and costs that could be avoided by fully informed decision making available only in a closed session with counsel.

Whereas, certain phases of the negotiation strategy may be impaired if every discussion is available for the benefit of opposing parties;

Whereas, the County Board wishes to meet with its attorney to discuss the pros and cons, and strategy regarding the labor negotiations, and finds that such a discussion cannot be had in public session.

Whereas, based upon the foregoing the Board finds there is an absolute need for confidentiality of this matter.

Now, Therefore, Be Resolved a closed meeting of the County Board addressing the labor negotiation strategy will be held with the County Attorney and other County staff. No subject matter other than the foregoing shall be discussed at said meeting.
