Meeting of August 19, 2014

 

The Board of County Commissioners of Wabasha County, Minnesota, convened in Regular Session at the Wabasha County Courthouse, in the City of Wabasha, Minnesota on Tuesday, August 19, 2014 at 9:00 a.m.

 

The meeting was called to order by Board Chairman Springer.

The following Commissioners were present: Springer, Wobbe, Hall, Harms. Absent: Roschen

Donation of $50 from Pepin Valley Dental, P.A. to the Youth Link Mentorship Program. Donation of $600 from the American Legion Auxiliary Unit 50 to offset transportation costs to the VA Medical Center.

Resolution No.: 2014-182

Whereas, Brian Hager requested a Conditional Use Permit to operate a trucking business on parcel R10.00093.00 located in the SE ¼, Section 30, Township 109 North, Range 9 West (57291 132nd Ave., Altura); and

Whereas, The Wabasha County Planning Commission conducted a public hearing on July 28, 2014 to provide an opportunity for the public to present any testimony related to the request; and

Whereas, The Wabasha County Planning Commission discussed the matter and with a vote of 4-1 recommends to the Wabasha County Commissioners the request be approved with the conditions as follows:

1. Access from the property in question to a public road shall be granted by the property road authority.

2. Maximum number of 30 units shall be allowed on the site. Each tractor-truck shall be a unit and each trailer shall be considered a unit. Dumptrucks will also be considered one unit.

3. All stormwater from the development should be directed to a stormwater retention basin designed by a professional to retain the runoff for a 10-year, 24 hour storm event.

4. Dust control shall be applied to the gravel driveway and parking lot on an as needed basis, but at least once a year.

5. The parking lot shall be screened from adjacent homes by way of a building or evergreen trees to be planted and maintained in a double row 8' apart until such screen is established to allow thinning as approved by the Wabasha County Zoning Department.

6. Proper MPCA and EPA permits shall be obtained and maintained for the business.

7. All semi-trucks shall enter and exit the site from the newly developed access.

Now Therefore Be It Resolved, the Wabasha County Board of Commissioners approves the Conditional Use Permit for Brian Hager with the above conditions.

Resolution No.: 2014-190

Be It Resolved that the Wabasha County Board of Commissioners enter into a grant contract with the Minnesota Department of Veterans Affairs (MDVA) to conduct the following program: County Veterans Service Office Operational Enhancement Grant Program. The grant must be used to provide outreach to the county's veterans; to assist in the reintegration of combat veterans into society; to collaborate with other social service agencies, educational institutions, and other community organizations for the purposes of enhancing services offered to veterans; to reduce homelessness among veterans; and to enhance the operations of the county veterans service office, as specified in Minnesota Laws 2013 Chapter 142 Article 4. This grant should not be used to supplant or replace other funding.

Be It Further Resolved that Nathan Pelz, the CVSO, be authorized to execute the grant contract for the above-mentioned program on behalf of the county.

Resolution No.: 2014-191

Whereas, from time to time, and employee's job function or duties may change from the original duties, and

Whereas, there has not been a policy that addressed the process of reviewing an employee's job function or duties, and

Whereas, the Policy Committee has created such policy, and

Whereas, the Wabasha County Policy Committee asks the Wabasha County Board to review and adopt the Position Classification Plan policy.

Now Therefore be it Resolved that the Wabasha County Board of Directors hereby adopts the attached Policy #400 – Position Classification Plan.

Resolution No.: 2014-192

Whereas, Lee D. Swanson, owner of parcel #R01.00212.00, property located at 38809 CR #3 Lake City, has provided a written request to the Wabasha County Board of Commissioners regarding the local option abatement for property tax payable in 2014.

Whereas, the Wabasha County Assessor has determined that fifty percent or more of the home was destroyed by fire on February 27, 2013, and the home is not livable.

Whereas, Mr. Swanson applied for and was granted an abatement for taxes payable in 2013 under MS 273.1233. He is applying for an abatement for taxes payable in 2014 under MS 273.1235.

Now therefore be it Resolved by the Wabasha County Board of Commissioners that a reduction in the 2014 property tax is granted on parcel #R01.00212.00. Since Mr. Swanson has moved to Goodhue County and does not plan on rebuilding, the reduction would be for the entire year of 2014 on the taxes that would be attributed to the home.

Resolution No.: 2014-193

Maintenance Agreements with Cities for 2015 (Option A)

Whereas, Wabasha County is obligated to maintain County State Aid Highways within cities throughout the County, and

Whereas, it is more expedient for the citizens of the listed cities to have those cities perform the maintenance activities of snow and ice control and removal, and sweeping and removal of debris.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the County of Wabasha enter into the attached agreements for the maintenance activities described above with the City of Elgin, Kellogg, Mazeppa, Millville, Plainview and Wabasha, and authorizes the Chairman of the Board and Clerk to the Board to execute the Agreements. The table below is a summary of the mileages and payment amounts of the agreements.

Resolution No.: 2014-195

Whereas, Wabasha County is authorized by Minnesota Statute 162.081 Subdivision 4 to distribute money apportioned to the County from the town road account in accordance with an adopted formula or as otherwise in accordance with Minnesota Rules.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, money apportioned to Wabasha County from the town road account shall be distributed to each township based upon the following:

% of Total Distribution Each Town's most recent % of all Towns'

45% Length of Town Roads

45% Population

10% Gross Road and Bridge Tax Capacity Rates

Resolution No.: 2014-196

Whereas, Wabasha County is dedicated to the maintenance and construction of a safe and efficient county road system while being responsive to the needs and values of the citizens of Wabasha County.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the attached Wabasha County Highway Department 2014 – 2023 Road and Bridge Improvement Plan is hereby approved.

Resolution No.: 2014-197

Whereas, Wabasha County recognizes the need for replacement of the Lake City Maintenance Shop, and

Whereas, Wabasha County finds it beneficial to all taxpayers to work cooperatively with other governmental agencies, and

Whereas, preparation of a proposal with the County's defined objectives is needed for continuing discussions with and consideration by the City of Lake City.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, Wabasha County

1. plans to replace the County Maintenance Facility located in Lake City

2. desires to work cooperatively with the City of Lake City on seeking cost effective solutions for facility needs

Be it further Resolved by the Wabasha County Board of Commissioners that, the Highway Committee prepare a proposal for the relocation of the County Maintenance Facility for further discussions and consideration by the City of Lake City including a County facility site plan.

Resolution No.: 2014-198

Whereas, Project CP 79-14-8100 – Aggregate Surfacing with any and/or all Supplemental Agreements, Change Orders or Work Orders, has been completed.

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that, the Wabasha County Auditor/Treasurer be authorized to issue a warrant for final payment to Roberson Lime & Rock Inc. in the amount of $3433.01.

Resolution No.: 2014-199

Now Therefore be it Resolved by the Wabasha County Board of Commissioners that,

The intersection of County Highway 25 and 2 remain an All-Way Stop.

Discussion was held on the Rural Addressing Ordinance and Maintenance. Item will be brought back before the end of the year.

 

HALL - HARMS

Resolution No.: 2014-200

Whereas, The State of Minnesota Board of Water and Soil Resources makes available to Wabasha County funding for the implementation of the septic program, local water plan, wetland conservation act program, and shoreland ordinance; and

Whereas, Funds for the various programs are made available through a Natural Resources Block Grant (NRBG); and

Whereas, The County Board must enter into an agreement with the Board of Water and Soil Resources to receive such grant funds.

Now Therefore Be It Resolved, the Wabasha County Board of Commissioners approves to enter into agreement with the State of Minnesota Board of Water and Soil Resources to receive funds through the Natural Resources Block Grant for fiscal year 2014 and 2015.
