Meeting of August 5, 2014

 

The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, August 5, 2014 at 9:00 a.m.

 

The meeting was called to order by Board Chairman Springer.

The following Commissioners were present: Springer, Wobbe, Hall, Harms. Absent: Roschen

Motion to approve the consent agenda including the following:

Minutes: July 17 and July 22, 2014

Donation of $100 from Mayo Clinic Lake City, and $50 from American Legion Post No. 110, Lake City to the Youth Link Mentorship Program. Donation of $600 from Glen & Mary Polyard, Wabasha, to Veterans Service Office for Transportation to Medical Center.

Resolution No.: 2014-178

Whereas, Wabasha County has applied for and been granted $21,032 to apply toward expenses associated with the Wabasha County Emergency Management Office through the Emergency Management Performance Grant, and

Whereas, said grant is a 50% matching grant that is awarded through the Minnesota Department of Public Safety, Division of Homeland Security and Emergency Management, and

Now, Therefore, be it Resolved that Wabasha County enter into an Agreement with the Minnesota Department of Public Safety, Division of Homeland Security and Emergency Management, by the 2014 Emergency Management Performance Grant Contract.

Resolution No: 2014-179

Whereas, a letter of resignation was tendered by Full-Time Jailer Michael Eggenberger, and;

Whereas, Jailer Eggenberger's resignation is effective August 7, 2014, and;

Whereas, the vacancy created by Eggenberger's resignation will drop the Wabasha County Jail's staffing plan below the State mandated number of jailers required to operate.

Now Therefore be it Resolved the Wabasha County Board of Commissioners Hereby:

Accepts the letter of resignation of Full Time Jailer Michael Eggenberger.

Resolution No: 2014-180

Whereas, a vacancy for a Jailer position has been created;

Whereas, it is expected that this vacancy will be filled from an Eligibility List of applicants.

Whereas, the Wabasha County Sheriff is requesting authorization to hire a Jailer to fill this vacancy;

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that:

The Wabasha County Sheriff's Office is hereby authorized to hire a Jailer to fill the current vacancy, effective immediately.

Resolution No.: 2014-181

Whereas, Scott Swanson on behalf of Steeplechase Bluffs, LLC submitted a Conditional Use Permit application to allow for an event center, tubing hill, cabins, and camping on parcel R09.00162.06 located in the E ½, Section 17, Township 109 North, Range 14 West (59468 423rd Ave., Mazeppa); and

Whereas, The Wabasha County Planning Commission conducted a public hearing on July 28, 2014 to provide an opportunity for the public to present any testimony related to the request; and

Whereas, The Wabasha County Planning Commission discussed the matter and with a vote of 5-0 recommends to the Wabasha County Commissioners the request be approved without conditions.

Now Therefore Be It Resolved, the Wabasha County Board of Commissioners approves the Conditional Use Permit for Steeplechase Bluffs, LLC with no condition

Resolution No.: 2014-182

Whereas, Brian Hager requested a Conditional Use Permit to operate a trucking business on parcel R10.00093.00 located in the SE ¼, Section 30, Township 109 North, Range 9 West (57291 132nd Ave., Altura); and

Whereas, The Wabasha County Planning Commission conducted a public hearing on July 28, 2014 to provide an opportunity for the public to present any testimony related to the request; and

Whereas, The Wabasha County Planning Commission discussed the matter and with a vote of 4-1 recommends to the Wabasha County Commissioners the request be approved with the conditions as follows:

1. Access from the property in question to a public road shall be granted by the property road authority.

2. Maximum number of 30 units shall be allowed on the site. Each tractor-truck shall be a unit and each trailer shall be considered a unit. Dumptrucks will also be considered one unit.

3. All stormwater from the development should be directed to a stormwater retention basin designed by a professional to retain the runoff for a 10-year, 24 hour storm event.

4. Dust control shall be applied to the gravel driveway and parking lot on an as needed basis, but at least once a year.

5. The parking lot shall be screened from adjacent homes by way of a building or evergreen trees to be planted and maintained in a double row 8' apart until such screen is established to allow thinning as approved by the Wabasha County Zoning Department.

6. Proper MPCA and EPA permits shall be obtained and maintained for the business.

7. All semi-trucks shall enter and exit the site from the newly developed access.

Now Therefore Be It Resolved, the Wabasha County Board of Commissioners approves the Conditional Use Permit for Brian Hager with the above conditions.

HALL – WOBBE

Resolution No.: 2014-183

Whereas, Gary and Nancy Hayden have requested a Conditional Use Permit to allow for the construction of a dwelling on parcel R17.00277.00 located in the NW ¼, Section 26, Township 109 North, Range 14 West (57623 395th Ave., Zumbro Falls) that does not abut a public road, but instead has an easement to a public road; and

Whereas, The Wabasha County Planning Commission conducted a public hearing on July 28, 2014 to provide an opportunity for the public to present any testimony related to the request; and

Whereas, The Wabasha County Planning Commission discussed the matter and with a vote of 5-0 recommends to the Wabasha County Commissioners the request be approved with the condition as follows:

1. Construction and maintenance of a driveway shall be borne by the applicant/landowner.

Now Therefore Be It Resolved, the Wabasha County Board of Commissioners approves the Conditional Use Permit for Gary and Nancy Hayden with one condition.

Resolution No.: 2014-184

Whereas, Article 16, Section 5 of the Wabasha County Zoning Ordinances establishes a Board of Adjustment vested with the authority as provided by Chapter 394.21 through 394.37 of the Minnesota Statues; and

Whereas, The Wabasha County Planning Commission consists of seven (7) members as per the Wabasha County Zoning Ordinance; and

Whereas, The Wabasha County Board of Commissioners appoints the members of the Board of Adjustment; and

Whereas, Dean Flugstad has resigned from the Board of Adjustment and a replacement has been found who is willing to fill the remainder of him term.

Now Therefore Be It Resolved, The Wabasha County Board of Commissioners appoints Gayle Gillespie to the Wabasha County Board of Adjustment to serve a term that expires on December 31, 2014.

Resolution No.: 2014-185

Whereas, Project CP 79-14-8090 – Furnish and Apply Chloride with any and/or all Supplemental Agreements, Change Orders or Work Orders, has been completed.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that,

the Wabasha County Auditor/Treasurer be authorized to issue a warrant for final payment to Envirotech Services Inc. in the amount of $8396.38.

Resolution No.: 2014-186

Now Therefore Be It Resolved by the Wabasha County Board of Commissioners that, Wabasha County Highway Department is hereby authorized to: attempt to sell or donate for removal the existing building within the right of way adjacent to parcel 07.00146.00

Be it further resolved that, if sale or donation of building is not available than the Wabasha County Highway Department is authorized to seek bids for the demolition or otherwise removal of the building adjacent to parcel 07.00146.00.

Resolution No.: 2014-187

Whereas, the County has a approved Computer User Policy; and

Whereas, periodically it is necessary to establish new policies and procedures for effective administration; and

Whereas, it was noted during a recent review that it does not include a requirement for employees to lock access to their workstations when unattended.

Now there be it resolved by the Wabasha County Board of Commissioners that, the Screen Locking Policy as presented is hereby approved and is to be added to the County's Computer User Policy.

SPRINGER - WOBBE

Resolution No. 2014-188

Whereas, As part of the Women's Economic Security Act, the Minnesota legislature enacted a law that protects the ability of employees to discuss their wages with others; and

Whereas, the new law explicitly says that "[a]n employer that provides an employee handbook to its employees must include in the handbook notice of employee rights and remedies under [that] section."; and

Now Therefore Be It Resolved by the Wabasha County Board of Commissioners adopts the Wabasha County Employee Wage Disclosure Policy.

Finance Director, Deb Koenig, gave a quarterly financial report – budget, investment and cash flow.

 

HALL - SPRINGER

Resolution No.: 2014-189

Whereas, the following applicant wishes to have its "1 to 4 Day Temporary On-Sale Liquor License" approved: Mazeppa Area Jaycees, 63633 298th Ave, Millville, West Albany Township, and

Whereas, the liquor license will be in effect for August 16, 2014.

Now therefore be it Resolved by the Wabasha County Board of Commissioners hereby approves the "1 to 4 Day Temporary On Sale Liquor Licenses" to the Club listed above, subject to the approval of the State of Minnesota Liquor Control Commissioner.
